Upon application for PATRICIA STEGNER, by Rudolph H. Bruer, Esq., Main
Road, Southold, NY for a Variance to the Zoning Ordinance, Article III,
Section 100-31, and for approval of access, New York Town Law Article 16,
Section 280(A)[3] concerning premises having insufficient area and width
and located on the west side of a private right-of-way off the south side
of Main Bayview Road, Southold, NY; County Tax Map Parcel ID No. 1000-
78-6-5 and 10.2.
The board made the following findings and determination:
By this application, appellants seek: (a) approval of access
pursuant to New York Town Law, Section 280-A, and (b) approval of
a parcel of land which was contiguous to the subject private road and
which contains insufficient area and width.
In researching the history of this property, it is noted that
the parcel in question is vacant and has been in single and separate
ownership since prior to the town's change in zoning from quarter-acre
to 40,000 sq. ft. It is also noted that the right-of-way in question,
indicated on the survey dated February 13, 1984 as "No. 2," is and
has since prior to 1966 been used as an access road to the existing
houses and parcels in the neighborhood and is not considered to be
a building lot. The Parcel indicated as "No. 3" contains an exist-
ing one-family seasonal dwelling and has been a single and separate
parcel quite some time before 1966.
For the reasons stated above, and in considering the character
of the neighborhood, the board determines: (1) that the relief as
granted will be consistent with the precedents set by the courts
under similar circumstances, (2) that the character of the neigh-
borhood will not be adversely changed, (3) that the circumstances
are unique, and (4) that the interests of justice will be served
by allowing the variance as indicated below.
Accordingly, on motion by Mr. Sawicki, seconded by Mr. Douglass,
it was
RESOLVED, that Appeal No. 3174, application for PATRICIA STEGNER,

1. That the right-of-way be cleared and resurfaced a minimum
width of 15 feet within the boundaries of the legal access road;
2. That the right-of-way be improved as follows in accordance
with #1, supra:
(a) Fill pot holes at intersection with Bayview Road with
a black top mix;
(b) Fill all the depressed areas, water-filled and others,
with the same type of gravel as used in the original road (which is a
mixture of small and medium-sized gravel at 70%, with 30% sand and
loam. (Ordinary bank run would not meet those requirements.)
(c) Grade surface smooth after all material is in place.
Location of Property: Private Right-of-Way off the south side
of Main Bayview Road, Southold, NY; County Tax Map Parcel No. 1000-
78-6-5.
Vote of the Board: Ayes: Messrs. Grigonis, Douglass, Goehringer
and Sawicki. Member Doyen of Fishers Island was absent. This resolu-
tion was unanimously adopted.

REASON FOR APPEAL
Continued
1. STRICT APPLICATION OF THE ORDINANCE would produce pradicaldifficultiesorunneces-
sary HARDSHIPbecause Applicants would be unable to utilize the property
for the purpose for which it was purchased, to wit: construction of
a one family dwelling. ~en the Applicants purchased these premises
in 1976, they believed that the property could be built upon.
The N.Y.S. Dept. of Environmental Conservation has issued their letter
stating non-3urisdiction, dated 3/29/83 and following a Board of Review
hearing on July 15, 1983, the Suffolk County Department of Health has
approved the location of tbs well and septic systems in connection with
the proposed c~nstruction on these premises.(Documentation is made part
of this application). Application has also been made to the Southold
TOWN Planning Board for the subdivision of this property, and is sched-
uled to be discussed at their October 17, 1983 meeting.
2. The hardship creotedis UNIQUE and isnot sharea by oil prope~ies alike in the immedia~
vicinit~ of this prope~y and in this use district because the dredged basin (shown on
survey submitted and accompanying photocopy of tax map) is at its
widest point to the v~st of the subject premises, cutting the depth
of this proper~y to approximately 70 feet less than the average lot
depth' along the easterly side of the dredged basin and canal, which
extends to the north and south of the basin.
3. The Variance would ob~rve ~e spirit ofthe Ordinance and WOULD NOT CHANGE THE
C~4ARACTER OF THE DISTRICT because the intended property use would be
consistent with the character of this residential district, and will
create only one additional lot.

the present existing gravel road in the above R.O.W. appears to be stable. I had no
difficulty in driving to the lot under appeal. ~here were some large water-filled

~he road is not centered in the R.O.W. It is closer to the east side. 1he width
for the first 250 Mt.*_ is 8 Ft. and the remaining length 12 Ft. .
~he first 50 Ft. is in good condition except f~r a few pot holes where it meets Main
Bayview Road.
I made 10 test holes in the remainder of the road length, including a few in the
water-filled areas. ~he material in all holes was a mixture of fine mud medium
size gravel wi~h some sand and loam at depths of from 3" to 4". 1he underlying
material was hard pacWed sand and loam. ~here was no frost in the ground as of
today.

I. STRICT APPLICATION OF THE ORDINANCE would produce practicaldifficultlesorunneces-
sary HARDSHIP because Applicants would be unable to utilize the property
for the purpose for which it was purchased, to wit: construction of
a one family dwelling. When the Applicants purchased these premises
in 1976, they believed that the property could be built upon.
The N.Y.S. Dept. of Environmental Conservation has issued their letter
stating non-jurisdiction, dated 3/29/83 and following a Board of Review
hearing on July 15, 1983, the Suffolk County Department of Health has
approved the location of the well and septic systems in connection with
the proposed csnstruction on these premises.(Documentation is made part
of this application). Application has also been made to the Southold
Town Planning Board for the subdivision of this property, and is sched-
uled to be discussed at their October 17, 1983 meeting.
2. The hardshipcreotedis UNIQUEand isnotshared by all properties alike in the immediate
vicinity ofthis property andinthis use district because the dredged basin (shown on
survey submitted and accompanying photocopy of tax map) is at its
widest point to the west of the subject premises, cutting the depth
of this property to approximately 70 feet less than the average lot
dept~ along the easterly side of the dredged basin and canal, which
extends to the north and south of the basin.
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because the intended property use would be
consistent with the character of this residential district, and will
create only one additional lot.
