RESOLVED, that the Southold Town Board of Trustees APPROVE the request for a
Transfer of Wetland Permit #3924 from Mark McDuffee to Dennis Hickey, as issued on
June 7, 1991, and,
BE IT FURTHER RESOLVED, that the Southold Town Board of Trustees APPROVE
the Amendment to Wetland Permit #3924 to include the pre-existing 7.3'X 16.3' shed
and the 12'X 14' platform.

confomls to the permit but the people purchasing our house have requested the fie. al inspectton. We do not
have a cop:< nor is one on file in the Trustee office.
We understand that the next field in~tions are scheduled for March 17 and woulcl like lo be

by (3) pilings. Located Breadwaters Drive and Mason Drive,
Cutchogue.' Is there anyone here who wishes to speak on behalf
of this application?
ROY HAJE: For the applicant, Roy Haje, Eh-Consultants. If you
have any questiens, I will answer them. I have nothing further
to add.
TRUSTEE KRUPSKI: What is the purpose of the two floats? It
seems like a pretty large float structure for that part of the
Creek there.
ROY HAJE: He now has 25' boat and was thinking of getting a
forty footer and he wanted to have the floats to get to the
depth.
TRUSTEE BREDE~EYER: O.K. The CAC had rec~n%~ended disapproval
feeling that this project was over sized for the location.
CAC suggest more accurate soundings. The CAC believes that
the soundings would show that if applicant would move the
catwalk as far to the west as possible, the applicant would
reach a deeper area faster. CAC suggest that the applicant
shorten the catwalk so that it does not extend further out then
the neighboring docks. Also the walk should be elevated at
least 4' above grade.
ROY HAJE: The sounding where done by somebody hired by the
applicant, so I did not do them myself. I believe that they are
quite accurate.
TRUSTEE KRUPSKI: The only problem I have is the floats. At such
tithe that he buys a 40' boat or whatever, he can c~me in and
~amend it if he needs the addition floats for s~lbility. If he
doesn't have that right now, I can't see te extend the float
system. He can always amend it without a preblem.
TRUSTEE SMITH: Roy, does this go out further then the neighbors
dock on either side?
~QY F~kJE: Henry, when I was there at the dock the docks weren't
out. Are they removable floating docks?
TRUSTEE SMIT~: I don't know.
TRUSTEE Ki{UPSKI: It seems like there is a bulkhead and a fixed
dock to the west. I cantt quite remember. Why don't we get the
aerial photo and look at this?
TRUSTEE BREDE~Ex~: Lets not. This is the public hearing. I
think if we have this much concern over the structure andit has
been awhile since we surveyed it, I think it might be wise to
conclude the hearing and maybe table the vote on the matter and
go take a lookat it. I there any more comments specifically
with respect to this application for or against? I will take a
motion to close the hearing.
TRUSTEE SMITH: So moved.

survey date May 24, 1991: "Remove 20' section of existing fixed
dock constr~et a 8' X 20' float and 3' X:.16' ramp." The platform
has been removed. Is there anyone here who wishes to speak on
behalf of this amended application? Is there anyone here Who
wishes to speak against this application? The Board's down
sizing request has been sullmitted. We could accept as amended
that portion of it when we go into the vote. ~earing no
comments, I will take a motion to close the hearing in this
matter.

application of Eh-Consultants on behalfpf IRA GORDON to
construct a. one~familydwelling, deck, L~ol, sanitary system
bluestone or similar pervious driveway. ~pproximately 750 c.y.
of fill will be trucked in from upland source. Construct a
fixed "L" dock consisting of 4' X 100' lbng. Wave Baffles will
be constructed on the outer sections as well as the southerly
40' of main dock section. Two pilings w~ll be placed within the
"L" section. To construct steps within the inter-tidal area to
provide access along the beach as per revised plan dated March
5, I99t. Located at Willis Creek Drive, Mattituek. The Board
had been out and looked at this site several times and there had
been some c~mnunications back and forth and an amendment. Is
there anyone here who wishes to speak on behalf of this
application?

TRUSTEE BREDE~EYER: CAC had comments against this. I will read

Trustees disapproval of wetland application [23-t0-3 Ira Gordon
to construc~ one-family, dWelling, deck, pool, sanitary system
bluestone or simila~ pervious driveway. Fix "L'~ dock consisting
of the aforementioned items we have mentioned, the Council has
concerns with the house and sanitary system I. horizontal
migrating of household sewage. Fill might cause runoff problems
to adjacent neighbors. Council also questions the accuracy of
the wetland line and would prefer to see the house and pool move
back 4-5 feet. Pool would have to back wash into a dry well.
Council disapproves the dock projects. Feels that the structure

its regular meeting held on June 6, 1991 regarding t~e above matter:
WHEREAS, JOHN GEIDEM3%N ON BEHALF OF MARK MCDUFFEE applied to the
Southold Town Trustees for a permit under the provisions of the
Wetland Ordinance of the Town of Southold, application dated April
23, 1991 and,
WHEREAS said application was referred to the $o~thold Town
Conservation Advisory Council for their findings and recommendations,

to said application on June 6, 1991 at which tirae all interested

Recommendation of Wetland Applications
On a motion by John Holzapfel, seconded by Stephen Angell, it was
RESOLVED to recommend to the Trustees that Wetland Application No.
81."I~16.3 of Joseph Spitaliere to install a 6' wide gravel walkway, construct
a ~,' x 299' tim'b~r catwalk which shall be constructed 4' over grade of
wetlands, to install an 8' x 12' swim platform which sahll be secured
by an anchored mporing and to remove and replace existing collapsed
drain line be TAaL~.D_. The CAC the Trustees should have the
applicant addr~ ,~ ~-~l[owing concerns:
1. ts the area a tern nesting ground? If so, what would the
the reaction be to the activity to take place in the area?
2. What is Ehe purpose of the drain and its location on the
adjacent !property?
3. There is,an osprey nest in the location of the catwalk. Would
the applicant be willing to relocate the nest and where?
4, Would the applicant be willing to delay activity during the
nes[ir{g season of the osprey and terns?
5. Where wduld the float/ramp be stored during the winter.
The CAC caninot make a recommendation of the application and suggests
the Trustees ~ithh~ld approval until these concerns are addressed
satisfactorily.
