Damon Hagan and Trustee President John Bredemeyer regarding the information below and your current application. Per Damon,we still require written documentation (letter form)from the three other property owners that 1:they are aware of Mark Davis spearheading an application to dredge the channel of James Creek on behalf of the group; and 2: that they are aware that they/Mr. Davis has hired you to act as their agent for said application. Per J. Bredemeyer;the dredge spoil project description contains items that may not be permitted per Town Code and/or require additional reviews/permits from other town offices. Please be advised that yesterday the Town Board tabled a revision in the Town Code regarding dumpsters on residential properties. The change contains the following: "No dumpster shall be permitted in the front yard or side yard of a residential property for more than two weeks, unless the property benefits from an open and valid building permit. If the property benefits from an open and valid building permit, said dumpster may remain in the front yard or side yard until either the building permit expires, or a certificate of occupancy and/or compliance is issued for the work described in the permit, whichever occurs first. Thereafter, the dumpster must be removed. Properties used for bonafide agricultural production shall not be subject to this provision". The whole revision is viewable under the Town Board's agenda from last night. It will be heard again on October 181H That being said, Mr. Davis may not be able to keep dumpsters on his driveway without the benefit of an open building permit if this is approved. If it is approved, you may also have to go through the Town Engineers for runoff concerns of the spoils. Another concern is the length of time for the proposed dredging. Given what you stated below, John Bredemeyer is requesting this office receives a copy of the approved DEC permit and plans for this application with the addition description that is below about the dredge spoils and length of time. Given all of the above,this application is tabled. Our next meeting is on November 16, 2016. Field inspection is Wednesday, November 9, 2016. If the description gets modified, I would need that by Monday, October 17th, as well as any modified plans (if necessary), and the letter from the other property owners. As you may be aware,the Suffolk County DPW will not finance dredging Projects unless the public benefit is in place/services a marina of commercial nature. My clients are prepared to finance the project as the waterway has become un-usable During periods of mid/low tide. I am unsure when the waterway was created/and or Last dredged but have been informed in was during the period of 1950's era. I have enclosed an application packet with and naming Mark Davis whom Owns the parcel we intend to utilize either to truck out the spoils or provide a temporary Dewatering area for the spoils before they are trucked to an upland approved landfill. You will find attached within a copy of the Suffolk County Tax Map of the Area as well as a Hydrographic Survey of the proposed dredging prepared by Sealevel Mapping.
