(16' wide) non- pressure treated decking with pressure treated substructure along the landward edge of the bulkhead; and as depicted on the site plan prepared by Timothy Hough, received on December 11, 2017, and stamped approved on January 17, 2018. The current permit allows for the existing boathouse/storage shed structure to be raised in-, place approximately 27"to accommodate grade of new bulkhead. The existing structure is located 10'from the edge of the bulkhead and 48'from the east property line. The Applicant is requesting written permission to relocate the structure further away from the bulkhead ( approximately 40) and 20'from the east property line and reconfigure to no larger then 100 square feet, as discussed in the public hearing. The second request is to modify top deck dimensions to act as the entire non-turf buffer.The applicant is requesting decking located at top of bulkhead to be 16'wide and constructed with non treated top decking.The deck will be constructed in order to allow run off from turf area to enter below deck and naturally filter through installed granular fill. In addition, decking will be pitched slightly away from wetlands with a gap between boards to allow all rain to pass below deck into granular fill. We were not notified by certified mail,as required,of this application. We first learned about the July 19, 2017 Trustee Hearing in the Thursday,July 13 Suffolk Times,which is less than the required"not less than 7 days".We respectfully request the hearing on this application be postponed so we can file and application to access the public records of this wetlands application file. • The request for replacement of the bulkhead is NOT"In place, In Kind". The proposed bulkhead will be 12"higher which will require grading changes to the property. We request that the applicant submit a civil engineering report with grading indicated to assure there is no storm water runoff on my adjacent property from the proposed grading changes. • The existing shed structure is a pre-existing condition that is not compliant with current wetland laws. Raising the structure 27" increases the degree of non-conformance of a non-conforming condition and is not in conformance with the Southold Building Code. • The 6'x 55'section of easterly walkway no longer exists and was removed by the applicant without submitting an administrative application to the Trustees for review and approval. • The existing bulkhead is currently constructed beyond the south Tie Line of the Kohn property. This is a situation,that should be reviewed with all other agencies having jurisdiction before a final determination of this application is made. Any rebuilding of the bulkhead should be entirely within the owner's property lines.A copy of the September 12,1962 survey is attached. • This application was originally submitted in 2008 and was NOT approved. There is a small section of the existing bulkhead that is on our property,and we respectfully requested in light of a renovation of this magnitude,that the pile and decking be removed from our property. The Kohn's subsequently sued us for Adverse Possession and were unsuccessful. The court reasserted our ownership of the property and we again request that any approval of this application be subject to the removal of the current pile and bulkhead section that is on our property.
