Upon application for EDWIN W. STEWART, 8403 Parish Lane, Indianapo- lis, Indiana 46217, for a Variance to the Zoning Ordinance, Article III, Sections 100-31 and 100-34 for permission to construct addition to dwelling reducing the rearyard setback, at 20 Carole Road, Southold, NY; County Tax Map Parcel No. 1000-52-2-2. The board made the following findings and determination: By this application, appellant seeks permission to construct a 14' by 22' addition, reducing the rearyard setback at approxi- mately 17' from the existing bulkhead along Old Cove, Arshamomaque, Southold for use as additional living area. The parcel in ques- tion contains approximately 4,050 sq. ft. building area with 20' frontage at the end of Carole Road. Existing on the premises is a one-story frame house set back 40.8' from the westerly property line, one foot from the northerly property line, and 31' from the easterly bulkhead. The exact distance from the southerly line is not given, however, does appear to be eight feet at its nearest point from the bulkhead. It is the opinion of the board members that the addition should be in character with the homes along the east side of Carole Road, all of which appear to be set back no closer than 23 feet from the existing easterly bulkheads. Also, it is noted for the record that this parcel and the parcels in this area are located in an "A-4" Flood Zone, which requires a minimum elevation of 8' above mean sea level for new residential structures. The elevation of the parcel in question is at an average of 5.3' above mean sea level, as shown on the amended survey of February 3, 1983. In considering this appeal, the board determines: (1) that the practical difficulties have been shown and are sufficient to warrant the granting of the application as noted below; (2) that the relief as noted below is not substantial in relation to the (CONTINUED ON PAGE TWO) DATED: December 3, 1983. ( ) ( ) REASON FOR APPEAL A Variance to Section 280A Subsection 3 A Variance to the Zoning Ordinance is requested for the reason that we would like to convert our four room seasonal cottage into a year round home which we can enjoy in our retirement years. ]Ponn zsl (Continue on other side) REASON FOR APPEAL Continued 1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces- sary HARDSHIP becau~ the house and lot upon which it is located is positioned differently from other houses on Carole Road. The size of the lot and its location makes it impossible, under present zoning regulations~ to increase the outward size of the house without the necessity of obtaining a variance from the Board of Appeals. 2. The hardship created is UNIQUE and is not shared by ail properties alike in the immediate vicinity of this property and in this use district because the only alternative to obtaining a variance for this addition would be to add a second floor. This would not only substantially increase the cost but would require the installation of stairways which would become more and more difficult to ascent and descent as the years pass. 3 The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because this is the oldest of the seven houses ,: Carole Road. Over the years~ substantial improvements have been or are being made~ to five of the six remaining houses on this road~ with the view of converting them from seasonal cottages into permanent residences. I feel that my application for a 14' addition was a reasonable request, being both architecturely and economically sound for that location. Since the Board has by its own action previously granted a variance for a 12' addition~ leaving an 18' rear yard setback~ on Carole Road~ it would seem to me to be to late for it to establish a 23' setback line. What has already been granted to one should not have been denied to me. The additional two feet was requested because it would be the correct addition to make from an architectural point of view. In addition the placement of bookshelves on the interior wall of the addition would have reduced the additional floor space to be gained to approximately 12'. Anything less than that would hardly be a worth- while undertaking. My house is not and has never been in line with the other houses on Carole Road. As you know it faces in an entirely different direction, requiring a different evaluation and judgement from that of the other houses. While I am not rejecting the additional 8' that has been granted~ unless my original request for 14' can be reconsidered~ we will have to re-think~ replan or abandoned the entire project. An 8' additional in itself would not be worth the cost involved. Also~ from the distribution of the Board's decision it appears that other parties may have intervened in this appeal for their own future benefit. Perhaps~ they unduly influenced the Board's findings. I trust that this decision may be reconsidered with the above points in mind.
