SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated May 2, 2017 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued his recommendation dated July 19, 2017. Based upon the information provided on the LWRP Consistency Assessment Form submitted, as well as the records available, it is the coordinator's recommendation that the proposed action is INCONSISTENT with the following LWRP policy standards and therefore is INCONSISTENT with the LWRP: Policy 1 —The front yard, rear yard and lot coverage does not enhance community character and does not foster a pattern of development in the Town of Southold that enhances community character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location and minimizes adverse effects of development. Policy 4.IA—Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. The coordinator warns the possibility of property loss because structures are located within a FEMA Flood Zone AE base flood elevation six(6)feet. Policy 6.3 — Protect and restore tidal and freshwater wetlands. The coordinator cautions that structures are extremely close to the wetlands/waterbody and indicates that a dewatering drywell for the as-built pool is not shown in the plans. Furthermore, the top elevation of the bulkhead is unknown and the threat from the flooding of the property exists. Page 2,August 17,2017 #7072, Landers Family Trust SCTM No. 1000-137-4-4 However, the dwelling has the benefit of certificate of occupancy z 3228 dated August 28, 1968, and z 11366 and z 11367 dated December 16, 1982. The swimming pool has the benefit of area variance 3283 dated November 1, 1984 allowing the swimming pool in a side yard location and certificate of occupancy z 15424 dated November 25, 1986. The applicant further has the benefit of a trustees wetland permit number 7509 dated March 23, 2011 granting an existing dwelling, deck (without shed), in ground swimming pool with the condition drywells are installed to contain roof run-off in accordance with Chapter 236-Stonmwater Management of the Town Code, and as depicted on the survey stamped approved on March 23, 2011. The existing permitted structures and the trustees wetland permit therefore bring the project into consistency with the LWRP and make the project consistent with the LWRP. PROPERTY FACTS/DESCRIPTION: The subject property is a non-conforming 8,080 square foot parcel in the Residential R-40 Zoning District. The parcel measures 100.00 feet along the northerly property line fronting Stillwater Avenue, measures 84.55 feet along the easterly property line, measures 100.28 feet along the southerly property line adjacent to Eugene's Creek, and measures 77.05 feet along the westerly property line. The existing single family home consists of a one and one-half story frame dwelling with an attached garage and attached side yard deck with an in ground swimming pool with fencing and large green hedges blocking sight to the pool and decking from neighbors on the northerly and easterly portions of the property (front and side) on the survey prepared by Alphonse Pesce,Jr., L.S. updated on March 30, 2017. BASIS OF APPLICATION: Request for Use Variances under Article XXII, Section 280-116B and Article XXIII, Section 280-124 and the Building Inspector's April 10, 2017, Amended June 9, 2017 Notice of Disapproval based on the application for a permit to construct additions and alterations and to legalize an"as built"deck addition to an existing single family dwelling, at: 1) located less than the code required minimum front yard setback of 35 feet, 2) located less than the code required minimum rear setback of 35 feet, 3) located less than the code required minimum side yard setback of 10 feet, 4) more than the code permitted maximum lot coverage of 20% at 5705 Stillwater Avenue, (Adjacent to Eugene's Creek), Cutchogue,N.Y. SCTM#1000-137-4-4. RELIEF REQUESTED: The applicant requests area variances to alter the one and one- half story frame dwelling to a two story frame dwelling by adding a dormer over the 2nd floor garage and adding a covered porch over an existing brick and concrete platform, and to legalize an existing "as built" deck which surrounds an existing in ground swimming pool as shown on the updated survey dated March 30, 2017 prepared by Alphonse Pesce, Jr., L.S. The requested additions and alterations will result in a front yard setback of 18.2 feet, a rear yard setback of 16.8 feet, a side yard setback of 6.8 feet and lot coverage of 29.7%. ADDITIONAL INFORMATION: Notices to owners of adjacent parcels were mailed as required and no comments were received. A prior decision by this Board,Appeal No. 3283, dated November 1, 1984 granted an area variance to place an in-ground swimming pool in the front yard. According to the current owners, the decking from the residence side yard that surrounds the pool already existed when they purchased the property. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on August, 3, 2017 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: Page 3,August 17,2017 #7072,Landers Family Trust SCTM No. 1000-137-4-4 1. Town Law §267-b(3)(b)(1). Grant of the variances will not produce and undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood consists of a mixture of single and two story year round and seasonal houses. The front and side yard where the pool and deck are located are surrounded by mature plantings and a fence, and are not able to be seen from the front and side of the property. The addition over the garage will enable the continuation and redesign of the existing roof to accommodate the interior design of the second floor. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than the area variance. The "as built" deck already existed. The addition and alterations will afford the owners the space they request in order for their family to enjoy their residence. As previously mentioned the Board approved the in-ground swimming pool in the front yard in a November 1, 1984 decision. The applicant will seek additional approval by the Town's Board of Trustees for distance of the "as- built"structures to the bulkhead. 3. Town Law V67-b(3)(b)(3). The variances granted herein are mathematical substantial, representing 48% relief from the code for front yard setback, 52% for rear yard setback, 32% for side yard setback and 48.5% from the code for lot coverage. 4. Town Law X267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions of the neighborhood as long as the applicant complies with requirements of Chapter 236 of the Town's Storm Water Management Code and the Board of Trustee regulations and recommendations set forth in Trustee permit conditions. 5. Town Law X267-b(3)(b)(5) The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge!of the limitations on the use of the parcel under the zoning code in effect prior to or at the time of the purchase. 6. Town Law 276-b Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of the alterations and additions to the residence and the legalization of the "as built" deck while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Acampora, seconded by Member Planamento, and duly carried, to GRANT the area variances as applied for, and shown on the survey prepared by Alphonse Pesce, Jr. L.S., last updated March 30, 2017. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The alterations and additions to the dwelling roof must include the proper leaders and gutters and drains. 2. A dewatering drywell for the "as-built" pool shall be submitted and approved. 3. The applicant must comply with requirements of Chapter 236 of the Town's Storm Water Management Code 4. The applicant must comply with the Board of Trustee regulations and recommendations set forth in Trustee permit conditions. Page 4,August 17,2017 #7072,Landers Family Trust SCTM No. 1000-137-4-4 That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variances) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk, within three (3) years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1)year terms. i Vote of the Board: Ayes:Members Dantes (Vice Chair), Planamento, Acampora and Goehringer (Chairperson Weisman Absent), This Resolution was duly adopted(4-0). i i Eric L Dantes,Vice Chair Approved for filing / 1$ /2017 I D-1 CT: s AUG U 2017 ' A pIraH TDLI u - — i MJLJ _ /ITGH CTCO O - —-- ---- — VfrrG W - N _ f4OI±THWEST ELEVIQ.T'iokt UTNG7E67`-ELEVATIOU ._-_ _ - - 6duTwEA-ZT ELEVAT101.1, - - 26 ) =-=35=o"_:REAM. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the below listed Policy Standards and therefore is INCONSISTENT with the LWRP. Policy 1. Foster a pattern of development in the Town of Southold that enhances community character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development. The 18.2' front yard setback (35' required); rear yard setback of 16.8' (35' required) and lot coverage (exceeds the 20 percent maximum) does not enhance community character. Policy 4.1 Minimize losses of human life and structures from flooding and erosion hazards. i-4-3 107a A. Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. The structures are located within a FEMA flood zone AE base flood elevation 6'. It is unknown if the first floor elevation of the dwelling complies with FEMA standards. If the dwelling does not comply with the standards the threat of property loss from flooding is high due to the close proximity to the waterbody. There is no ability to relocate the structure out of the AE flood zone. At a Meeting of the Zoning Board of Appeals held on October 25, 1984, the above appeal was considered, and the action indicated below was taken on your [ ] Request for Variance Due to Lack of Access to Property New York Town Law, Section 280-a [ ] Request for Special Exception under the Zoning Ordinance Article , Section [X] Request for Variance to the Zoning Ordinance Article III , Sections 100-31 and 100-32 [ ] Request for Upon application of BERNARD AND GERALDINE DEMPSEY, Stillwater Avenue, Cutchogue, NY for a Variance to the Zoning Ordinance, Article III, Sec- tions 100-31 and 100-32, for approval of excessive lot coverage and construction of pool in an area other than the required rearyard located at 5705 Stillwater Avenue, Cutchogue, NY; Fleetwood Cove Subdivision Lots 16 and 17; County Tax Map Parcel N . 1000-137-04-004. The public hearing on this matter was also held on October 25, 1984. The board made the following findings and determination: This is an appeal to Article III: (a) Section 100-31 for approval of the construction of a 14' by 28' swimmingpool which will exceed the 20% lot coverage requirement for all structures, and (b) Section 100-32 for permission to locate an accessory pool and storage shed in the sideyard area. Article III, Section 100-31 permits a maximum of 20% of the total lot for construction. The premises in question fronts along Stillwater Avenue 100 feet in length and contains an area of approximately 7,250 sq. ft. Existing on the premises is a one-family, one-story dwelling and attached garage, which cover approximately 1 ,268 sq. ft. Twenty percent of the total lot area is 1 ,450 sq. ft. By an addition of the swimmingpool and 6' by 8' storage shed, the total lot coverage would be 1 ,708 sq. ft. , in excess of approximately 258 sq. ft. The appli- cant does not intend at this time to construct a deck and therefore is not under consideration by this board. The only other structures to be placed is a fence as required by Section 100-30(C)[2] enclosing the pool yard area. Article III, Section 100-32 requires all accessory buildings to be located in the rearyard area. The rearyard area of this parcel is limited with the dwelling- set back 12.5± feet from the wood retain- ing wall . The pool would be set back eight feet east of the dwelling within the sideyard area; the shed would be placed towards the rear along the easterly side of the dwelling. The board agrees that the (CONTINUED ON PAGE TWO) DATED: November 1 , 1984. CHAIRMAN, SOUTHOLD TOWN ZONING BOARD OF APPEALS Form ZB4 (rev. 12/81) Page 2 - Appeal No. 3283 Matter of BERNARD & GERALDINE DEMPSEY Decision Rendered October 25, 1984 —7®—7) RECEIVED areas in question are the most practical under the circumstances. APR 1 1 2017 In considering this appeal , the board determines: (a) that the relief as approved is not substantial; (b) by allowing the ZONING BOARD Uk relief, no substantial detriment to adjoining properties would be APPEALS created; (c) that no adverse effects will be produced on available governmental facilities of any increased population; (d) that the relief will be in harmony with and promote the general purposes of zoning; (e) the circumstances are unique; (f) that the interests of justice will best be served by allowing the variance, as applied and noted below. Accordingly, on motion by Mr. Grigonis, seconded by Mr. Goehringer, it was RESOLVED, that the relief requested under Appeal No. 3283, in the application for BERNARD AND GERALDINE DEMPSEY for approval of the location and construction of a 14 by 28 swimmingpool and 6' by 8' accessory storage building in the sideyard area, BE AND HEREBY IS APPROVED, SUBJECT TO THE FOLLOWING CONDITIONS: 1 . There be no adverse lighting to neighboring properties; 2. There be no elevated deck (above ground level ) unless reappli- cation is made for the additional lot coverage pursuant to Article III, Section 100-31 ; 3. There be no roofing; 4. The accessory shed be used for storage purposes only. Location of Property: 5705 Stillwater Avenue, Cutchogue, NY; Fleetwood Cove Subdivision Lots 16 and 17; County Tax Map Parcel No. 1000-137-4-4. Vote of the Board: Ayes: Messrs. Goehringer, Doyen, Grigonis and Sawicki . Member Douglass was absent (due to illness). This resolution was adopted by unanimous vote of the members present. GERARD P.
