FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on April 6,2017 at which time written and oral evidence were presented. Based upon all testimony,documentation,personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 1i267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The subject property is part of a larger family compound consisting of irregularly shaped parcels containing wooded areas, open fields and salt meadow. The proposed dwelling and pool will not be seen from the road since it is accessed by a long right of way and will be located -----b-ehind-tlie existing garage,—built prior to 1957,—and-the existing dwelling tliat-fronts on New Suffolk Avenue.-^The -- front yard faces woods and vineyard and the rear yard faces wetlands and Down's Creek. The undeveloped lot to the north,which shares a right of way also has additional road frontage on New Suffolk Avenue creating the potential for the applicant to be the sole user of the right of way. 2. _Town Law $267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than area variances. The applicant's lot consists of substantial wetlands with the building envelope limited to the western edge of the site. Working within strict confines presented by the NYS Department of Environmental Conservation and Town of Southold Trustees with regard to flagged wetlands and non-disturbance areas, the applicant proposes to increase the rear yard setback from the creek and thereby needs zoning relief from the front yard setback requirement of 60 feet.Additionally, the survey indicates that by placing the dwelling upland from the flagged wetlands they will benefit by Zone X flood rating. Without a typical rear yard placement of the pool can only occur in a side yard. The "as built" accessory garage has been in its current location since prior to zoning and will be located in a side yard when construction of the new dwelling is completed. 3. Town Law 4267-b(3)(b)(3). The variances granted herein are mathematically substantial, representing 26% relief from the code. However, the 30 foot right of way along the applicant's frontage will make the front yard setback appear to be compliant with the required 60 feet setback. Furthermore, given the site requirements of the sanitary system and dry well placement, odd shape of the lot and setback from the creek, variances are required to allow the existing garage to remain. As a result of environmental requirements and site development previously addressed the pool can only be located in the side yard. 4. Town Law 4267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant acquired the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase.
