BURGIO and ANGELA BURGIO, his wife , both residing at 28-28 212th Street, Bayside , New York t+ (}� - f.� LE.,1 1_i_. _. party of the first part, and GRACE FIORE, residing at 29 Valentine Drive , Albertson, New York party of the second part, Y1 WITNESSETH,that the party of the first part, in consideration of Ten Dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, '•�iRt� at Bay View, near Southold; in the Town of Southold, County of Suffolk and State of New York, known and designated as lots nos. 158 and 159 on a certain map entitled, "Subdivision Map of Cedar Beach Park" completed September 15, 1926 by Otto W. Van Tuyl, Surveyor and filed in the Suffolk County Clerk' s Office December 20 , 1927 as Map No. 90. t17 PREMISES known as 150 Sunset Way, Cedarbeach, Southold, New York. TOGETHER with all rights , easements and appurtenances set forth in all prior deeds of record. TOGETHER with all rights, title and interest, if any, of the grantors ' in and to beach, waters and lands under water of Canoe Inlet in front of and abutting said premises to the center line thereof; together with such rights as the grantors have the right to grant, of an ease- ment in common with others over the waters of Canoe Inlet, Cedar Beach Harbor and the inlet for ingress and egress by boat to and from Little Peconic Bay and to and from the above described premises; together with all rights, title and interest of the grantors, if any, in and to the private road known as Sunset Way in front of and abutting said premises to the center line thereof and subject to the rights of others to use said road. Simultaneously herewith the grantee has executed a purchase money mortgage in the amount of $ 40 , 000. 00, which mortgage is intended to be recorded simultaneously with this deed. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consid- eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose.
