SUPERVISOR RUSSELL: Please rise and join in the Pledge of Allegiance. Thank you. Before
I get to the regular business of the agenda, I am going to pass it over to Councilwoman Jill
Doherty because she has a special presentation to make.

COUNCILWOMAN DOHERTY: This is our annual poster contest, for the Tree Committee.
You can see all around the posters, here in the middle are the winners and the runner-ups. And I
will turn it over to Dave Cichanowicz, the chairman of the Tree Committee, to hand out
proclamations and prizes to the winners.
DAVE CICHANOWICZ: Okay, good afternoon everyone. We are here for the annual poster
contest and the Tree Committee board picks out what we feel is the best poster for the entire
Town of Southold as well as honorable mentions for each of the school districts. Along with
that, we give out gift cards and the grand prize winner gets a nice $100 gift certificate and a tree
planted on their behalf at the school. It's a nice program, we want to keep the kids active and
involved in keeping the community green and anything we can do to help that, we are all for it.
With that being said...
COUNCILWOMAN DOHERTY: Before Dave starts, I want to mention that the rest of the Tree
Committee are here and if you guys want to come up and sit in the front row here and help us
congratulate the winners? These are a group of hard working people that donate their time, and
we do plant a lot of trees during the year and we do a lot of education, so thank you guys for all
you do.
MR. CICHANOWICZ: Our mission goal is try to keep all the street trees in Southold healthy
and thriving. Planning for the future, there are numerous trees in the area that are dying of
disease and such that we have to take down and we are looking to plarit new trees or seedlings in
their place and to keep everything beautiful as it has been. So we are going to go to the number
one winner for the overall Southold town is Jennifer Luke from the Oysterponds School, if you
want to come on up?
COUNCILWOMAN DOHERTY: This is her poster, we have a certificate of congratulations
from the Southold Town Board for you.
MR. CICHANOWICZ: Here is a gift certificate for $100 for you, don't spend it all in one place.
Thank you. Congratulations. Next we have Darwin Esteban from Southold, he is not here.
Well, we have a $50 gift card for him and a certificate. Next we have Ava Fudjinski from Our

have all the posters on display in here and out in the foyer. They will be up for several days, so

SUPERVISOR RUSSELL: Would anybody like to address the Town Board on any of the items
that appear on the agenda?
Robert Dunn
ROBERT DUNN: Robert Dunn, Peconic. I just have a question about 401, (inaudible)it doesn't
say any reason why.
SUPERVISOR RUSSELL: The changes that are proposed, the intention is to make them
consistent with the federal flood damage prevention, they, consistent with recent changes to the
maps at the federal level. Initial flood insurance program. That's all that is. it's trying to bring
some uniformity to the two.
TOWN ATTORNEY DUFFY: Those 40 numbers are already in the code. Those aren't new
additions...
MR. DUNN: Oh, I understand that. There are existing maps. Inaudible. Anytime you do
anything (inaudible) I have been reading more and more about federal flood (inaudible) So to
identify an area or a thing (inaudible) What would be the purpose?
SUPERVISOR RUSSELL: The consistency between federal maps and the town code? I mean,
ultimately we are administering federal law, so I don't know that there's anything other than our
obligation to follow what federal laws says. I mean we are administering the flood maps, all of
that, you know, at the local level, like it or not.
MR. DUNN: The flood maps are already in existence. Over here we are talking flood damage
prevention.
SUPERVISOR RUSSELL: These are just the panel numbers, the numbers you see, just the
panel numbers on the maps that are already established.
MR. DUNN: Already established.
SUPERVISOR RUSSELL: Right.
MR. DUNN: It's not like you are creating a new thing.
SUPERVISOR RUSSELL: No, we are just making out code consistent with theirs.
TOWN ATTORNEY DUFFY: I can tell you FEMA changed the one panel to add a property
tow it. I can find it for you, if you want.
MR. DUNN: Inaudible.

TOWN ATTORNEY DUFFY: Then it trickles down to DEC and then to us, and then we have
to make our code consistent with the actual map. We are just recognizing the change that FEMA
made.
MR. DUNN: Inaudible.
SUPERVISOR RUSSELL: There have been instances in the past where people have petitioned
FEMA to be removed from the flood plains, certain zones. I don't know how successful
they've....
MR. DUNN: Inaudible.
SUPERVISOR RUSSELL: Yes.
MR. DUNN: Inaudible. So I am just concerned where all of this is going (inaudible).
SUPERVISOR RUSSELL: Sure, fair enough.
MR. DUNN: Is given as why (inaudible), they have stated they won't be doing any beach
restoration(inaudible). And I can understand that, are they going to say (inaudible).
SUPERVISOR RUSSELL: They are never going to get out of the federal flood insurance
program, they are never going to give that up. Never happen.
MR. DUNN: Inaudible. It's a little scary.
SUPERVISOR RUSSELL: And most of the nicest houses on the edge of that sand pile. They
are not going to let the federal government go out of the federal flood insurance program.
MR. DUNN: Well, some of those people are exactly (inaudible)
SUPERVISOR RUSSELL: On repetitive losses? I am not sure. That would be their decision
but I am not so sure they can handle or would be willing to accept repetitive losses. It's pretty
substantial. Would anybody else like to address the Town Board on any of the agenda items?

Chris Baiz
CHRIS BAIZ: Good afternoon, members of the Board. I am Chris Baiz in the village of
Southold. I also support the town as chair of the Agricultural Advisory Committee and I just
want to support #357 this afternoon. This has been a very long, collaborative process to identify
what is agriculture in the Town of Southold. Not to invent new agriculture but just what is there
today. As you all know, in our zoning code we have over 210 definitions which up until this
afternoon have basically had three of those 210 definitions identifying agriculture in the town,
was something that represents 1/3 of the town's land mass. So I see we are going to have 13 or
14 new definitions plus maybe modified a couple of existing definitions. The Agricultural
Advisory Committee collaborating with the Town Board and the Code Committee and giving

you our input, as your `on the ground agricultural experts', we tried to identify the best we can
what are the current agricultural practices in town. This, of course, is just part one with getting
these definitions into the text. Part two which will be more of the permitted use regulations as to
how these definitions will be used is yet to come, at your guidance, Mr. Supervisor. And along
with that we will probably be adding at least one definition and probably a couple of others but
especially the definition for the word farm. That is not currently in the text, we tried to invent
farm but we are going to do a do-over on that one. Anyway, with that, I think we are beyond the
point of discussion, we are 98% where we want to be, so I urge you all to support our advisory
efforts with regard to these definitions and look forward to affirmation of this new proposed law.

MR. BAIZ: If you have any questions, let's talk after the meeting.
SUPERVISOR RUSSELL: Thank you, Chris. I am surprised there isn't a larger contingency
here tonight, given the attendance two weeks ago. I thought there was a lot of unresolved issues
that we would be hearing more of tonight.
MR. BAIZ: I think they got the idea that things were resolved. They know, we are working on
that as well and we certainly look forward to the Town Board's support on this and it's still a
collaborative effort going forward. We have to further and better define what one third of our
land use is here in the town because the people who are in this industry are basically your gene
pool for the future, that it stays here, unless the town doesn't want to have agriculture as a major
land use. We feel that we do and we feel that the town does as well. So, this just helps us better
identify what we can do in the future and as well all know, if it's in the code we can at least
move forward in that direction. If it isn't in the code, it's very hard to develop business plans to
help agriculture move forward. Thanks very much.

WHEREAS there has been presented to the Town Board of the Town of Southold, Suffolk
County,New York, on the 28`x' day of February, 2017, a Local Law entitled "A Local Law in
relation to Amendments to Chapter 280-4,Agriculture." and
WHEREAS the Town Board of the Town of Southold held a public hearing on the aforesaid
Local Law at which time all interested persons were given an opportunity to be heard, Now
therefore be it
RESOLVED that the Town Board of the Town of Southold hereby ENACTS the proposed Local
Law entitled, "A Local Law in relation to Amendments to Chapter 280-4,Agriculture"
reads as follows:

A Local Law entitled, "A Local Law in relation to Amendments to Chapter 280-4,
Agriculture".
BE IT ENACTED by the Town Board of the Town of Southold as follows:
§280-4. Definitions.
AGRICULTURE -The production, keeping or maintenance, for sale, lease or personal use, of
plants and animals useful to man, including but not limited to forages and sod crops; grains and
seed crops; dairy animals and dairy products; poultry and poultry products; livestock, including
beef cattle, sheep, swine, horses, ponies, mules or goats or any mutation of hybrids thereof,
including the breeding and grazing of any or all of such animals; bees and apiary products; fur
animals; fruits of all kinds, including grapes, nuts and berries, vegetables; floral, ornamental and
greenhouse products; or lands devoted to a soil conservation or forestry management program.
AGRICULTURAL PRODUCTION -For the purposes of this Chapter, Agricultural Production shall
include, but not be limited to, the following:
1. A Farm Operation engaged in the production for sale of crops, livestock or livestock
products, by a bona fide farm operation, or bona fide aquaculture/mariculture farm
operation, both as defined herein, which shall include but not be limited to:
a. Field crops, for example corn, wheat, oats, rye, barley, hay, potatoes and
dry beans;
b. Fruits, for example apples, peaches, grapes, cherries, tomatoes and berries;
C. Vegetables, for example snap beans, cabbage, carrots, beets and onions;
d. Horticultural specialties, for example nursery stock, ornamental shrubs,
ornamental trees and flowers;
e. Livestock and livestock products, for example cattle, sheep, hogs, goats,
horses, poultry, ratites, such as ostriches, emus, rheas and kiwis, farmed deer,
farmed buffalo, fur-bearing animals, milk, eggs and furs;
f. Maple sap;

g. Christmas trees derived from a managed Christmas tree operation whether
dug for transplanting or cut from the stump;
h. aquaculture and mariculture as defined herein;
i. Biomass, which means crops raised for bioenergy, and shall include, but is
not limited to, farm woodland, switch grass, giant reed, and miscanthus.
j. Apiary, including the cultivation of bee colonies, bee honey, beeswax, and
related products;
AGRICULTURAL PRODUCTION BUILDING -An on farm operation building, or part of a
building, primarily useful or necessary for crops in their harvested state in the conduct of
Agricultural production, including but not limited to barns, silos, storage of mechanical equipment,
storage of harvested crops, spaces, accessory alternative energy structures, animal pens, and other
shelters.
AGRICULTURAL PROCESSING -The on-farm processing of agricultural products at and
from a single farm operation located within the Town of Southold, which has been converted from
its original (raw) state into a processed or prepared product through applications of cooking,
distilling, fermenting, crushing, or straining, etc. Such processed agriculture products include,
but are not limited to,jams,jellies, cheeses, potato chips,jerkies, meats, fowl, fish, breads, and
baked goods, beer, wine and distilled alcoholic and non-alcoholic beverages.
AGRICULTURAL PROCESSING BUILDING - An on farm operation building, or part of a
building, used for processing and storage of agricultural products of a single farm operation into
processed agricultural products as defined herein.
PROCESSED AGRICULTURAL PRODUCT -Agricultural product which has been
converted from its original state into a distinct product by techniques such as cooking, distillation,
fermentation, crushing and straining. Examples of processed agricultural product include,
without limitation, jams,ms, jellies, cheeses, potato chips, meats, fowl, fish, wine and other alcoholic
beverages. Simple washing, cleaning, arranging or packaging of agricultural products shall not
cause the product to be considered "processed" under this definition.
ON FARM OPERATION DIRECT MARKETING -The sale of raw or processed agricultural
products that are produced by a bona fide farm operation or a bona fide aq uaculture/mari culture
farm operation directly to consumers.
ON FARM DIRECT MARKETING BUILDING -An on farm building, or part of a building,
used for the direct farm marketing of agricultural products and agricultural processed products
from a single farm operation.

FARM OPERATION - Means the land, including underwater lands used in aquaculture and
mariculture, buildings used in agricultural production, on-farm agricultural processing buildings
on farm direct marketing buildings, equipment, manure processing and handling facilities and
practices which contribute to the cultivation, production, preparation, processing and marketing
of crops, livestock and livestock products, freshwater or marine water products including fish
fish products, and/or water plants and shellfish, as a commercial enterprise. The farm operation
may consist of one or more parcels of owned or rented land, which parcels may be contiguous or
noncontiguous to each other.
BONA FIDE FARM OPERATION - Indicators of a bona fide farm operation include, a farm
operation, as defined herein, that:
1. Is located on land with not less than seven acres of land used as a farm operation
in the preceding two years for the production or sale of crops, livestock or livestock
products, of an average gross sales value of$10,000 or more, or
2. Is located on land of seven acres or less used as a farm operation in the preceding
two years for the production or sale of crops, livestock or livestock products of an
average gross sales value of$50,000 or more, or
3. Has been issued a farm stand operator permit.
FARMHOUSE -A principal dwelling on a Farm Operation used exclusively y a farmer/owner/
operator who is in full time residence and actively engaged in farming the lands of the farm operation,
or as housing for the Farm Operation's workers or occupied by key employee(s) of the Farm Operation
AQUACULTURE - The breeding, cultivation, planting, containment, er and harvesting of Pr-Oduets
organisms that are naturally predueed occurring in freshwater n meats, -for-example
including finfish; ,shellfish mollusks such as snails and clams; crustaceans such as shrimp and
crayfish; and seaweed aquatic plants. The term "aquaculture" is also commonly used to include
marine water, or maricultured, species such as oysters, bay scallops, lobsters , and sugarp.
LAND-BASED AQUACULTURE - The cultivation of marine and freshwaters organisms in a
man-made structure, such as an on-land building or pond. Any f,•Y,., of aquaeultur-e that does not

mollusks such as snails, oysters, and clams; crustaceans such as shrimp, crabs, and lobsters;

BONA FIDE AQUACULTURE/MARICULTURE FARM OPERATION - Indicators of a
bona fide aquaculture/mariculture farm operation include, a farm operation, as defined herein,
engaged in aquaculture and/or mariculture that:
1. Has obtained all commercial cultivation and harvest permits required by the New
York State Department of Environmental Conservation Law and a permit from either
the New York State Department of Agriculture and Markets or the Suffolk County
Department of Health Services when the farm stand offers on-premises consumption,
and
2. Has access to underwater land, including, but not limited to, a lease,riparian rights,
a grant, fee title to underwater land, or a franchise within the Peconic Bay Estuary or
Town waters, or has land-based cultivation infrastructure.

III. SEVERABILITY
If any clause, sentence,paragraph, section, or part of this Local Law shall be adjudged by any
court of competent jurisdiction to be invalid,the judgment shall not affect the validity of this law
as a whole or any part thereof other than the part so decided to be unconstitutional or invalid.
IV. EFFECTIVE DATE
This Local Law shall take effect immediately upon filing with the Secretary of State as provided
by law.

COUNCILMAN DINIZIO: I just want to make a statement first before I vote, Mr. Baiz
correctly said that there are three definitions in the code that are currently existing that have to do
with farms. They are the definition of a farm which is just a one sentence definition, basically
devoted to agricultural use. Farm buildings and farm stands. Now, I wish we could just get with
that. I wish that that could just be it. We have lived this long with those three definitions and
my personal views that are the more words we have are more words that could be misunderstood
by people. So, but with all of that, I trust that the Committee who have worked extremely hard
on this and knowing farmers who are businessmen, having to sit down on a regular basis and
having to tell people such as myself what a farm is, is probably a difficult task. So I will vote
yes on this.
SUPERVISOR RUSSELL: Yes, I am going to make a couple of quick comments. I am
disappointed that many of the people that were here two weeks ago aren't here tonight. There
was a great deal of discussion, first and foremost, I hope everybody appreciates the difficulty this
Board has, in trying to develop a consensus on these types of legislation. When there didn't seem
to be a clear consensus on the legislation as proposed from the agricultural community. I think
that one of the things that needs to be put to the side now, I think there was an implication on the
part of one let's say lobbyist/representative that insinuated that the legislation that was subject to
hearing two weeks ago wasn't what was noticed and had been noticed earlier. Actually it had
been noticed six weeks earlier, it had been advertised on the paper and on the website. It was the
same print. Suggestions like use of the word primarily, I understand why maybe people don't
want to live with this sole agricultural operation but you know, the problem with those words is
they are ambiguous, they lead to the problems we have now. I mean, you can't go out and issue a
summons, bring someone to court because they violated an adverb. Might as well use chiefly or
mostly or most part. You need to have something which is enforceable which is one thing I do
want to say is I know there was a lot of concern the other night with regard to enforcement, well,
the town is not going to enforce it anyway. Actually, I agree with the sentiment that any time we
get into this issue down the road, we need to put a focus on enforcement with verifiable criteria
on the uses side but we need the cooperation of the ag community for that because I do not want
some of them to say this is overly restrictive. It's what you've asked for. Some of the other
things, contradictions of the 60/40 rule, all of that other stuff, I feel like we should have had a
more meaningful discussion,had some of the people showed up tonight but ultimately I think
we've got a lot of work to do. I think it's very difficult to think that all of agriculture can be put
under one umbrella of definitions. There are so many different segments of it, that I said three
years ago remove this, remove this, remove this and treat them separately and the argument is,
that's discriminatory. That's not agriculture. But one segment of the industries needs are and
what the other segments needs are, are sometimes not even close to being consistent. So I really
think, I will adopt these, I will vote to adopt them but I really think we need to sit down and start
adding a whole bunch more because the industries are far more diverse than 13 or 14 mere
definitions. It just can't capture it well enough. I vote yes.

Multi-Jurisdictional, Comp Emergency Mgmt Plan Agreement
WHEREAS, the Department of Fire,Rescue and Emergency Services of Suffolk County
(the County) is authorized to receive grant funding from the Federal Emergency Management
Agency UASI 2015 &UASI 2016 Grant program under Resolutions 862-2015 and 738-2016 to
provide emergency service coordination for the development of inter-municipal agreements with
partners' municipalities; and
WHEREAS, the County will utilize federal and state grant funds to coordinate with the
Municipality in the development of a Comprehensive Emergency Management Plan; and
WHEREAS, the County and the Town of Southold hereto desire to coordinate in
connection with the coordination and development of a multi jurisdictional, Comprehensive
Emergency Management Plan.
NOW, THEREFORE, be it
RESOLVED, by the Town Board of the Town of Southold, that the Supervisor be and
he hereby is authorized to execute an agreement on behalf of the Town of Southold with the
County of Suffolk acting through its Department of Fire, Rescue and Emergency Services
("Department" and/or "FRES") in connection with the coordination and development of a

BE IT ENACTED by the Town Board of the Town of Southold as follows:
I. Purpose.
The safe and proper disposal of the solid wastes generated by the people of the Town of
Southold and adherence to the mandates of the Town's Solid Waste Management Plan with
respect to collection and disposal of solid waste and recyclables has been and remains a matter of
serious public concern. The purpose of this local law is to clarify regulations and permitting
requirements.
II. Chapter 233 of the Code of the Town of Southold is hereby amended as follows:
§233-3A. Disposal and Collection of Solid Waste and Recyclables.
B. Commercial Waste Pefmit Licenses Requirements.
1. With the exception of those operating within the Fishers Island Waste
Management District, no refuse hauler or carter or agent thereof shall collect,
transport or dispose of Solid Waste and/or Recyclables generated within the Town
without obtaining a Carter's Pefmit License issued by the Town Clerk Solid
Waste District.
3. Upon receipt of a complete application, the Town Gler-k shall refer-the applicatieft
to he Solid Waste District shall refer the application to the Zoning Inspector for a•
determination of whether any violations of the law exist. The Town Cie Solid
Waste District shall issue the applicant a Carter Pefmit License so long as the
applicant is deemed by� LLle cvuu t Solid WuJti. Dist .,,,,a.t � .. i etof to be in

compliance with this local law and all applicable County and State regulations.
5. Whenever satisfactory proof, such as by means of an affidavit, is submitted to the
Town Gler4c Solid Waste District that a Carter Permit License issued for the
purpose set forth in this local law has been lost or destroyed, the Town Cie
Solid Waste District shall, upon payment of five dollars ($5.00) by the applicant,
issue a new Carter Pefmit License. No Carter Pefmit License issued pursuant to
the provisions of this local law shall be transferable.
6. The Carter Pefrnit License holder hereunder shall, upon request, furnish the Town
with a list detailing the number of residences, commercial establishments or other
generators of Solid Waste and/or Recyclables located in the Town and serviced by
the applicant and the intended location that said Solid Waste and/or Recyclables
shall be deposited by the carter. This list shall be prepared at a level of detail
satisfactory to the Town Gler4E Solid Waste District and shall be updated by the
Carter PeFmit License holder at the request of the Town, but not more often than
every three months.

III. SEVERABILITY
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any
court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law
as a whole or any part thereof other than the part so decided to be unconstitutional or invalid.
IV. EFFECTIVE DATE
This Local Law shall take effect immediately upon filing with the Secretary of State as provided
by law.

#1000-69-5-12.1. Historically, the Water Supply Plan Map reflects the physical changes in the
water supply network since 2000. The property owner has represented to the Town that the
groundwater quality at this property is inadequate and poses a significant concern that requires
the extension of public water to the property. The extension of the transmission main is intended
to supply the property and is not intended to result in additional pressure in the area.
Section 2. Enactment.
Based on the goals of the Suffolk County Water Authority and Suffolk County
Department of Health Services to provide safe drinking water to the property, and upon our
consideration of the recommendations of the Town Planning Department, and the public
comments taken at the public hearing, we hereby amend the Town of Southold Water Supply
Plan Map to include the extension of a water transmission main to 375 Ackerly Pond Lane,
Southold. -
Section 3.
The Southold Water Supply Plan Map as adopted by Resolution No. 31 on June 20, 2000
by the Town Board, and most recently amended by Resolution No. 2016-316, is hereby amended
to reflect the extension of a water transmission main to 375 Ackerly Pond Lane, Southold.
Section 4. Severability.

I have here an affidavit of publication. It was published in the Suffolk Times, I have an affidavit
it was posted on the Town Clerk's bulletin board. We have a letter from the town Planning
Department, `the proposed action amends the town's water supply map to include the extension
to 375 Ackerly Pond. The action has been reviewed to the New York State DEC regulation
6NYCCRR part 617 state environmental quality review and its determination that pursuant to
part 617.5 C20 and 27, the action is a type II action and therefore not subject to SEQRA review.
And that's from Mark Terry and then we have something from the Suffolk County Chief
Planner, that pursuant to the requirements of the Suffolk County administrative code, the above
referenced application which has been submitted to the Suffolk County Planning Commission, is
considered to be a matter for local determination as there is no apparent significant county-wide
or inter-community impacts. A decision of local determination should not be construed as either
approval or disapproval. I have a letter from out LWRP coordinator that it has been reviewed to
Chapter 268 Waterfront Consistency Review and based upon the information provided as well as
the records available, it is the recommendation that the action is consistent with the LWRP
policy standards and therefore is consistent with the LWRP. And there are notice to adjacent
property owners, too. And that's it.
