At the same meeting held on January 18, 2017 the Board of Trustees denied the issuance of a Coastal Erosion Permit in accordance with Chapter 111 of the Town Code. This letter and supporting documents are being submitted in accordance with Chapter 111-21 of the Town Code appealing the decision by the Board of Trustees for the following reasons which are based upon Best Management Practice requirements: e Relative to Coastal Policy 4 - The proposed shade shelter's construction shall be consistent with A CE Chapter 24 Flood Resistant Design&Construction Standards. o Relative to Coastal Policy 6.3 - Although the proposed structure is situated seaward of the Coastal Erosio i Hazard Area line, the proposed location has been relocated in an area already accessed Iby the public. This area where the shade shelter is proposed is surrounded on all four sides by previous development (ground fixed playground equipment, ground fixed barbeques, asphalt parking lot with guiderail and a timber walltway). a Relative to Coastal Policy 6.3 - The new location is a17,ay from existing beach grass and vegetation. There is no presence of tidal or freshwater wetland vegetation in the footprint of the new location or in the immediate areas adjacent to the proposed structure which areas include improvements such as fixed playground equipment, asphalt and a timber walkway. On behalf of the Mattittiak Park District our office acknowledges the discretion applied by the Board of Trustees in the furtherance of the above referenced coastal policies by the issuance of the Wetland Permit despite the recommendations of the LWRP Coordinator. We respectfully request an appeal of the decision made by the Board of Trustees relative to the issuance of a LIUR L. x McLean Associates, P.C. Coastal Erosion Permit for the construction of this flood resistant shade shelter within a previously developed area of the Breakwater Beach facility in Mattituck. Our office assumes the construction of the proposed timber deck over an existing concrete slab was not part of the decision by the LWRP Coordinator and/or the Board of Trustees. With respect to the application from the Mattituck Park District, Coastal Erosion relief should be granted by the Town Board since the variance criteria set forth in Section 111-20 are in fact met by the proposed project: A. No reasonable, prudent, alternative site is available. The original location was closer to existing grasses and has now been situated in au area surrounded by development. There is no other area that would satisfy ADA accessibility and provide a safe area protected frown vehicles in the parking lot(guiderail). B. All responsible means and measures to mitigate adverse impacts on natural systems and their functions and values have been incorporated into the activity's design at the property owner's expense. The proposed shade shelter would be located along a developed area of the beach facility. Due to the absence of vegetated-wetlands or submerged aquatic vegetation within the vicinity of the proposed shade shelter the proposed activity would not cause a fragmentation of ecological communities;result in the physical loss, degradation, or functional loss of ecological components; or otherwise adversely impact the functions or values of the surrounding natural systems, including the wetlands or tidal waters of the Town. C. The development will be reasonably safe from flood and erosion damage. Although located in the Coastal Erosion Hazard Area the shade shelter structure is proposed in a well enough protected area that various site features such as fixed playground equipment, guide rail,parking lot area,lifeguard building and the wooden walkway of this developed beach shoreline have been successfully maintained for many decades. D. The variance requested is the minimum necessary to overcome the practical difficulty or hardship which was the basis for the requested variance. As discussed with the trustees,the shade shelter has been relocated to an area that was not the applicant's preferred choice, but the applicant understands that the proposed park feature had to be put in an area where other fixed features and surfaces existed. E. Where public finds are utilized, the public benefits must clearly outweigh the long-term adverse effects. Public funds will be utilized in connection with this sponsored project. Breakwater Beach does not have any structure that would provide protection in the event of a fast moving storm/rain event nor shade for residents who cannot tolerate the sun. The benefit that this shade shelter will provide is consistent with the other park features that would eventually surround this flood resistant structure. LKAVAL. K. McLean Associates, PC In addition to meeting these variance criteria,the project also meets the criteria for issuance of a Coastal Erosion Management Permit as set forth by Section 111-9 because (a) the proposed shade shelter is reasonable and necessary considering reasonable alternatives and the extent to which it provides safe shelter for the residences who use this municipal waterfront property and would be consistent in nature and location with the surrounding fixed park features and development at the facility; (b) the proposed shade shelter is not likely to cause a measurable increase in erosion at the new location selected at the site; and (c)the proposed shade shelter will create no adverse effects on natural protective features and their functions and protective values or existing erosion protection structures and natural resources. In addition to this application letter for-appeal in accordance with Chapter 111-21 for the above referenced property, enclosed are the following for review: 1. Application for Appeal to the Coastal Erosion Hazard Board of Review 2. Board of Trustees Letter of Denial dated January 18,2017 3. Copy of the Wetlands Permit 48950 issued on January 18,2017 4. At the same meeting held on January 18, 2017 the Board of Trustees denied the issuance of a Coastal Erosion Permit in accordance with Chapter 111 of the Town Code. This letter and supporting documents are being submitted in accordance with Chapter 111-21 of the Town Code appealing the decision by the Board of Trustees for the following reasons which are based upon Best Management Practice requirements: • Relative to Coastal Policy 4 - The proposed shade shelter's construction shall be consistent with ASCE Chapter 24 Flood Resistant Design& Construction Standards. • Relative to Coastal Policy 6.3 - Although the proposed structure is situated seaward of the Coastal Erosion Hazard Area line, the proposed location has been relocated in an area already accessed by the public. This area where the shade shelter is proposed is surrounded on all four sides by previous development (ground fixed playground equipment, ground fixed barbeques, asphalt parking lot with guiderail and a timber walkway). • Relative to Coastal Polio - The new location is away from existing beach grass and vegetation. There is no presence of tidal or freshwater wetland vegetation in the footprint of the new location or in the immediate areas adjacent to the proposed structure which areas include improvements such as fixed playground equipment, asphalt and a timber walkway. On behalf of the Mattituck Park District our office acknowledges the discretion applied by the Board of Trustees in the furtherance of the above referenced coastal policies by the issuance of the Wetland Permit despite the recommendations of the LWRP Coordinator. We respectfully request an appeal of the decision made by the Board of Trustees relative to the issuance of a • .Founded in 1950 • LIIAA ' L. K. McLean Associates P.C'. 9 Coastal Erosion Permit for the construction of this flood resistant shade shelter within a previously developed area of the Breakwater Beach facility in Mattituck. Our office assumes the construction of the proposed timber deck over an existing concrete slab was not part of the decision by the LWRP Coordinator and/or the Board of Trustees. With respect to the application from the Mattituck Park District, Coastal Erosion relief should be granted by the Town Board since the variance criteria set forth in Section 111-20 are in fact met by the proposed project: A., No reasonable, prudent, alternative site is available. The original location was closer to existing grasses and has now been situated in an area surrounded by development. There is no other area that would satisfy ADA accessibility and provide a safe area protected from vehicles in the parking lot(guiderail). B. All responsible means and measures to mitigate adverse impacts on natural systems and their functions and values have been incorporated into the activity's design at the property owner's expense. The proposed shade shelter would be located along a developed area of the beach facility. Due to the absence of vegetated wetlands or submerged aquatic vegetation within the vicinity of the proposed shade shelter the proposed activity would not cause a fragmentation of ecological communities; result in the physical loss, degradation, or functional loss of ecological components; or otherwise adversely impact the functions or values of the surrounding natural systems, including the wetlands or tidal waters of the Town. C. The development will be reasonably safe from flood and erosion damage. Although located in the Coastal Erosion Hazard Area the shade shelter structure is proposed in a well enough protected area that various site features such as fixed playground equipment, guide rail,parking lot area, lifeguard building and the wooden walkway of this developed beach shoreline have been successfully maintained for many decades. D. The variance requested is the minimum necessary to overcome the practical difficulty or hardship which was the basis for the requested variance. As discussed with the trustees, the shade shelter has been relocated to an area that was not the applicant's preferred choice, but the applicant understands that the proposed park feature had to be put in an area where other fixed features and surfaces existed. E. Where public funds are utilized, the public benefits must clearly outweigh the long-term adverse effects. Public funds will be utilized in connection with this sponsored project. Breakwater Beach does not have any structure that would provide protection in the event of a fast moving storm/rain event nor shade for residents who cannot tolerate the sun. The benefit that this shade shelter will provide is consistent with the other park features that would eventually surround this flood resistant structure. L11AAL. K. McLean Associates P.C. 9 In addition to meeting these variance criteria, the project also meets the criteria for issuance of a Coastal Erosion Management Permit as set forth by Section 111-9 because (a) the proposed shade shelter is reasonable and necessary considering reasonable alternatives and the extent to which it provides safe shelter for the residences who use this municipal waterfront property and would be consistent in nature and location with the surrounding fixed park features and development at the facility; (b) the proposed shade shelter is not likely to cause a measurable increase in erosion at the new location selected at the site; and (c)the proposed shade shelter will create no adverse effects on natural protective features and their functions and protective values or existing erosion protection structures and natural resources. In addition to this application letter for appeal in accordance with Chapter 111-21 for the above referenced property, enclosed are the following for review: 1. K. McLean Associates on behalf of MATTITUCK PARK DISTRICT applied to the Southold Town Trustees for a permit under the provisions of Chapter 111 Coastal Erosion Hazard Areas of the Town Code of the Town of Southold, application i dated September 9, 2016, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator recommended that the proposed application be found Inconsistent with the LWRP, and specifically Inconsistent with the following coastal policies pursuant to Chapter 111 Coastal Erosion Hazard Areas of the Town Code: Policy 4 - minimize losses of human life and structures from flooding and erosion hazards, Policy 6.3 —protect and restore tidal and freshwater wetlands, A. comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on October 19, 2016 and again on January 18, 2017, at which time all interested persons were given an opportunity to be heard, and, l 2 WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure, as applied for is located in a beach area as per the Definitions in Chapter 111 Coastal Erosion Hazard Areas of the Town Code and governed by Section 111-12 (D) -All development is prohibited on beaches unless specifically provided for in Chapter 111; and Section 111-6 Definitions: Unregulated Activity— Excepted activities which are not regulated by this chapter include, but are not limited to, elevated walkways or stairways constructed solely for pedestrian use and built by an individual property owner for the limited purpose of providing'noncommercial access to the beach; docks, piers, wharves or structures built on floats, columns, open timber piles or other similar openwork supports with a top surface area of less than 200 square feet or which are removed in the fall of each year; normal beach grooming or cleanup; maintenance of structures when normal and customary and/or in compliance with an approved maintenance program; setup and maintenance of temporary wildlife protective structures,planting vegetation and sand fencing so as to stabilize or entrap sand in primary dune and secondary dune areas in order to maintain or increase the height and width of dunes,routine agricultural operations, including cultivation or harvesting, and the implementation of practices recommended in a soil and water conservation plan as defined in § 3, Subdivision (12), of the Soil and Water Conservation Districts Law,provided, however, that agricultural operations and implementation of practices will not be construed to include any activity that involves the construction or placement of a structure, and, NOW THEREFORE BE IT, RESOLVED, for the foregoing reasons, and because the proposed action is located entirely within the Coastal Erosion Hazard Area and in a beach area, and because the proposed action is not permitted in such areas pursuant to Chapter 111 of the Town Code, that the Trustees deem the proposal to install a 25' wide by 40' long steel shade shelter supported by six (6) foundation columns over a proposed 4" (25'x40') concrete slab; and to install an approximately 12'x24' timber deck fastened onto the existing concrete slab that is attached to the existing lifeguard building to be impermissible under Chapter 111, and, BE IT FURTHER, RESOLVED, that for the foregoing reasons, the Board of Trustees DENIES WITHOUT PREJUDICE the Coastal Erosion Permit application of MATTITUCK PARK DISTRICT to install a 25' wide by 40' long steel shade shelter supported by six (6) foundation columns over a proposed 4" (25'x40') concrete slab; and to install an approximately 12'x24' timber deck fastened onto the existing concrete slab that is attached to the existing lifeguard building; and as depicted on the site plan prepared by L. McLean Associates on behalf of MATTITUCK PARK DISTRICT applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated September 9, 2016, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator recommended that the proposed application be found Inconsistent with the LWRP due to noncompliance to Chapter 111 of the Southold Town Code, Coastal Erosion Hazard Areas, and; WHEREAS, the Board of Trustees has furthered Policies 4 and 6.3 of the Local Waterfront Revitalization Program to the greatest extent possible through the imposition of the following Best Management Practice requirements: the proposed steel shade shelter was relocated to an area accessed more by the public in order to help protect the existing beach grass and vegetation that is located around the originally proposed location; and r 2 WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on October 19, 2016 and again on January 18, 2017, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, ` WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that for the mitigating factors and based upon the Best Management Practice requirement imposed above, the Board of Trustees deems the action to be Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code, and, RESOLVED, that the Board of Trustees approve the application of MATTITUCK PARK DISTRICT to install a 25' wide by40' long steel shade shelter supported by six (6) foundation columns over a proposed 4" (25'x40') concrete slab; and to install an approximately,12'x24' timber deck fastened onto the existing concrete slab that is attached to the existing lifeguard building; and as depicted on the site plan prepared by L. K. McLean Associates, P.C., last dated November 17, 2016, and stamped approved on January 18, 2017. Permit to construct and complete project will expire two_years from the date the permit is signed.
