Upon application of CHARLES AND CLAIRE WOOLLEY, 29 Oakridge Drive, Huntington, NY 11743, for a Variance to the Zoning Ordinance, Article III, Section 100-32 for permission to build garage/storage building in the frontyard area at premises known as 520 Private Road #12 (near Bayview), Southold, NY; County Tax Map Parcel No. 1000-078-06-006. The board made the following findings and determination: By this appeal, appellants seek permission to construct a 24' by 24' garage/storage building in the frontyard area of the subject premises five feet from the northerly side property line and five feet from the easterly front property line along Private Road. The parcel in question fronts along the Private Road approximately 118.32 feet and contains an area of approximately 14,850 square feet. Exist- ing on the premises is a one-family, one-story frame dwelling set back approximately 62 feet from the Private Road line. Applicants have stated the cesspools are located in the rear yard and therefore the rear yard would not be practical for this accessory building. The board agrees with the reasoning of applicants; however, the board feels that a minimum setback of 15' from the front property line along the Private Road is more feasible and within the spirit of the zoning ordinance. In considering %his appeal, the board determines: (1) that the variance request is not substantial; (2) that no detrimental effects to adjoining properties will be created; (3) that no adverse effects will be produced on available governmental facilities of any increased population; (4) that the circumstances are unique; (5) that the relief requested will be in harmony with and promote the general purposes of zoning, and (6) that the interests of justice will be served by allowing the variance, as indicated below. On motion by Mr. Douglass, seconded by Mr. Goehringer, it was RESOLVED, that Appeal No. 3158, application of CHARLES AND CLAIRE WOOLLEY for permission to construct 24' by 24' accessory garage, BE AND HEREBY IS APPROVED, SUBJECT TO THE FOLLOWING CONDITIONS: (CONTINUED ON PAGE TWO) DATED: October 4, 1983.
