In the event that such approval is necessary, the holder of this permit shall not commence operations here- under until such approval has been obtained in writing. The failure to obtain such other approval when reeuired shall subject this permit to immediate revocation by the Trustees upon receipt by the Trustees. of written notice from such other governmenta~ or municipal authorities of its refusal or disapproval. The applicant does by the accegtance of this permit, assume all responsibility for operations under- taken pursuant to [his permit, and shall take all precautions for the prevention of injuries to persons and property resulting from such operations. By such acceptance, the a~[}licant also agrees to indemni- fy and save harmless the Town, and its officers, agents and employees from any a ~d all claims arisfng from operations under this permit and any and all acts or omissions of applicant, his agent and employees. The applicant and the owner and occupants of the premises upon which the operations authorized by this permit are being conducted, do, by the acceptance of this permit, give consent to the Town, and its officers ano employees to enter upon the premises where such operations are being conducted To make such inspections as the Town may deem necessary to insure that such operations are being con- ducted in conformity with this permit. Adversely affect fish, shellfish or other beneficial marine organisms, aquatic wildlife and vega- tation or the natural habitat thereof, E. Increase the danger of flood and storm-tide damage. F, Adversely affect navigation on tidal waters or the tidal flow of the tidal waters of the town. G. Change the course of any channel or the natural move~nent or flow of any waters. H. Country Road Wading River, New York 11792 RE: Mattituck Park Commissicn Dear Mr. Just: The following action was taken by the Board of Trustees at a regular meeting held on December 26, 1985: Moved by Trustee Bredemeyer seconded by Trustee Bednoski WHEREAS, the Land Use Company on behalf of the Mattituck Park Commission applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application no. 320 and dated August 13, 1985 and, WHEREAS, said application was referred to the Sou%hold Town Conservation Advisory Council for their findigns and recommendations, and, WHEREAS, a public hearing was held by the Town Trustees with respect to said application on December 26, 1985 at which time all interested persons were given an opportunity to be heard, WHEREAS, the Board considered all testimony and documentation submitted concerning this application; and it is noted for the record that there has neen no public opposition; and WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the Town, NOW, THEREFORE, BE IT RESOLVED that the Land Use Company on behalf of the Mattituck Park Commission be granted permission under the provisions of the Wetland Ordinance of the Town of Southold, New York, all in accordance with the application submitted. Moved by Trustee Smith seconded by trustee Krupski WHEREAS, Madeline S. Haas, Secretary on behalf of the Mattituck Park Commission has requested a Waiver of the Wetland Ordinance, Chapter 97, Article II, Section 97-22, and WHEREAS, the Trustees have inspected the property in question and the surrounding area, and WHEREAS, the Board has considered all of the information submitted regarding this request NOW, THEREFORE, BE IT RESOLVED that Madeline S. Baas, Secretary for the Mattituck Park Commission be and hereby is granted a Waiver of the Wetland Ordinance to dredge in Wolf Pit Lake, Mattituck with the provision that the fringe marsh is left in its natural state and that it is dredge to 3ft. You will recall that on July 2, 1986, a waiver was issued with respect to proposed work at Wolf Pit Lake. This waiver did not contain an expiration date, but did request that spoil be trucked to an approved upland site and that the fringe must be left in the natural state. We are asking at this time, that permission be granted for spoil to be placed on adjacent property of the Park District - the triangular piece of property to the east of Wolf Pit Lake and Tuthill Lane. We are also asking for approval of our plan to re-grade, re-vegetate, and plant trees in the work area after completion. The proposed restoration area is shown on the attached survey. Pursuant to Section 97-32 of the Southold Town Code we request a hearing before the Trustees. A copy of the notice of violation is annexed hereto. The notice of violation should be rescinded for the following reasons: (1) Mattituck Park District was granted a waiver of the Wetland Ordinance for work to be performed at Wolf Pit Lake by letter dated July 2, 1986. A copy is annexed heretO. (2) No spoil was intentionally placed on Tuthill Any spoil inadvertently deposited on Tuthill Lane in connection with the work has been or will be removed. Lane. The lake has a lot of debris consisting of approximately 500 yards of leaves and sti~k~. The removal of the debris would be at the expense of the Park Commission and done to enable the natural spring to once again function.
