Upon application of JOHN & SABINA BASILE, 510 Custer Avenue, South- old, NY for a Variance to the Zoning Ordinance, Article III, Section 100-31 for permission to construct addition to existing dwelling with reduction in frontyard setback at 510 Custer Avenue, Southold, NY; Fair- view Park Subdivision Map 3388, Lot 11; County Tax Map Parcel ID No. 1000-70-08-033. The board made the following findings and determination: By this appeal, appellants seek permission to construct a 13' wide addition extending 11 feet from the northerly wall of the present garage area leaving a setback from Custer Avenue at 42 feet. The premises in question contains an area of 20,125 square feet with 115.94 feet along Custer Avenue. Existing on the premises is a one-story one-family dwelling with attached garage which is set back 53 feet from Custer Avenue. After inspection of the immediate area, the board finds that the average frontyard setback of the existing homes is approximately 40 feet. In considering this appeal, the board determines that the variance request is not substantial in relation to the requirements of the zoning code; that the circumstances are unique; that by allowing the variance no substantial detriment to adjoining properties will be created; that the difficulty cannot be obviated by a method feasible for appellant other than a variance; that the relief requested will be in harmony with and promote the general purposes of zoning; and in view of the manner in which the difficulty arose and in consideration of all the above factors, the interest of justice will be served by allowing the variance as indicated below. On motion by Mr. Sawicki, seconded by Mr. Grigonis, it was RESOLVED, that Appeal No. 3074, application of JOHN AND SABINA BASILE, for permission to construct an extension to the existing garage leaving an insufficient frontyard setback at 42 feet, be and hereby IS APPROVED AS APPLIED FOR.
