SwF y Ag coo Ip" TERMS AND CONDITIONS The Permittee David&Chantal Landman residing at 6610 Soundview Avenue, Southold,New York as part of the consideration for the issuance of the Permit does understand and prescribe to the following: l. That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will,at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees,the work shall cause unreasonable obstruction to free navigation,the said Permittee will be required, upon due notice,to remove or alter this work project herein stated without expenses to the Town of Southold. 8. The Permittee is required to provide evidence that a copy of this Trustee permit has been recorded with the Suffolk Countv Clerk's Office as a notice covenant and deed restriction to the deed of the subject parcel. Such evidence shall be provided within ninety(90)calendar days of issuance of this permit. 9. T hat the said Board will be notified by the Permittee of the completion of the work authorized. 10. Moore, Esq. 51020 Main Road Southold, NY 11971 RE: DAVID & CHANTEL LANDMAN 6610 SOUNDVIEW AVENUE, SOUTHOLD SCTM# 1000-59-8-6.1 Dear Ms. Moore: I have reviewed the application for the above reference property and determined that it is incomplete at this time. The reasons for the determination are: 1. An original survey has not been submitted to this office. The survey submitted is not to scale nor is it stamped by the licensed surveyor. 2. The driveway design on the survey must conform to the filed approved Planning Board subdivision map dated January 22, 2005, showing two separate driveways for Lot 1 and Lot 2. 3. The driveway design on the survey needs to depict the discharge pipe under the driveway for Lot 1 and that it will be maintained. Similarly, a discharge pipe will be in installed under the driveway for Lot 2 and be maintained. - 4. The landward edge of the Non-Disturbance Buffer line (50' landward of edge of wetlands), will be delineated with either a proposed split-rail fence (using non- treated wood posts), a stone wall, or boulders with native plantings, all with sufficient elevation/spacing/penetration in the wall or boulders to allow the natural flow/passage of water and small animals that inhabit this area. This also will be added to the survey. 5. The limitation on clearing and cutting shall not prohibit the proper landscaping and maintenance of the vegetation, including but not limited to removal of diseased, decayed or dead material and obnoxious plant species. Specifically permitted throughout the entire property is the planting of additional native plants, or replacing trees and other vegetation with comparable native species. b. The lots are located adjacent to an agricultural reserve and these lots may be subject to the noise and fugitive dust normally associated with agricultural activities. Farming practices and activities are protected pursuant to Article XXII, Farmland Bill of Rights (Added 5-27-1997 by L.L. No. 11-19971 Section 100-220. I understand that you and Mike met with David at his property. Thank you. I am preparing the project description and I am attaching a copy of the Planning Board recorded C&R's. (let me know if it is not attached) The Planning Board C&Rs say that (obviously exclusive of the driveways) we should have a 50' non- disturbance measured from the edge of wetlands; then a scenic-natural easement measured from the 50' to the 75' from the wetlands. (see paragraph 3 & paragraph 9). This makes more sense than 100' non- disturbance (which is your entire jurisdictional limit). The topography of the 100' was about 50' from the edge of freshwater wetlands then a small rise for the last 50 feet. My client has severe Lyme disease and all his children have tested positive for Lyme. David and his wife is concerned because Lyme prevention suggests keeping the fallen leaves cleaned because the ticks tend to be found in the fallen and accumulating leaves. If the entire 100' is non-disturbance then he can not even clean up the fallen leaves & low brush deer habitat My suggestion is to place the split rail fence at 50' (Planning Board non-disturbance)...then the balance of the area (from the 50 to 100 make "non-turf & no pesticides"; the Planning Board C&R's already prohibit clearing of trees up to 75' (clients told you they do not want to cut trees). But this would allow the family to keep the leaves & brush away from the house where the deer can hide and leave behind the deer ticks. The Planning Board C&R's allow for maintenance of the buffer area (which is the 50 to 75') but do not allow the owners to cut the trees and maintain a scenic easement. Also-I have asked Peconic surveyors to show the subdivision driveway on the Landman survey so that we will know where the driveway should be located (driveway building envelope). There were two entrances designed on the subdivision map and the driveways for each lot were adjacent to each other. I believe the drawing shows 10' driveway on each parcel so providing a 20' common driveway. This would comply with the subdivision requirements for access. I should have this info from the surveyor right away. The items you listed were not an issue ( the stormwater code compliance was already part of the building permit process). I will get started typing...please let me know about the 100' (this is the limit of Trustee jurisdiction...generally non-disturbance areas are no greater than 50' so that the homeowner does not have to live with vines & brush so close to the home) Pat PATRICIA C. Specifically permitted throughout the entire property is the planting of additional native plants, or replacing trees and other vegeta-tion with comparable native species. 6. The lots are located adjacent to an agricultural reserve and these lots may be subject to the noise and fugitive dust normally associated with agricultural activities. Farming practices and activities are protected pursuant to Article XXII, Farmland Bill of Rights [Added 5-27-1997 by L.L. No. 11-19971 Section 100-220. Right to Farm of the Town of Southold Town Code. 7 . No new residential structure (exclusive of driveway and dry wells) or sanitary disposal facility shall be constructed or otherwise located less than 100 feet from the most landward limit of freshwater wetland. 8 .
