HomeMy WebLinkAboutPolice Radio - Shelter Island RESOLUTION 2017-524 . °Qac ADOPTED DOC ID: 13133 THIS IS TO CERTIFY THAT THE FOLLOWING RESOLUTION NO. 2017-524 WAS ADOPTED AT THE REGULAR MEETING OF THE SOUTHOLD TOWN BOARD ON JUNE 6, 2017: RESOLVED that the Town Board of the Town of Southold hereby authorizes and directs Supervisor Scott A. Russell to execute the Police Radio Agreement between the Town of Southold and the Town of Shelter Island for calendar year 2017 regarding receiving and dispatching radio transmissions on behalf of Shelter Island Town by the Town of Southold at its radio base station, whereby the Town of Shelter Island agrees to pay the Town of Southold the sum of$48,682 for 2017, with annual increases consistent with CPI, subject to the approval of the Town Attorney. , Elizabeth A.Neville Southold Town Clerk RESULT: ADOPTED [UNANIMOUS] MOVER: Robert Ghosio, Councilman SECONDER:Louisa P. Ruland POLICE RADIO AGREEMENT A THIS AGREEMENT made this d3 day of June, 2017, by and between the TOWN OF SHELTER ISLAND, a municipal corporation of the State of New York, having its principal office at State Road (Route 114), Shelter Island, Suffolk County, New York, party of the first part, and the TOWN OF SOUTHOLD, a municipal corporation of the State of New York, having its principal office at 53095 Main Road, P.O. Box 1179, Southold, Suffolk County, New York, party of the second part. The Town of Shelter Island owns and operates police vehicles containing radio equipment, but does not maintain a radio transmission base station. The Town of Southold maintains a police department at the radio transmission base station, together with radio operators on duty twenty-four hours a day for the purpose of receiving and transmitting radio communications to and from the base station to police vehicles within the Town of Southold and the Town of Shelter Island. The Town of Shelter Island maintains a telephone at the base station whereby all telephone communications directed to the police of the Town of Shelter Island may be answered through such a telephone at the base station located in the Town of Southold. Therefore, the parties mutually agree that radio transmissions be received and dispatched on behalf of the Town of Shelter Island by the Town of Southold at its radio base station, and that in addition thereto the Town of Shelter Island at -1- its expense maintain a telephone at the Southold Town Police Station which will receive telephone calls directed to the Shelter Island Town Police; IT IS AGREED AS FOLLOWS: 1. That the Town of Shelter Island at its own cost and expense will provide and maintain a telephone and necessary equipment at the Southold Town Police Station at Peconic, New York. All telephone communications directed to the Shelter Island Town Police will be transmitted over said telephone and be received at the Southold Town Police Headquarters. 2. That the Town of Southold agrees that radio operators at the Southold Town Police Station will answer all telephone communications received on behalf of the Town of Shelter Island, will document the telephone communications and will dispatch the necessary information to the Shelter Island Town Police by telephone or radio transmission. 3. The Town of Southold agrees that it will receive and dispatch radio transmissions from the Shelter Island Town Police vehicles and will maintain a record of all such radio transmissions. 4. That in consideration of the aforementioned services provided by the Town of Southold, the Town of Shelter Island will pay the Town of Southold the sum of $48,682 for the calendar year 2017, which reflects the annual adjustment based on the Federal Consumer -2- Price Index. The amount will be paid on or before the 15th day of June of each year during the term of this Agreement. 5. This Agreement shall take effect on the 1St day of January, 2017, and shall be renewed annually. Payments will be adjusted annually consistent with the Consumer Price Index. Notwithstanding the foregoing, either party may terminate this Agreement on December 31 of any calendar year by giving written notice of termination at least 90 days in advance of the termination date. 6. The Town of Southold shall not, in any event, be liable for any damage or loss of property or for injury to persons, arising from or caused by any breakdown or interruption of service of such communication equipment, nor for any such damages or injury caused by the acts of negligence of the Town of Southold, its officers or employees. The Town of Shelter Island shall indemnify and hold harmless the Town of Southold from any and all damages, judgments, costs and expenses of every kind, which may raise or result from the acts or omissions of the Town of Southold, its officers and employees performed under and pursuant to the provisions of this Agreement. -3- IN WITNESS WHEREOF, the parties hereto have caused this Agreement to be executed on the day and year first above written.
