Chairman Wilcenski: Good evening ladies and gentlemen and welcome to the June 5,
2017 Planning Board Public Meeting. The first-order of business is for the board to set
Monday, July 10, 2017 at 6:00 p.m. at the Southold Town Hall, Main Road, Southold,
as the time and place for the next regular Planning Board Meeting.

SUBDIVISIONS - STATE ENVIRONMENTAL QUALITY REVIEW ACT
(SEQRA)
SEQRA Type Classifications/ Set Hearing:
Chairman Wilcenski: Miller & Brinckerhoff Lot Line Change -This re-subdivision
proposes to transfer 0.55 acres from SCTM#1000-8.-1-6.5 to SCTM#1000-8.-1-5.1. Lot
6.5 will decrease in size from 6.7 acres to 6.15 acres, and Lot 5.1 will increase in size
from 3.71 acres to 4.26 acres. The property is located on Off East End Road, in Fishers
Island. SCTM#1000-8-1-6.5 & 8-1-5.1
Pierce Rafferty:
WHEREAS, this re-subdivision proposes to transfer 0.55 acres from SCTM#1000-8.-1-
6.5 to SCTM#1000-8.-1-5.1. Lot 6.5 will decrease in size from 6.7 acres to 6.15 acres,
and Lot 5.1 will increase in size from 3.71 acres to 4.26 acres. The property is located
on Off East End Road, Fishers Island; and
WHEREAS, SCTM#1000-8.-1-4.16 and SCTM#1000-8.-1-5 were merged by deed to
create SCTM#1000-8.-1-5.1 recorded in Liber 12901 Page 124; and
WHEREAS, March 31, 2017, the Planning Department requested by letter that the
applicant provide justification for compliance with the Lot Recognition standard in Town
Code §280-9 Lot Recognition to reflect the differences in configuration for SCTM#1000-
8.-1-6.5 and SCTM#1000-8.-1-4.16; and
WHEREAS, April 11, 2017, the applicant submitted by letter the map entitled "Minor
Subdivision Plan made for Robert J. Miller", prepared by Richard H. Strouse, dated
March 23, 1984 and last revised December 26, 1984 and the map entitled "Proposed
Lot Line Change Prepared for Rita M. Cushman, Trustee", prepared by Shepard B.
Palmer, dated March 11, 1982 and last revised November 15, 1988; and
WHEREAS, May 22, 2017, the Planning Board found the current configurations of
SCTM#1000-8.-1-6.5 and SCTM#1000-8.-1-4.16 to be in compliance with the Lot
Recognition standard in Town Code §280-9 Lot Recognition and found the application
complete; and
WHEREAS, the Southold Town Planning Board, pursuant to State Environmental
Quality Review Act (SEQRA) 6 NYCRR, Part 617, has determined that the proposed
action is an Unlisted Action as it does not meet any of the thresholds of a Type I Action,
nor does it meet any of the criteria on the Type II list of actions; be it therefore
RESOLVED, that the Southold Town Planning Board has determined that this proposed
action is an Unlisted Action under SEQRA as described above.

103-5-1. SCTM#1000-103-5-1 will increase from 0.43 acres to 1.05 acres and
SCTM#1000-103-5-5. SCTM#1000-97-8-31.2 will decrease from 22.21 acres to 21.59
acres in the R-80 and R-40 Zoning Districts. The property is located at 195 Little Neck

Chairman Wilcenski: Martz, Theodore C., Jr. - This proposal is for a Standard
Subdivision of a 1.62 acre parcel into two lots where Lot 1 equals 0.71 acres and Lot 2
equals 0.92 acres, located in the R-40 Zoning District. The Zoning Board of Appeals
granted an Area Variance to allow for Lot 1 to be less than 40,000 sq. ft. The property is
located at 555 Broadwaters Road, approximately 80' west of Wunneweta Road,
Cutchogue. SCTM#1000-104-12-6.1

WHEREAS, this proposal is for a Standard Subdivision of a 1.62 acre parcel into two
lots where proposed Lot 1 equals 0.71 acres and proposed Lot 2 equals 0.92 acres,
located in the R-40 Zoning District. The Zoning Board of Appeals granted an Area
Variance to allow for Lot 1 to be less than 40,000 sq. ft.; and
WHEREAS, on December 7, 2015, the pursuant to Planning Board State Environmental
Quality Review Act (SEQRA) 6 NYCRR, Part 617 issued a Negative Declaration on the
action; and
WHEREAS, on March 7, 2016 the Southold Town Planning Board determined that this
proposed action is Consistent with the policies of the Town of Southold Local
Waterfront Revitalization Program; and
WHEREAS, on March 7, 2016, the Planning Board granted Conditional Preliminary Plat
Approval upon the map entitled "Preliminary Land Division At Broadwaters", dated April
30, 2007 and last revised December 15, 2015, prepared by Kenneth M. Woychuck Land
Surveyor, with conditions; and
WHEREAS, on June 7, 2016 the applicant submitted a Final Plat Application; and
WHEREAS on June 20, 2016, the Final Plat Application was found to be complete; and
WHEREAS, on July 12, 2016 the Southold Planning Board found that the proposed
subdivision plat presents a proper case for requiring a park suitably located for

recreational purposes, but that a suitable park cannot be properly located on such
subdivision plat, and that the Planning Board will require $7,000.00 in lieu thereof,
pursuant to §240-53 G of the Southold Town Code; and
WHEREAS, A Final Road and Drainage Plan dated August 22, 2016 shows a new
notation that reads "Front yard Area to be Re-graded in the Future and Re-vegetated as
Per Planting Board Specifications", which was a request by the applicant that was not
approved by the Planning Board; and
WHEREAS on February 16, 2017 the Southold Planning Board received the draft bond
estimate in the amount of $6,425.00; and
WHEREAS on April 10, 2017 the Southold Planning Board accepted the draft bond
estimate dated January 24, 2017 in the amount of$6,425.00; and
WHEREAS, on April 10, 2017 a Public Hearing on the Final Plat was held and closed;
and
WHEREAS, the Planning Board has accepted the existing trees on Lot 1 as fulfilling the
street tree requirements pursuant to §161-44 Street trees of the Southold Town code.
The trees are located within the area that must not be cleared, and will be identified on
the Final Plat and Final Road & Drainage Plan; and
WHEREAS, pursuant to §240-37 Administration fee; an administration fee in the
amount of$4000.00 is required; and
WHEREAS, pursuant to §240-10 Technical Requirements, MIFDU regulations are not
applicable to this two lot subdivision; and
WHEREAS, the Planning Board has found that, with the exception of those identified in
the conditions below, all items pursuant to §240-20 Submission of Final Plat have been
met; be it therefore
RESOLVED, that the Southold Town Planning Board hereby grants Conditional Final
Plat Approval upon the maps entitled Final Plat Land Division at Broadwaters last
revised May 23, 2016, submitted to the Planning Board on June 7, 2016, and Final
Road and Drainage Plan at Broadwaters, dated April 30, 2007 and last revised August
4, 2016, prepared by, Kenneth M. Woychuck Land Surveyor subject to the following
conditions:
1. The Planning Board found that a suitable park cannot be properly located within
the subdivision. Please submit a park and playground fee in the amount of
$7,000.00 in lieu thereof, pursuant to §240-53 G of the Southold Town Code.
2. Submit the Administration Fee in the amount to $4,000.00 pursuant to §240-37 of
the Southold Town Code.

3. Submit proof of completed road and drainage work from the Town Engineer or
submit a performance guarantee in the amount of$6,425.00 pursuant to §240-
31.
4. Submit a Letter of Water Availability issued by the Suffolk County Water
Authority.
5. A Final Road and Drainage Map last revised August 4, 2016 and received by the
Planning Board on January 10, 2017, was submitted. The following changes are
required:
a. Please remove the Lot 1 notation that reads "Front yard Area to be Re-
graded in the Future and Re-vegetated as Per Planting Board
Specifications."
b. Label the buffer area on Lot 1 as "Natural and Undisturbed Buffer Area".
c. Show the species and size of five existing trees in good health located
near Broadwaters Road and label as Street Trees. The five existing trees
are being accepted by the Planning Board as fulfilling the Town Code's
street tree requirement pursuant to §161-44 Street trees.
6. A plat titled Final Plat Land Division at Broadwaters last revised May 23, 2016
was submitted to the Planning Board on June 7, 2016. The following changes are
required:
a. Provide metes and bounds of the Right of Way easement.
b. Hatch and label, the buffer areas on Lots 1 and 2 on each property
boundary as "Natural and Undisturbed Buffer Area".
c. The Suffolk County Department of Health Services approval stamp must
be issued on the Final Plat. Currently the stamp is on the Preliminary Plat.
d. Show the species and size of five existing trees in good health located
near Broadwaters Road as label as Street Trees. The five existing trees
are being accepted by the Planning Board in lieu of requiring planting
street trees pursuant to the Town Code.
7. File the signed Covenants and Restrictions and the Common Driveway
Easement documents with the Office of the Suffolk County Clerk, and upon filing
provide this office with a copy.
8. Submit to the Town Planning Department twelve (12) paper copies and four (4)
Mylar copies of the Final Plat that include all changes noted in these conditions,
and all endorsed by the Suffolk County Department of Health Services with their
approval stamp. In addition submit 12 copies of the Final Road and Drainage
plans.

9. The Final Plat must meet all Subdivision Map Filing Requirements as outlined by
the Suffolk County Clerk's Office. Please see the following link to their website for

Vice-Chairman Rich: The Estates at Royalton - This proposal is for a Standard
Subdivision of a 36.9 acre parcel into 12 lots where Lots 1-11 equal 0.7 acres, and Lot
12 equals 12 acres, located in the A-C Zoning District. This subdivision includes 15.2
acres of open space and 1.7 acres for a proposed road. The property is located at 55
Cox Neck Road, approximately 490 feet north of Sound Avenue, Mattituck.

WHEREAS, this proposal is for a Standard Subdivision of a 36.9 acre parcel into 12 lots

District. This subdivision includes 15.2 acres of open space and 1.7 acres for a
proposed road; and
WHEREAS, on November 28, 2017 the Southold Town Planning Board granted
Conditional Final Plat Approval upon the map entitled "Final Plat for the Subdivision
Map of Estates at Royalton", dated June 22, 2016 and last revised October 31, 2016,
prepared by Young &Young, Land Surveyors, subject to conditions, and
WHEREAS, Conditional Final Approval expires on June 28, 2017; and
WHEREAS, on May 15, 2017 the Applicant's Agent submitted a request for a six month
extension, be it therefore

SEQRA Type Classifications/ Set Hearing:
Chairman Wilcenski: North Fork SurgiCenter—This Site Plan is for the proposed
conversion of an existing 5,564 sq. ft. 1-story building (formerly SCWA office) with a
2,333 sq. ft. basement for storage, to a professional office (medical) and 16 parking
spaces on 1.15 acres in the Light Industrial (LI) Zoning District. The property is located
at 700 Boisseau Avenue, Southold. SCTM#1000-63-3-2

WHEREAS, this Site Plan is for the proposed conversion of an existing 5,564 sq. ft. 1-
story building (formerly SCWA office) with a 2,333 sq. ft. basement for storage, to a
professional office (medical) and 16 parking spaces on 1.15 acres in the Light Industrial
(LI) Zoning District, Southold; and
WHEREAS, the Southold Town Planning Board, pursuant to State Environmental
Quality Review Act (SEQRA) 6 NYCRR, Part 617.5 (c), determined that the proposed
action is a Type II Action as it falls within the following description for 6 NYCRR, Part
617.5(c)(2) replacement, rehabilitation or reconstruction of a structure or facility, in kind,
on the same site, including upgrading buildings to meet building or fire codes, unless
such action meets or exceeds any of the thresholds in section 617.4 of this Part. The
action is for the conversion of an existing 1-story building and basement, no footprint
expansion, to include a medical center for examinations and out-patient
procedures/surgeries; be it therefore
RESOLVED, that the Southold Town Planning Board has determined that this proposed
action is a Type II Action under SEQRA as described above.

Determinations:
Chairman Wilcenski: 13400 Main Road Corp. -This proposed Site Plan, in
conjunction with a pending Lot Line Modification, is for the addition of±9,258 sq. ft. of
land for ±23 parking stalls on 1.05 acres in the Hamlet Business Zoning District. The
property is located at 13400 NYS Route 25, ±10' s/w/o Wickham Avenue & NYS Route
25, Mattituck. SCTM#1000-114-11-9.6

WHEREAS, this proposed Site Plan, in conjunction with a Lot Line Modification, is for
the addition of±9,258 sq. ft. of land for 21 parking stalls on 1.05 acres in the Hamlet
Business Zoning District, Mattituck; and
WHEREAS, on October 15, 2015, the Zoning Board of Appeals granted Area Variance
#6888 as part of a Lot Line Change with the following condition: The applicant must

obtain Site Plan approval from the Planning Board. Failure to do so will render the
variance null and void; and
WHEREAS, on November 10, 2015 and November 16, 2015, Karen Hoeg, Esq.,
authorized agent, submitted an application for Site Plan review; and
WHEREAS, on December 7, 2015, the Planning Board found the application incomplete
and required revisions to the site plan with additional information; and
WHEREAS, the Southold Town Planning Board, pursuant to §280-133 C of the
Southold Town Code, has the discretion to waive any or all of the requirements in §280-
133 for those applications involving uses strictly related to agriculture as long as they
are not necessary to further the objectives set forth in Town Code §280-129 to maintain
public health, safety, and welfare. The Planning Board has found that this application is
eligible for a waiver of certain elements of the Site Plan requirements because it is an
existing site with no proposed expansion to the building footprint, the details of which
are included in the Staff Report dated December 7, 2015; and
WHEREAS, on July 11, 2016, the Southold Town Planning Board granted Final
Approval with one condition for a lot line modification on the maps entitled
"Boundary Line Alteration Situate Mattituck", prepared by John C. Ehlers, Land
Surveyor, dated November 1, 2014, with the following condition: The property
owner of SCTM#1000-114-11-9.6 must obtain Site Plan Approval for the additional
parking proposed on SCTM#1000-114-11-9.6; and
WHEREAS, on October 31, 2016, Karen Hoeg, Esq., authorized agent, submitted
revised site plans and additional information for Site Plan review as required; and
WHEREAS, on November 21, 2016, the Planning Board accepted the application as
complete for Site Plan review; and
WHEREAS, on December 5, 2016, the Southold Town Planning Board, pursuant to
State Environmental Quality Review Act (SEQRA) 6 NYCRR, Part 617.5 (c), determined
that the proposed action as an Unlisted Action as it does not meet any of the thresholds
of a Type I Action, nor does it meet any of the criteria on the Type II list of actions; and
WHEREAS, on December 14, 2016, the Planning Board, pursuant to Southold Town
Code §280-131 C., distributed the application to the required agencies for their
comments; and
WHEREAS, on December 16, 2016, the Southold Town Fire Inspector reviewed and
determined that there was adequate fire protection and emergency access for the site;
and
WHEREAS, on January 9, 2017, a Public Hearing was held and closed; and

WHEREAS, on February 6, 2017, that the Southold Town Planning Board, as Lead
Agency, pursuant to SEQRA, made a determination of non-significance for the
proposed action and granted a Negative Declaration; and
WHEREAS, on January 16, 2017, the Southold Town Engineer reviewed the above-
referenced application and has determined that the proposed building and site meet the
minimum requirements of Chapter 236 for Storm Water Management; and
WHEREAS, on January 17, 2017, the Mattituck Fire District determined there was
adequate fire protection for the site; and
WHEREAS, on January 20, 2017, the Town of Southold LWRP Coordinator reviewed
the above-referenced project and determined the proposed project to be consistent with
Southold Town LWRP policies with recommendations; and
WHEREAS, at their Work Session on January 23, 2017, the Planning Board reviewed
the proposed Site Plan and comments from the Public Hearing and required certain
revisions to the Site Plan; and
WHEREAS, on February 28, 2017, Karen Hoeg, Esq., authorized agent, submitted
correspondence requesting a discussion with the Planning Board regarding the items
required as a result of the January 23, 2017 work session; and
WHEREAS, at their work session on March 27, 2017, the Planning Board discussed the
requirements detailed in the January 27, 2017 Planning Board letter with the applicant;
and
WHEREAS, on March 31, 2017, the Planning Board sent a follow-up letter to the
applicant as a supplement to the January 27, 2017 Planning Board letter; and
WHEREAS, on May 16, 2017, Karen Hoeg, Esq., authorized agent, submitted revised
site plans and a check for payment to the Tree Fund as required; and
WHEREAS, on June 5, 2017, the Southold Town Planning Board determined that all
applicable requirements of the Site Plan Regulations, Article XXIV, §280 — Site Plan
Approval of the Town of Southold, have been met; therefore, be it
RESOLVED, that the Southold Town Planning Board hereby waives certain Site Plan
Application requirements as noted above.

Development Rights land; 22.8 acres in the A-C Zoning District. The property is located
at 1350 Alvahs Lane, ±1175' n/w/o NYS Rt. 25 & Alvahs Lane, Cutchogue.

WHEREAS, this-Site Plan is for the proposed construction of a 8,162 sq. ft. agricultural
storage barn (7,142 sq. ft. footprint and 1,020 sq. ft. attic storage) on Southold Town
Development Rights land; 22.8 acres in the A-C Zoning District, Cutchogue; and
WHEREAS, on August 29, 2016, William Ackerman, owner, submitted an application for
Site Plan review; and
WHEREAS, on September 12, 2016, the Planning Board accepted the application as
complete for review; and
WHEREAS, on September 19, 2016, the Planning Board, pursuant to Southold Town
Code §280-131 C., distributed the application to the required agencies for their
comments; and
WHEREAS, on September 22, 2016, William Ackerman, owner, submitted building
elevation plans with more detail to the Planning Board for review as requested; and
WHEREAS, on October 3, 2016, a Public Hearing was held and the Planning Board
heard comments from the public regarding the proposed project including, but not
limited to, concerns questioning the size and use of the building and on site operations
on Town Development Rights land. The Planning Board determined to hold the hearing
open with information to be provided by the applicant; and
WHEREAS, on October 7, 2016, the Planning Board sent a letter to the applicant
requesting certain information and materials regarding the building; and
WHEREAS, on October 21, 2016, William Ackerman, owner, submitted a floor plan
schematic and the second floor plan; and
WHEREAS, on November 1, 2016, the Planning Board sent a letter to the applicant
requesting a list of properties managed by North Fork Viticulture Services; and
WHEREAS, on November 4, 2016, William Ackerman, submitted materials and
information with regard to the 11/1/16 Planning Board letter; and
WHEREAS, on November 7, 2016, the Public Hearing was held open until November
21, 2016 for written comment; and
WHEREAS, on December 2, 2016, the Planning Board sent a request to the Zoning
Board of Appeals (ZBA), requesting an interpretation of the use of the barn as a base of

operations for a business that manages vineyards in other locations in addition to the
eight acres of vines on the subject property. During the Public Hearing, it was

WHEREAS, on May 8, 2017, the ZBA issued the following Code Interpretation for file
#7037: "The use as proposed by North Fork Viticulture Services (NFVS) to erect a barn
for the storage of equipment used in a business wherein NFVS manages vineyards
unrelated to the agricultural operation on the subject property, is not an allowed use or
accessory use, pursuant to Section 280-13(A)(2) of the Town Code of the Town of
Southold"; therefore be it

application for review; and
WHEREAS, the two subject lots were created by the Planning Board in the 3-lot
subdivision map of Giora Hanoch and Harold Watts, filed map number 9059, February
1, 1991. The subdivision created a 110' x 110' building envelope for Lot 14.6 (aka Lot
#3) setback 100' feet from County Route 48 and a common driveway with the adjacent
lot to the west (aka Lot#2). The building envelopes and common driveway were created
for a presumed future residential use, however the uses for the two lots are now a
church and this proposed winery Site Plan. Neither the building envelopes nor the
common driveway are practical for the proposed winery and existing church,; and
WHEREAS, the Planning Board has considered the original purpose of the common
driveway and the building envelopes, as well as the new locations of the existing and
proposed structures and found that any impacts are being addressed in this site plan
process; and
WHEREAS, on September 1, 2015, the Planning Board provided comments to the
Zoning Board of Appeals (ZBA) with regard to the requested area variances for file
#6882 and did not process the application until a decision was rendered by the ZBA;
and
WHEREAS, on March 21, 2016, the ZBA issued a determination for file #6882 with
three (3) conditions; and
WHEREAS, on April 18, 2016, the Planning Board found the application incomplete for
review and required additional information and revisions to the Site Plan; and
WHEREAS, on September 14, 2016, Anthony Sannino, owner, submitted information
and revised site plans for review; and
WHEREAS, on September 27, 2016, Anthony Sannino, owner, submitted information
and supplemental plans for review; and
WHEREAS, at the Work Session held on October 3, 2016, the Planning Board accepted
the application as complete for review; and
WHEREAS, on October 3, 2016, the Southold Town Planning Board, pursuant to State
Environmental Quality Review Act (SEQRA) 6 NYCRR, Part 617, determined that the
proposed action is a Type II Action pursuant to §617.5(c)(3) "agricultural farm
management practices, including construction, maintenance and repair of farm buildings
and structures, and land use changes consistent with generally accepted principles of
farming" and, therefore, not subject to further review; and
WHEREAS, on November 3, 2016, the Planning Board, pursuant to Southold Town
Code §280-131 C., distributed the application to the required agencies for their
comments; and

WHEREAS, on November 7, 2016, a Public Hearing was held and determined to
remain open for more information; and
WHEREAS, on November 9, 2016, the Planning Board sent a letter to the applicant

with regard to the November 9, 2016 Planning Board letter; and
WHEREAS, on December 5, 2016, the public hearing was continued and then closed;
and
WHEREAS, on December 6, 2016, the Architectural Review Committee provided
comments to the Planning Board that the application had been tabled due to insufficient
plans and information; and
WHEREAS, on December 14, 2016, the Southold Town Fire Inspector provided
comments to the Planning Board; and
WHEREAS, on December 14, 2016, the Southold Town Engineer reviewed the
proposed application and required revisions in order for the proposed drainage to meet
the minimum requirements of Chapter 236 for Storm Water Management; and
WHEREAS, on December 15, 2016, the Town of Southold Local Waterfront
Revitalization Program Coordinator reviewed the proposed project and determined it to
be consistent with Southold Town LWRP policies with certain recommendations to the
Planning Board to be implemented; and
WHEREAS, on January 3, 2017, the Cutchogue Fire District determined there was
adequate fire protection for the site; and
WHEREAS, on January 4, 2017, the Suffolk County Planning Commission (SCPC)
reviewed the proposed project and considered it to be an action for local determination
as there appears to be no significant county-wide or inter-community impact(s); and
WHEREAS, at their work session on January 23, 2017, the Planning Board reviewed
comments from referrals with regard to parking and building location; and
WHEREAS, on January 26, 2017 the Planning Board sent a letter to the applicant
summarizing the determinations made by the Board regarding parking and building
location and notifying them that review of the application with regard to Traffic Safety
would continue at the next available work session; and
WHEREAS, at their work session on February 6, 2017, the Planning Board continued
the review of comments from referrals with regard to Traffic Safety; and
WHEREAS, on February 8, 2017, the Planning Board sent a letter to the applicant
requiring certain information and revisions to the site plan; and

WHEREAS, on March 7, 2017, Anthony Sannino, owner, submitted a revised site plan
and information requested by the Planning Board; and
WHEREAS, on March 21, 2017, Anthony Sannino, owner, submitted a revised
photometric plan and a traffic routing plan as required; and
WHEREAS, on March 27, 2017, the ARC approved the Site Plan as submitted; and
WHEREAS, on April 6, 2017, the Southold Town Chief Building Inspector reviewed and
certified the proposed winery as a permitted use in the A—C Zoning District pursuant to
ZBA file #6882; and
WHEREAS, on April 10, 2017 the Planning Board re-opened the Public Hearing due to
changes to the location of the parking and building on the revised Site Plan. These
revisions included the relocation of the building sixty-five (65) feet closer to CR 48, and
the relocation of the parking areas from the front of the building to the side and rear of
the building. The Board found that a hearing on the revised plan was necessary to
provide adjacent neighbors and the general public the opportunity to comment on these
changes; and
WHEREAS, on April 10, 2017, the Public Hearing was closed;
WHEREAS, at their Work Sessions on April 24, 2017 and May 22, 2017, the Planning
Board reviewed all input from the Public Hearing and staff recommendations were
considered and incorporated to the satisfaction of the Planning Board; and
WHEREAS, the Planning Board has found that, as reflected in the record for this Site
Plan application, there are potential impacts from noise, parking, traffic safety,
pedestrian safety, and adverse impacts to the established character and value of the
adjoining properties that must be adequately addressed in the Site Plan approval
process, and that these issues have not been completely addressed in the Site Plan
application referenced herein and the proposed Site Plan; and
WHEREAS, the Planning Board has identified revisions to the proposed Site Plan, and
additional conditions for this site which address and mitigate these identified areas of
concern and potential adverse impacts. These conditions and their expected mitigating
effects are as follows:
1. The maximum number of people/patrons on the winery site is limited to 235, not
including the Bed & B location or employees;
This condition (above) is intended to limit intense use and large crowds on site which
can create traffic safety hazards, pedestrian safety hazards, and adverse impacts on
the established character and value of adjoining residential properties to the east,
the adjacent church to the west and noise pollution.

2. The maximum number of vehicles permitted on site is 39. There is no additional
parking permitted on site or on adjacent properties. The applicant shall not direct
people to park on public streets including CR48;
This condition is intended to provide a fixed number of vehicles permitted on the site
for the purpose of wine tasting. The rationale for this condition is based on the
number of parking spaces that can be safely accommodated at the site, and
potential adverse impacts identified on the Planning Board's record (a summary of
which can be found in the Planning Staff Reports dated January 23, 2017 and
February 6, 2017). The safety of the public and the quality of life of the neighbors will
be better served by controlling the amount of vehicles that visit this site.
3. Limousines and Buses;
Limousines and Buses must park in the oversize spaces on the west side of the
building, and are permitted in the following numbers and combinations:
a. Maximum number of limousines at any one time is five (5);
b. When 4 or 5 limousines are on site, no buses are permitted;
c. Maximum number of buses at any one time is-two (2);
d. One limousine is permitted when two buses are on site;
e. Up to three limousines are permitted with one bus on site.
4. All vehicles must remain with their patrons on site at all times. No drop-off
permitted except for ride sharing, public transit or taxi;
Town Code Section 280-78 H requires that parking for the use of the site be
contained on site. Traffic safety hazards are increased as vehicles exit and enter CR
48, where traffic typically travels at 55 mph or greater, with no acceleration or
deceleration lanes at this site. This condition limits the number of times a large
vehicle will exit and enter CR48. By preventing the drop-off of patrons, the condition
also limits the impacts of limousines and charter buses that might otherwise park
and idle in residential neighborhoods while they wait to be called to pick up their
passengers;
5. Parking in designated parking areas only, as shown on the approved Site Plan;
This is intended to minimize any parking conflicts between large vehicles permitted
on site;
6. The 17 gravel parking stalls facing the building are to be the primary parking
stalls;

This condition is intended to focus parking towards the building, away from the
adjacent residential parcels,
7. The Traffic Routing Plan provided is required to be distributed to all driver/livery
companies ahead of time and shall be provided/displayed for all potential patrons
on the company website;
This condition is intended to provide a safe route to access the site that utilizes
controlled intersections and avoids any U-turns;
8. No more than 12 special events, as defined by Southold Town Code, per year.
This condition is due to the small size and shape of the site, which places the winery
building and activities within close proximity to adjacent residences and church, and
will reduce the potential noise impacts to those neighbors; and
WHEREAS, on June 5, 2017, the Southold Town Planning Board determined that all
applicable requirements of the Site Plan Regulations, Article XXIV, §280 — Site Plan
Approval of the Town of Southold, have been met with the exception of the conditions
listed below; therefore be it
RESOLVED, that the Southold Town Planning Board has determined that this proposed
action, upon meeting the conditions listed herein, is consistent with the policies of the
Town of Southold LWRP.

building to clearly indicate the limits of the grass area approved for parking;
11.Stormwater Requirements pursuant to §236:

a. Provide erosion and sediment controls for the proposed project;
b. Provide the Trench Drain at a minimum of eighteen (18") inches wide. The
Cross Section shown for the Trench Drain has been loosely indicated as
being 8" to 51" inches in width;
c. The drainage calculations for the proposed gravel utilize a runoff
coefficient of 50% for the gravel parking area and must be changed to
100%; the drainage design must then be amended accordingly;
d. The drainage calculations must include the areas indicated as the Patio
and the Crush Pad;
e. Provide certification from a NYS licensed engineer that stormwater from
this site will not reach waters of the State. If this certification cannot be
shown, then a NYSDEC Storm Water Pollution Prevention Plan (SWPPP)
will be required if the area of disturbance for this site plan is greater than
one acre;
f. All work within the Right-of-Way on County Route 48 must meet the
minimum requirements of County Specifications.
12.Provide at least five (5) prints of a revised Site Plan including the stamp, seal and
signature of the NYS licensed professional preparing the plan, with all the above
conditions reflected on the revised plans;
13.Obtain SCDHS approval and a provide a print with the SCDHS approval stamp
upon the current revision of the Site Plan to this department, and including the
stamp and seal of the NYS professional preparing the plan;
14.File the lot merger and C&R's required by SCDHS;
15.Provide a draft of the Covenants and Restrictions (C&R's), including conditions 1
through 8 above, to the Planning Board for review and approval (template to be
provided by Planning Department);
16.File the C&R's (after the draft is approved by the Planning Board) with the Office
of the Suffolk County Clerk and submit a receipt of the filing to this department

10 questions . It just strikes me that
11 the size of the board -- of the barn
12 is out of proportion to the
13 landscape . So I would just like to
14 understand why a 4 , 000 plus square
15 foot barn is necessary. I would like
16 to understand how the equipment that
17 is going to be stored in the
18 effectuated, whether it ' s from the
19 road or whether it ' s from Soundview
20 Avenue, which is used as bicycle
21 scenery. And along which there are
22 many runners . So that is my second
23 question. My third question is, I
24 noticed that there is lighting
25 proposed against the barn . I would

4 make sure that the barn is used for

10 probably answer a few of those . I
11 don ' t know if you saw the plans but
12 the landscaping does show numerous
13 Evergreens planted along Soundview
14 Avenue from the road. All site plan
15 applications have to be Dark Sky
16 Compliant and to code as far as
17 lighting . And as far as storage, I
18 believe from what we have gone
19 through, it ' s just an addition for an
20 area to store equipment on the farm
21 there . That ' s the best that I can
22 do, unless anyone else wants to
23 address those questions .
24 MS . DALY: Well, the only comment
25 that I would make is that I live

1 right across the road and I am pretty
2 familiar witty the equipment that is
3 used on the farm. And it seems , to be
4 that a 4 , 000 plus square foot barn is
5 very, very large in comparison to the
6 equipment that is run on the farm.
7 So that is just one of the questions
8 that I had that prompted me to come
9 to the hearing today.
10 CHAIRMAN WILCENSKI : Okay. Well,
11 we will look into that . All the
12 testimony that we take tonight, we do
13 look into it . We will find out and
14 we will ask the owner or owner ' s
15 agent to find out what type of
16 equipment will be housed there .
17 MS . DALY: Okay. And then in terms
18 of the Suffolk County regulations, once
19 you approve the usage, of the barn for
20 storage can it be used for any other
21 purpose?

23 MS . DALY: All right, I did talk to
24 Mr . Terry a couple of weeks ago . The
25 setback from the road is 60 feet as I

14 a very large barn with supposedly to
15 house equipment . And the question
16 is, how is that equipment getting to
17 the barn? Because the question
18 previously was, there is a dirt road
19 there . But if there are trucks and a
20 lot of other equipment using
21 Soundview Avenue and a bike path, but
22 there is also an enormous amount of
23 children and people walking up and
24 down, bicycling and it ' s sort of
25 fairly slowed traffic road. And I

1 would imagine that is a bit dangerous
2 to some of those people if you have
3 large trucks . So I have some
4 concerns with that .

6 will investigate and ask the
7 applicant about the sizes of those
8 vehicles and how they will be
9 maneuvered from property to property.

18 road. And okay, he has a few trees
19 there . We have spent a lot of money
20 and time on our property and
21 everything is the way that we want
22 it . And across the street, we have
23 nothing but junk. We ' re paying very,
24 very high taxes . You can look it up
25 and find out . And I am not too

1 pleased that I am going to be looking
2 at shrubs , plus I am going to be
3 looking at a barn with chickens and
4 what not and what not . I moved from
5 the city and I paid a lot of money on
6 my house and I pay a lot of taxes .
7 And I have another problem. From the
8 farm, I have -- when it rains a lot,
9 all of the runoff water comes down my
10 drain and onto my property and I have
11 a lake . And I spoke to Mr . Orlando .
12 I spoke to everybody in Town. And
13 you know what, nobody cares .
14 CHAIRMAN WILCENSKI : Can you
15 clarify that the water is coming from
16 that farm?
17 MS . STANISIC : You can see when it ' s
18 raining, the water is flowing towards
19 my property and goes down my driveway.
20 CHAIRMAN WILCENSKI : From the farm

22 MS . STANISIC : From the farm. My
23 neighbors can verify it . I have a lake .
24 A lake . I lost a snow blower, a
25 lawnmower, all the equipment in my

1 garage because I have a lake . And I
2 have two big drywell ' s on my property .
3 And this has been happening since the
4 vineyard was put in . Okay. You

9 have drywell ' s for all those surface
10 water .
11 MS . STANISIC : I spoke to Mr . Orlando .
12 He came and inspected my property. He
13 saw pictures of my lake . I am not
14 kidding . Lakes . Water up to here . And
15 I pay heavy, heavy taxes there and I
16 would like to be compensated. At
17 least fix the street fix the property
18 across the street . So we have a nice
19 neighborhood. That is why we moved here .
20 We want to live here . As you know,
21 taxes are enormous on Soundview Avenue
22 on the water. I don ' t mind paying for it
23 but I want to be compensated for
24 something .

2 parcel that is owned by Suffolk County
3 and Suffolk County would prefer that all
4 that shrubbery be removed in order to
5 comply with Open Space . However, what
6 Suffolk County is going through right

9 Getting beyond that, it ' s an internal
10 parcel . Development rights intact and
11 that ' s where we ' re building the barn.
12 It ' s going where it ' s going because
13 that ' s the only place it ' s allowed to
14 go . And then as -- in respect to the
15 equipment on the farm, the equipment is
16 on the farm. That particular farm is --
17 they have no other farm to go to .
18 They ' re not traveling up the road to go
19 someplace else . It ' s all right there on
20 those parcels that are in the parcel .
21 They ' re all part of One Woman Vineyard.
22 And then in respect as far as roof water
23 runoff, of course, on the site place we
24 addressed that . And one o the reasons
25 for the barn is to, Number 1, get rid of

2 plastic coup-house . So that goes . As
3 far as the farm equipment, it ' s a
4 vineyard operation. It ' s not a wine

9 They ' re not going to be traveling up and
10 down the road. I am sure they access
11 that dirt road from time to time, you
12 know, most of what they do is internal to

18 I am a resident in the Town of Southold.
19 I am also a local winery owner . I have
20 two wine businesses here in the Town.
21 One of them is a winery and one of them
22 is a wine making and wine consultant
23 business . So actually, I have a personal
24 interest in this matter . I was invited
25 to speak in favor of the project . Which

1 I am. For one, it ' s a fantastic
2 opportunity to preserve open space and
3 to preserve agricultural tradition . For
4 the second reason, an opportunity for the
5 family and value to our property. Both
6 at the property level and the business
7 level, but also to create a legacy for
8 their family and future generations .
9' This is a fanatic business idea and to
10 have a retail component to it, only
11 adds to their margin of profit as well .
12 And of course, what I would love to see
13 if this project to get approved and
14 sends a clear message to the wine
15 industry, that the Town is supportive of
16 our industry and very interested in
17 seeing responsible and respectful folks
18 like the Shanks Family. In promoting
19 good business and providing jobs to the
20 Town . I would like to point out that
21 such a business as this will incorporate
22 a lot more than simply retail and cash
23 registers . Any sort of business of this
24 nature incurs a number of high skill
25 and high paying jobs, such as IT, HR,

1 PR and Marketing, Graphic Design, and
2 they are all very respectful professions .
3 All part of the general wine industry
4 community. And I would also like to urge
5 the Planning Board to make an approval
6 for this application . As I understand it
7 has been working the circuit for a while
8 with some questions as to what a winery
9 and what a tasting room is and how it ' s
10 defined. I would like to offer that it
11 is and already defined at State levels .
12 And that there isn ' t any place in the
13 New York State Law ' s or New York State
14 Ag ' s and Market ' s or the New York State
15 Alcohol Laws which allows for a local
16 township to define what is tasting room
17 and what is a tasting . So it could be
18 just that simple . And mostly because
19 they' re personal friends to me . I would
20 like to see them be able to continue and
21 expand their business and grow their
22 business in their vision. And will
23 continue running a happy and health
24 business . So thank you .

16 Murray and I am a resident on Ackerly
17 Pond and Lower Road. Right down from
18 where this project is being proposed.
19 Thank you for the opportunity to
20 speak to you tonight . I would like
21 to voice my opposition for this
22 project as proposed for the following
23 reasons . First of all, the
24 inheritant use of this space is not a
25 testament as to Mr . Shanks or his

1 person, but he ' s asking for a
2 approval for the change of land use
3 that is in perpetuity. So if the
4 property transfers, we don ' t have the
5 assurance of the applicant that they
6 will conduct themselves in a high
7 manner that he has represented
8 himself . It ' s also a major change to
9 that lot . As a bar owner and a
10 restaurant owner for the last
11 14 years , what I understand is, that
12 the proposal now is to introduce the
13 sale of alcoholic beverages for
14 onsite consumption. That in and of
15 itself is a gift that has been
16 offered to farmers, vineyards to
17 promote the industry but I don ' t know
18 that the State has really taken the
19 impact to heart and how it affects
20 the community. Where every piece of
21 land that grows ten acres of grape,
22 has the capability has the ability to
23 open up a bar . As a bar owner, I
24 realize that elevated responsibility
25 that I have because of my business to

1 the community and to ensure public
2 safety. As proposed, the location of
3 this entity on Lower Road, which is
4 already a harrowing intersection,
5 will only exacerbate and we have to
6 look at what the clientele is doing
7 while they are at this location . Not
8 everyone will go there and drink to
9 access ss . And as a responsibile
10 owner, you must do everything within
11 your grasp to ensure that your
12 patrons are able to enter and exit
13 safely but some fall through the
14 cracks . The traffic impact, I read
15 the response from the applicant ' s
16 attorney where the solution for the
17 density of traffic on a difficult
18 corner was to send them down a
19 tertiary road onto Ackerly Pond, a
20 residential neighborhood. So while
21 this site may not challenge to Main
22 Road, or some see that it does, it
23 does present a challenge to Lower
24 Road and Ackerly Pond, a residential
25 neighborhood. Where an estimate --

1 what they had offered was 18 parking
2 stalls based on their traffic study
3 and would affect 54 trips per day on
4 a weekend. However 39 parking spaces
5 are proposed, which is a total of
6 117 trips per weekend day using the
7 applicants calculations . And their
8 responses to send it through the
9 residential neighborhood and not to
10 put it onto a commercial route road.
11 Occupancy. The indoor occupancy
12 proposed is 30 persons and a septic
13 system designed to support 30
14 occupants . If you look at the plans,
15 two toilets . However, the proposed
16 outdoor capacity is 124 visitors per
17 the December 1st 116 letter from
18 Counsel Abigail Wickham. Therefore
19 the total occupancy is 154 people
20 with parking lot for 39 cars and a
21 septic capacity for a convenience
22 store . Well, I am in the business of
23 selling alcohol . I can tell you one
24 of the most important functions of my
25 business is having enough sanitary

1 capacity for my clientele . So this
2 says the only way that this would be
3 resolved -- and I want to remind the
4 Board, as a tavern owner, I never
5 bought a chair hoping no one would
6 sit it in. Run a business is
7 economics . The capacity is 154
8 people and that is how many customers
9 you need in that business all the
10 time . The proposed 4 , 487 square feet
11 that is 1, 933 square feet plus 2 , 554
12 of outdoor space is dedicated for
13 public serving . They want to reserve
14 their right to have trucks . They
15 want the right to have unregulated
16 private events . The applicant
17 refused to state if live and
18 amplified music will be providing,
19 citing that if the Planning Board did
20 not have the authority to ask this
21 question . The importance of gaming
22 the neighbors, the true community,
23 Ackerly Pond, Lower Road, South
24 Harbor, is to address the issues as a
25 business owner that serves alcoholic

1 beverages to the public . I would
2 love to think that every one that
3 walks through that door is 154 wine
4 connoisseurs, but that is not the
5 case . What is being proposed is a
6 business . A business that has never
7 operated on that site . And if you
8 look through the file, the neighbors,
9 the people of the direct impact,
10 closest to this location have all
11 come out and said we want Mr . Shanks
12 to be able to have his winery;
13 however, he needs to go • back to the
14 drawing board. He needs to address
15 how people are loaded on and loaded
16 out of . He needs to write size the
17 operation to its septic system, which
18 I think we need to hold County
19 Health Department accountable for .
20 Because if we were to ask to open up
21 a tavern at that location and stood
22 before this Board, we wouldn ' t meet
23 with this proposal but because it ' s a
24 farm using that home rule, that
25 ability for the community to comment

1 on projects that do have impacts on
2 the street that houses 3 houses in
3 Southold. Mine being one of them and
4 I am proud of it . If Mr . Shanks came '
5 here and asked to stamp his fruit
6 stand, I don ' t think one neighbor
7 would have negative comment . If
8 Mr . Shanks came here and said I want
9 to have wine tasting capability,
10 30 people, and the parking and
11 sanitary code met what he proposed,
12 as long as we knew those patrons
13 could come ,in and off of that site
14 and not create a public safety issue,
15 his neighbors would stand with him.
16 But today, this neighbor does not .
17 And I come out in full opposition of
18 the project as proposed. I think
19 that the applicant needs to be sent
20 back to the drawing board and needs
21 to be a responsible business owner
22 and address those concerns . Thank

11 But as part of the wine business , I
12 will address things such as traffic
13 and the nature of wineries and wine
14 business . First of all traffic is
15 generated by any new business that
16 comes to town . Any new business .
17 And there are multiple bars and
18 restaurants that have opened up in
19 the course of the last five years .
20 All of which also serve alcohol and
21 all of which bring their own set of
22 customers and visitors . So I don ' t

24 than any of those facilities .
25 Additionally, unregulated events that

1 I believe to be very true in the Town
2 of Southold. We do have very
3 specific rules about how events are
4 held at wineries in our Town . As far
5 as numbers and whether or not you
6 need a permit and whether or not to
7 pay for that permit . And making the
8 Town aware of that event . So that
9 community services can be arranged to
10 watch our for our general residences .
11 And I would also like to point out
12 the nature of wineries is, what we do
13 is not slowing shots across the bar .
14 What we do is traditional and
15 cultural . And it ' s not about making
16 our customers inebriated. It ' s about
17 sharing an agricultural product .
18 It ' s about talking about the art of
19 wine and how it ' s made . And very
20 often there is a food ( Inaudible) .
21 So it ' s a balanced visit . And one
22 more, wineries are engaging in active
23 education in order to responsibly
24 serve our customers . Mine own
25 business included. I have even made

1 a point to put myself through that
2 very own education. So with that in
3 mind, I don ' t think what the Shanks
4 are proposing to open is -- it ' s not
5 a business that is a threat to the
6 community. It ' s a business that is
7 an addition to the community. Thank

14 (Inaudible) . I am from Mattituck. I
15 support what Ms . Schafer says . I
16 don ' t know her but it sort of comes
17 with my views and mesh ' s with this
18 situation. I came here tonight to
19 listen and not to talk. So I don ' t
20 know a lot of the particulars . But I
21 think with respect to what the other
22 gentleman said, there are a lot of
23 businesses out here that have not
24 been compliant and still not
25 compliant and maybe they ' re exempt

1 and so forth. But I think the issue
2 of this proposal is to me, this is a
3 business concept, which fits very
4 much in the view that I have of new
5 businesses coming into the -North
6 Fork. From what I understand that
7 it ' s a farm. Not genetically
8 produced, which more farms out here
9 need to do that . A winery is a
10 component of that . I also understand
11 that it ' s supposed to be a wonderful
12 blend of bringing farm life and
13 melding that into a new concept of a
14 winery that is focused on education
15 and focused on the beauty of the farm
16 lands here . On the North Fork. And
17 I think that is a wonderful concept .
18 We are an agricultural area and it ' s
19 one of the great beautifies of this
20 . area . And as we develop, I would
21 like to see more of a food type and
22 growing non genetically modified
23 foods offering more products and
24 produce like that in more venues .
25 Where you can bed educated about it .

1 About how the wine is grown . About
2 how the vegetables are grown and all
3 of these wonderful things . I
4 happened to be last year at a lecture
5 that the Southold Historical Society
6 and Mr . Shanks gave a lecture just on
7 that and it was so impressed with
8 love and care . And they really put
9 into this winery, their own sweat,
10 blood and tears . I know they put in
11 a lot of plans and a lot of work to
12 make this a showcase in this area .
13 In a new type of venue . So I just
14 wanted to come in and say that I am
15 wholeheartedly in favor of this kind
16 of business . And just as an
17 anecdote, we out here in Mattituck
18 are family and the North Fork. Since
19 the late 1800 ' s . And so we have seen
20 a lot of changes here . Some of which
21 I am not happy with and some of which
22 I am. So thank you very much for
23 your time .

4 Reeve . And I grew up here on a
5 potato farm. Last century. A long
6 time ago . And I have been away for a
7 while . Came back here . We have a
8 house here . And I just wanted to
9 state how pleased I am to see the
10 direction the North Fork is
11 taking -- Southold Town has taken .
12 And it ' s because of what Southold
13 Town has taken in leadership, a lot
14 of public outlook and investments
15 and initiatives, that have kept this
16 area in the agricultural nature state
17 as much as possible . So I am very
18 pleased at what has taken place . And
19 I fully support Shanks application
20 for what they' re doing because I
21 think they ' re excellent stewards of
22 the land. I think they make
23 excellent local products . I think
24 they hire local talent to help them
r" 25 in their endeavor . And I think it

1 fits it what else is going on here in
2 the North Fork as well . I think the
3 Shanks have also contributed so much
4 to this community. They' re not
5 passive investors . They' re active
6 participants in the community. In
7 the library. In the historical
8 society, in a lot of our

10 our local organizations . So they ' re
11 part of the community. I think what
12 they' re doing is an excellent job and
13 I think what they ' re asking for is
14 what has been given to so -many other
15 wineries that are respective of this
16 communities and support the community
17 and make the community what it is . I
18 think the preservation of space out
19 here and the ability to provide
20 industry support of our people is so
21 important . You know, I think that is
22 what the Shanks are doing . So I
23 fully, as an old time native,
24 growing on what used to be the Refarb
25 Farm which is now the Harbes Farm,

1 right, and I think they have done an
2 excellent job of promoting the area .
3 I really fully support the Shanks
4 proposal and I hope that it
5 becomes to fruition. They ' re
6 excellent stewards of the land.
7 Make excellent products . I think the
8 one thing that is lacking right now
9 is public knowledge of their products
10 and their endeavors . I think by
11 doing what they have applied for will
12 make the rest of the public a great
13 benefit of what they are to this
14 community. So thank you .

19 Larson . I am also from Mattituck and
20 my family has been out here from
21 Orient Point to Mattituck since 1903 .
22 We have also seen a lot of changes
23 and it absolutely delights me to see
24 that we have not loss our farming
25 community at all . Instead it has

1 changed. And it has changed to many
2 wineries with beautiful vineyards to
3 look at it and it has remained pretty
4 much agricultural as it first began.
5 I would like to see that tradition
6 continue . I would like to see our
7 lands preserved as vineyards instead
8 of commercial businesses . This is
9 exactly what we need. I am in full
10 support of this winery and the way
11 that they want to go about it . I
12 realize that we have a lot of traffic
13 problems with all the wineries here .
14 Many of them exit onto 25 . Many of
15 them exit on to the North Road and
16 the side streets . I don ' t know if
17 that problem is ever solvable . But I
18 do not believe that that should be
19 one of the factors that should hold
20 back this application because it
21 applies to almost every winery out
22 here . And as far as I know, they' re
23 trying to be compliant with every
24 thing that has been asked. We have a
25 lot of wineries who are compliant but

1 who are not concerned about driving
2 and safety. People leave those
3 wineries from major, major parties
4 and we have some issues . I do not
5 believe, knowing the Shanks
6 reasonably well and having been
7 active with them in other
8 organizations out here, that this is
9 the type of winery it is going to be .
10 It ' s going to be a huge, huge
11 addition to us and I would hope that
12 it would be approved as soon as
13 possible and that more wineries in
14 the agricultural condition would
15 continue along the lines that they ' re
16 presenting . Thank you so much.

3 mentions anything about having
4 weddings any more .

9 the fact about having weddings and
10 parties ands things like that .
11 Triangle Park entertains a lot of
12 children . We have traffic now that
13 comes back and forth . Everybody has
14 a right to run a business and be
15 successful in their business . I am
16 not here to put them down, but I kind
17 of like the way Southold is . You
18 know, the overall picture, like most
19 of you people as residents have
20 mentioned. You know what I mean.
21 It ' s still a nice place . But if you
22 put a winery that is going to be
23 serving alcoholic beverages and
24 you ' re going to have a wedding, where
25 are you going to put these buses and

1 cars and where are they -- which way
2 they coming in? Where are they going
3 to exit from? There are still a lot
4 of children that play in that park.
5 What happens when one of those
6 children run out into Lower Road and
7 now there is a tragedy. Is everybody
8 going to feel good about growing
9 1 fruit and flowers and stuff like
10 that? You know, you got to look at
11 the overall picture . And the owners
12 of this winery, if they happen to
13 sell that business, what happens down
14 the road. You see, I got 4
15 granddaughters but they ' re not
16 running into the road anymore right
17 now. But there are a lot of people
18 that come to visit . There are a
19 couple of families that have little
20 children that live on Lower Road
21 there . There is one family that have
22 bouncy balloon parties , you know, for
23 the little girl that lives there .
24 You know, nobody is talking about the
25 impact of having extra traffic and

1 stuff like that on Triangle Park.
2 Triangle Park is a nice little park.
3 A lot of people entertain there . And
4 I don ' t mean, entertain like having a
5 party. They sit there and have lunch
6 and have barbecue ' s . It ' s what makes
7 you sit there and fall in love with
8 the Town of Southold. Like I said,
9 there is nobody discussing that . So
10 we ' re talking about how nice these
11 people are . And they are very nice
12 people . We ' re not disputing that .
13 But my point is, what about the
14 impact of having all the extra
15 traffic . Safety wise . That is
16 pretty much what I was going to say .
17 I ash everybody could kind of get a
18 solution to kind of make it work for
19 everybody involved. The ladies for
20 the One Woman Winery. They were
21 concerned about making that block a
22 commercial area . Lower Road is not a
23 commercial area except for the
24 electrical place . Ackerly Pond is
25 pretty much a residential area . That

5 MR. FALCETTA: My name is Mike
6 Falcetta . I run the adjacent parcel
7 touching the Shanks . I am here in
8 support of this property and project .
9 I also want to say there has been
10 many concerns about the parcel
11 changing hands over time . And also
12 the operations what the current
13 owners would do . I feel that the
14 Town has a lot of things already in
15 place, in terms they ' re allowed a
16 certain number of parking spots . If
17 they exceed that, there is code
18 enforcement to stop that . If they
19 want to have a wedding, they have to
20 apply to the Town of Southold. You
21 can tell them if they can or can ' t
22 have a wedding . They also have --
23 there is -- isn ' t there a noise
24 ordinance in the Town of Southold?
25 If they are going to have music and

1 they break the rule, there is code
2 enforcement for all of these things
3 already in place . And if the Town
4 can ' t enforce those -- if he ' s going
5 to break the rules , then you should
6 be able to enforce it . And if he ' s
7 not going to break the rules, he ' s

15 comment about all on site
16 consumption . I also run another one
17 of the local wineries and I will tell
18 you the only survival for our
19 business is to have people take wine
20 home and consume it at their houses .
21 If I were to only sell wine for
22 people to drink at my property, we
23 would be out of business a long time
24 ago . And so that is a major
25 component of this . And many of us

1 have already put checks and balances
2 into place within our businesses in
3 order to encourage wine to go home
4 and to encourage tasting ' s rather
5 than on-site consumption . That is a
6 problem that we internally as a
7 business discuss . We talk about and
8 it ' s something that we feel strongly
9 about . And the gentleman that runs
10 Tavern ' s , his business or any other
11 tavern or any other restaurant that
12 gets approved in this Town, those
13 businesses are 1000 on-site
14 consumption . Nothing goes home from
15 those places .

18 MS . WICKHAM: Good evening . My
19 name is Abigail Wickham representing
20 the applicant of Wickham & Bressler
21 in Mattituck. I would like to both
22 ` make some presentations and submit
23 some documentation today. Some of
24 which of what I am going to say,
25 you ' re aware of but I want to put it

1 on record. So I hope you will bear
2 with me and I will try and be as
3 brief as possible . First, as we have
4 heard, this is a winery, as in the
5 Town Code, is defined as a production
6 and sales occur . And we do have
7 production here in prior hearing
8 testimony. We were advised that wine
9 is made from the grapes on site and
10 is the prose production on site is
11 capable of approximately 8800
12 gallons based on a 15 acre yield. Of
13 course that varies tremendously year
14 to year depending on the yield. And
15 that is the point that I want to
16 make . As to a tasting room and the
17 sales component of winery, the
18 tasting room is only the final step
19 in the process . It is the mechanism
20 by which, this gentleman, said, the
21 object is to sell the bottles of wine
22 and not by the glass . And in order
23 to make a winery viable you have to
24 recoup the cost of the acquisition,
25 the farming which is probably a

1 bigger gamble than anybody occurs in
2 Las Vegas . Wine production,
3 regulatory requirements and
4 constructions of infrastructure . So
5 those are all things that have to be
6 accomplished and it ' s a hard road to
- 7 hoe . And my point is, these wineries
8 are small businesses for the most
9 part . They ' re in competition not
10 only with the local wineries but
11 other businesses and other regions .
12 So it ' s very important that they be
13 granted' a local playing field. With
14 respect to production, I have a
15 statement from Louisa Hargrave that I
16 would like to put into the record,
17 that I think is a very good
18 explanation of production . And I
19 think it would be important and the
20 Board would find it interesting to
21 read in terms of the nature of wine
22 production . I won ' t bother to read
23 it now. In terms of the level
24 playing field, I have mentioned. I
25 have a list of a number of wineries

1 that have been approved here under a
2 code that is very similar or exactly
3 the same as what we have now. And
4 none of these wineries have been
5 given conditions under than the usual
6 site conditions and when you talk
7 about what type of conditions you
8 put on a winery, it ' s very important
9 from a business perspective to make
10 sure that this business is not put at
11 a competitive disadvantage to others
12 and other properties and other
13 businesses in the area . I would like
14 to call particular attention to the
15 first one, in 2013 , was the Harbes
16 family winery. And I know we all do
17 respect what a tremendous job the
18 Harbes have done in terms of
19 agricultural and marketing . And
20 their winery was approved for sizably
21 more than this one on an area that we
22 know there is traffic issues and we
23 know there is parking issues . And so
24 I would like you to take a look at
25 those and the one ' s that come

1 through . And some of them are very.
2 Very big wineries . This point that
3 we want to make here, which we have
4 made before, this is not a large
5 winery. This is a small modest
6 winery. It ' s in the neighborhood of
7 1900 square feet on the first floor
8 tasting room. There are porches .
9 You have all those figures in your
10 materials in terms of the size but
11 the basic size of it, for the
12 building structure itself, for the
13 winery, for the tasting portion, the
14 porches which are seasonal and the
15 inside, year round, is around 3300
16 square feet . And as Nancy Steelman
17 the architect pointed out to me this
18 afternoon, is very much a small scale
19 in keeping with the average size of a
20 residential building and it ' s
21 designed like an average residential
22 building . The size of this parcel ,
23 1 . 8 acres could accommodate a winery
24 two or three times this size and that
25 is not what is being planned. So

1 their concern is to keep a small,
2 their culturally based winery
3 operation. One other thing I want to
4 submit and I won ' t read it , but it ' s
5 a letter that you received in
6 December from Theresa Ward and
7 Michael Murray. And a number of
8 those comments , as well as some of
9 the comments that Mr . Murray made
10 today, were not correct . And I would
11 like this in the record to, correct
12 them. I am not going to read the
13 whole letter tonight, but I do want
14 to point out as we have previously,
15 the sanitary systems, toilet
16 capacity and all of the water supply
17 will be fully dictated and approved
18 only by Suffolk County Health
19 Department but also by the New York
20 State Building Code . And the
21 statements made tonight were just not
22 accurate in that regard. Special
23 events, as we know are regulated by
24 the ZBA and the Town Code .
25 Mr . Antonelli made a comment about

1 Triangle Park, which has been
2 there for many, many years, but for
3 the record, I want it to be stated
4 that it ' s a small, 1 1/2 acre parcel
5 is a very elongated triangular
6 configuration . The widest with of
7 that is 164 feet . And it is also
8 shielded from this winery proposal by
9 quite a distance that is shown on a
10 map, as well as the Town (inaudible)
11 excuse me, the fully planted vineyard
12 and quite a significant elevation
13 increase . So when you ' re down in the
14 lower road, which is the main park,
15 you won ' t even see this winery and it
16 will be shielded from it . Parking
17 will be regulated by your Board,
18 on-site . And so the difficulty of on
19 street parking, I am sure we will
20 talking about and dealing with. I
21 did not say that a traffic solution
22 was to send them down the road, the
23 outlet . But first, this
24 neighborhood that was discussed is
25 not exclusively residential . If you

1 look at the zoning map, Platinum
2 Electric are commercial and business
3 zoned. And those are just things
4 that have been there for many, many
5 years . Some of the other businesses
6 on Main Road and Lower Road, also .
7 Just a minute . Mr . Antonelli lives
8 on Ackerly Pond Lane, not Lower Road.
9 The Murray ' s live on the corner
10 there . Both of those properties are
11 about three times beyond the 500 foot
12 standing distance of people who have
13 standing to challenge a decision .
14 And while we certainly don ' t want to
15 ignore traffic or routes , we do want
16 to make it clear, that this is not
17 the only property that uses the-se
18 routes and it shouldn ' t be singled
19 out as causing all of the problems .
20 What I would like to ask you tonight,
21 most importantly, is that you close
22 the hearing because we have had
23 extensive testimony. We would ask
24 that the Board in reviewing the maps
25 and in reviewing the conditions ,

1 consider allowing, as I understood
2 you have always allowed in the past,
3 non substantial modifications to the
4 map as it now stands in terms of
5 parking, driveways, layout,
6 addressing comments from the referal
7 agencies that may or may not be back

10 not significant major changes and
11 making the public aware tonight that
12 such a modification may be made as
13 part of your consideration and is all
14 a matter of public record. I don ' t

4 the block that is going to do weddings
5 or does weddings? What is there input
6 on that part? You know what I am

9 to do something that is going to change
10 the whole atmosphere of that area, that
11 seems to be the problem. Doesn ' t seem
12 like anybody is looking at the long
13 term view of it . They ' re looking at
14 how nice the flowers look and the food
15 that is being grown . That is nice, but
16 what about keeping the area somewhat
17 what it is . You know what I am saying .

21 weddings for years and we have not
22 had a complaint on the property and
23 if we did, we would address ' s it .
24 And we would hope that the Town would
25 do that . Weddings, there are rules .

1 And in fairness with the current
2 legislation that the Town has , I
3 believe that they ' re only allowed to
4 apply for weddings about 60 days in
5 advance . Something to that extent .
6 If you can tell me a person that has
7 planned a wedding in 60 days , so . I
8 essentially take a deposit and take a
9 gamble and say that I hope the Town
10 is going to let me have this . So
11 that is just another thing for
12 another day, I guess . Very close .
13 And yes, there are weddings at my
14 family which is just off Ackerly Pond
15 Road.
