ACCESS EASEMENT
THIS AGREEMENT made this 13`h day of April, 2016 between LITTLE
PIKE'S PROPERTIES, INC., ("GRANTOR") with offices located at 1210 North
Bayview Road Ext., Southold, NY 11971 and ALEXANDER L. SUTTON and
TRACY M. SUTTON, residing at 1160 North Bayview Road, Ext., Southold, NY
11971 (owner of Lots 1 and 2 (GRANTEE); and
WHEREAS, the GRANTOR owns certain land situate at North BAyview
Road Extension, Town of Southold, County of Suffolk, State of New York
(SCTM: 1000-78-9-78) which runs between the intersection of Victoria Drive and
Liberty Lane and North Bayview, hereinafter referred to as Right of Way; and
WHEREAS, Alexander and Tracy Sutton own land situate at North
Bayview Road Ext., Southold, County of Suffolk, State of New York more
specifically described as Lots 1 and 2 on the filed map "Final Plat Standard
Subdivision prepared for Alexander L. And Tracy M. Sutton, prepared by Nathan
Taft Corwin, III, Land Surveyor dated May 8, 2012 and last revised on April 9,
2016 to be filed with the Suffolk County Clerk's Office (Schedule A and Schedule
B (sctm: 1000-79-9-54)
WHEREAS, the Southold Town Zoning Board of Appeals has required
through a condition of the variance granted on October 7, 2010 file number 6385
that the 50' by 400' right of way (1000-78-9-78) must be continuously maintained
by the owner and any future owners with clearing for vehicular traffic including
emergency vehicles; and
WHEREAS, GRANTOR desires to provide an easement for access from
lands of Lot 1 and 2 over the Right of Way; and
WHEREAS, said access area is described in Schedule "B" annexed
hereto and made a part hereof and said access area is hereinafter referred to as
"the Easement Area"; and
WITNESSETH:
NOW THEREFORE, in consideration of ONE DOLLAR ($1.00 ) and other
good and valuable consideration to GRANTOR, the receipt of which is hereby
acknowledged, this agreement:
1. GRANTOR does hereby grant, transfer, bargain, sell and convey unto
Lots 1 and 2, in perpetuity subject to limitations contained herein, an access
easement, of the nature, character, and to the extent hereinafter set forth over
and upon the Easement Area.
2. The nature, character, and extent of the easement hereby granted is
as follows:
a. The owners of Lots 1 and 2, their invitees, guest and others of
the general public shall have the nonexclusive right to use the Easement Area
for the purpose of vehicular and pedestrian ingress and egress of the Right of
Way.
b. The owners of Lots 1 and 2 shall maintain grubbing of the
wooded vegetation to a 15' wide by 15' high canopy so that a 50' by 400' right of
way (parcel 1000-78-9-78) remains open and accessible to vehicular traffic
including emergency vehicles over its entire length.
c. In the case that the owner of Lot 1 fails to maintain the 50' by
400' right of way (parcel 1000-78-9-78) the owner of Lot 2 shall have the right to
resurface the easement area or a portion thereof with a driveway made of
permeable material for the safe passage of vehicles and pedestrians.
3. Failure of GRANTOR or GRANTEE to insist upon the strict
performance of any provision of this easement shall not be abrogate, or be
deemed to waive, any of GRANTOR'S or GRANTEE'S rights under this
easement.
4. This easement shall run with the land and be binding upon and inure to
the benefit of the parties, their successors, assigns, heirs and benefactors.
