CLAUDIA PURITA, residing at 19995 Soundview Avenue, Southold, New York 11971, party of the first
part, and
OLD NORTH ROAD BARN, LLC, a New York limited liability company with offices at 5195 Old North
Road, Southold, New York 11971, party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten and 00/100--($10.)--Dollars, and
other good and valuable consideration paid by the party of the second part, does hereby grant and release
unto the party of the second part, the heirs or successors and assigns of the party of the second part
forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon, situate, lying
and being at Southold, in the Town of Southold, County of Suffolk and State of New York, being known
and designated as Lot No. 3 on a certain map entitled, "Cluster Minor Subdivision & Lot Line Change for
Frank Purita", which said map was filed in the Suffolk filed in the Suffolk County Clerk's Office on 9/7/05 as
Map No. 11299, which is also known as SCTM#'s 1000-51-3-4.11, 4.12, 4.13, and 4.14.
THIS DEED is intended to convey for title purposes the property described above into the same name as
the property currently owned by Old North Road Barn, LLC situate at 5195 Old North Road, Southold,
New York 11971, also known as SCTM# 1000-51-3-5. The legal description of the entire premises owned
by the party of the second part is described on Schedule "A", attached hereto and made a part hereof.
Being and intended to be the same premises conveyed to the party of the first part by deed Liber 12491
Page 722 and deed Liber 12498 Page 528.
The Building Parcels located within the property described on Schedule A are described as set forth in
Schedule B.
SUBJECT TO Deed of Development Rights dated 12/21/05 made by Franco Purita a/k/a Frank Purita and
Claudia Purita to County of Suffolk on a portion of the property described above, which deed was recorded
in the Suffolk County Clerk's Office on 1/10/06 in Liber 12429 page 721, which affects a portion of the
premises specifically known as SCTM#'s 1000-51-3-4.13 and 4.14, and subject to Easements and
Declarations of Covenants and Restrictions of record.
The parcels herein described are subject to an Amended 15' Water Easement running from Old North
Road to Lots 1 & 2 on said Map No. 11299, as more fully set forth in an Amended Water Easement dated
May 4, 2017 and intended to be recorded simultaneously herewith over Lot 3 on said map.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the
appurtenances and all the estate and rights of the party of the first part in and to said premises.
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and
will apply the same first to the payment of the cost of the improvement before using any part of the total of
the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the
sense of this indenture so requires.
