Dear Mr. Adams:
The following action was taken by the Board of Town Trustees
during their regular meeting held on April 27, 1989 as follows:
WHEREAS the Town Trustees have conducted an on site inspection of the
~ubject property,
ESOLVED that the Town Trustees approve the request made by Edward
Adams for a waiver to regrade, replant, and plant trees in work area
after completion, spoil to be placed on adjacent property to the east
of Wolf Pit Lake and Tuthill Lane, Mattituck, N.Y.
Please return to the Building Department for a determination on
the need for any other permits which may be required for this project.

Dear Mrs. Haas:
The following action was taken by the Board of Trustees at their
regular meeting held on June 26, 1986 regarding your request for a
Waiver of the Wetland Ordinance co dredge in Wolf Pit Lake, Mattituck.
Moved by Trustee Smith seconded by Trustee Krupski
WHEREAS, Madeline S. Haas, Secretary on behalf of the Mattituck Park
Commission has requested a Waiver of the Wetland Ordinance, Chapter 97,
Article II, Section 97-22, and
WHEREAS, the Trustees have inspected the property in question and the
surrounding area, and
WHEREAS, the Board has considered all of the information submitted
regarding this request
NOW, THEREFORE, BE IT
RESOLVED that Madeline S. Haas, Secretary for the Mattituck Park
Commission be and hereby is granted a Waiver of the Wetland Ordinance
to dredge in Wolf Pit Lake, Mattituck with the provision that the fringe
marsh is left in its natural state and that it is dredge to 3ft. (max.)
and the spoil is co be trucked to an approved upland site.

The validity of this permit is or may be subiect to the approval of other governmental or municipa~
authorities, The Town accepts no resoonsibilitV in applying for or obtaining such approval. In the
' event that such approval is necessary, the holder of this permi~ shall not commence operations here-
unoer until such approval has been obtained in writing. The failure to obtain such other approva~ when
required aha subject this permk to immediate revocation by the Trustees upon receipt by the
Trustees- of written notice from such other governmenta~ or ~lunicioal authorities of its refusal or
disapproval,
The applicant does by the acceptance of this permit, assume all responsibility for operations under-
taken pursuant to this permit, and shall take ail precautions for the prevention of iniuries to persons
ano property resulting from such operations. By sucn acceptance, the applicant also agrees to indemni-
fy and save harmless the Town, and its officers, agents and employees from any and ail claims arising
from operations under this permit and any and all acts or omissions of applicant, his agent and
employees.
The applicant and the owner and occuoants of the premises upon which the operations authorized by
this permit are being conducted, do, by the acceptance of this permit, give consent to the Town, and
its officers and employees to enter upon the premises where such operations are being conducted To
make such inspections as the Town may deem necessary to insure that such operations are being con-
ducted in conformity with this permit.
This operation will not substantially: A. Adversely affect the wetlands of the town.
B. Cause damage from erosior, turbidity or siltation.
C. Cause saltwater intrusion into the fresh water resources of the town.
D. Adversely affect fish, shellfish or other beneficial marine organisms, aquatic wildlife and vege-
tation or the natural habitat thereof,
E. Increase the danger of flood and storm-tide damage.
F. Adversely affect navigation on tidal waters or The tidal -'Iow of the tidal waters of the town.
G. Change the course of any channel or the natural movement or flow of any waters.
H. Weaken or undermine the lateral support of other lands in the vicir~ity.
I. Otherwise adversely affect the health, safety a,nd general welfare of the people of the town.

Dear Mr. Just:
The following action was taken by the Board of Trustees
at a regular meeting held on December 26, 1985:
Moved by Trustee Bredemeyer seconded by Trustee Bednoski
WHEREAS, the Land Use Company on behalf of the Mattituck Park
Commisszon applied to the Southold Town Trustees for a permit
under the provisions of the Wetland Ordinance of the Town of
Southold, application no. 320 and dated August 13, 1985 and,
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findigns and recommendations,
and, '-
WHEREAS, a public hearing was held by the Town Trustees with respect
to said application on December 26, 1985 at which time all interested
persons were given an opportunity to be heard,
;~iEREAS, the Board considered all testimony and documentation
submitted concerning this application; and it is noted for the
record that there has neen no public opposition; and
WHEREAS, the Board has determined that the project as proposed
will not affeot the health, safety and general welfare of the
people of the Town,
NOW, THEREFORE, BE IT
RESOLVED that the Land Use Company on behalf of the Mattituck Park
Commission be granted permission under the provisions of the
Wetland Ordinance of the Town of Southold, New York, all in
accordance with the application submitted. This permit will
expire on December 26, 1986 if work has not commenced by said date.
There shall be two inspections required; and the Trustees shall be
notified when the project is complete.

Re: Mattituck Park District/Wolf Pit Lake
Gentlemen:
We are writing to you to request a supplemental waiver of
permit in connection with the clean up of Wolf Pit Lake, Mattituck,
New York. You will recall that on July 2, 1986, a waiver was
issued with respect to proposed work at Wolf Pit Lake. This waiver
did not contain an expiration date, but did request that spoil
be trucked to an approved upland site and that the fringe must
be left in the natural state.
We are asking ag this time, that permission be granted for
spoil to be placed on adjacent property of the Park District -
the triangular piece of property to the east of Wolf Pit Lake
and Tuthill Lane. We are also asking for approval of our plan
to re-grade, re-vegetate, and plant trees in the work area after
completion. The proposed restoration area is shown on the attached
survey.
Thank you for your attention to this matter. We await your
prompt response to so that the pro2ect may be completed.

Gentlemen:
We are the attorneys for the Mattituck Park District
and are writing you with respect to the above referenced
violation. Pursuant to Section 97-32 of the Southold Town
Code we request a hearing before the Trustees. A copy of
the notice of violation is annexed hereto.
The notice of violation should be rescinded for the
following reasons:
(1) Mattituck Park District was granted a waiver of
the Wetland Ordinance for work to be performed at Wolf Pit
Lake by letter dated July 2, 19860 A copy is annexed
hereto.
(2) No spoil was intentionally placed on Tuthill
Any spoil inadvertently deposited on Tuthill Lane in
connection with the work has been or will be removed.

(3) Spoil is to be placed on adjacent property of
Mattituck Park District, to wit: a triangular piece of
property to the east of Wolf Pit Lake and Tuthill Lane.
Approval is requested for this site for deposit of spoil.
(4) Mattituck Park District intends to regrade~
revegetate and plant trees as appropriate upon completion of
the work.
(5) The conditions of the waiver have been complied
with and there is no reason for a permit application. All
that is now required is approval of the proposed spoil
deposit site.

Gentlemen:
The Mattituck Park Commissioners request the waiver of any permits
needed to clean out Wolf Pit Lake, Mattituck, New York.
The lake has a lot of debris consisting of approximately 500 yards
of leaves and sttnl~. The removal of the debris would be at the expense
of the Park Commission and done to enable the natural spring to once
again function.
