PROPERTY LOCATION: 13175 NYS Route 25,Mattituck,NY SCTM No. 1000-140.-3-38.4 SEORA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated March 17, 2017 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. SOUTHOLD TOWN PLANNING BOARD: The application was referred to the Southold Town Planning Board for comments relating to the proposed office building addition. The Planning Board, in their June 29, 2017 memorandum, indicated that they do not support the area variance since the parcel lacks sufficient on site parking for the proposed uses, and municipal parking in the vicinity is already over-subscribed. In addition, they have serious concerns over the long range effects and potential safety issues of inadequate parking on undersized parcels and the number of uses proposed on such a small property. PROPERTY FACTS/DESCRIPTION: The subject property is a non-conforming 14,793 sq. ft. parcel in the Hamlet Business (HB) Zoning District. The property fronts NYS Route 25 on the southerly property line measuring 73.44 feet, measures 216.60 on the westerly property line, 76.27 feet along the northerly property line, and 222.36 feet along the easterly property line. The parcel is improved with a one story building that currently contains three different business uses. There is also an attached raised wood walk along the westerly side of the building, as depicted on a survey prepared by John C.Ehlers, L.S., last revised December 20, 2016. BASIS OF APPLICATION: Request for a Variance under Article X, Section 280-46; and the Building Inspector's December 22, 2016, amended January 12, 2017 Notice of Disapproval based on an application for a permit to construct additions and alterations to an existing commercial building at: 1) proposed additions to provide four (4) separate uses upon a single parcel measuring less than the minimum allowed 80,000 sq. ft. in total area (or 20,000 sq. ft. in area per permitted use); located,at: 13175 NYS Route 25,Mattituck,NY. SCTM# 1000-140-3-38.4. Page 2,July 20, 2017 #7059, Orioli SUM No. 1000-140-3-38.4 RELIEF REQUESTED: The applicant requests a variance to construct a proposed 1,659. sq. ft. second story addition over the existing building which will consist of four offices, a storage area, reception, restrooms and a conference area. The proposed addition on this 14.973 sq. ft. lot in the Hamlet Business Zoning District is not permitted pursuant to Chapter 280-Bulk Schedule which requires a minimum lot size of 20,000 sq. ft. per use. There are already three retail uses on this commercial parcel and the office space will be considered a fourth use. ADDITIONAL INFORMATION: During the public hearing and during a scheduled interior inspection, Board members observed three existing retail uses in the subject building: a frozen yogurt shop, a party supply store with warehouse storage, and a beverage store. The applicant stated that the proposed office space on the second floor would be used for the operation of the owner's retail businesses. A response in the negative was received when the Board asked the owner if he could purchase more land in order to meet the Town Code Bulk Schedule for the proposed four uses and required parking yield. The applicant testified that his seven retail employees park in the municipal parking lot adjacent to the north of the subject parcel. Two 20 feet storage containers are currently located on the property and a truck unloading area is located along the westerly side of the rear of the building. The applicant's representative was asked to address the inadequate on-site parking and indicated that she will re- submit plans depicting additional proposed on-site parking. On July 18, 2017, the applicant's representative submitted a letter dated July 14, 2017, accompanied by photographs of the subject parking area, responding to questions raised during the public hearing. A parking plan proposing 10 spaces, dated July 14, 2017, was also included with the submittal which was absent of dimensional information, depicted unsuitable parking locations and an insufficient number of parking spaces required for the proposed uses. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on July 6, 2017 at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law §267-b(3)(b)(1). Grant of the variance will produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Although the subject parcel is located in a hamlet business zone, which permits the highest density of development by code, it is substantially non-conforming in size for the existing three businesses and the code required parking for same. A 2015 parking study of the area conducted by the Town Planning Board demonstrated that the neighborhood is already congested and cannot meet the required parking needs of existing businesses. 2. Town Law &267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant is already non-conforming to the bulk schedule for the number of existing uses, and for the required parking per use. Therefore any additional use would require a variance. 3. Town Law &267-b(3)(b)(3). The variance requested herein is mathematically substantial. The bulk schedule requires 20,000 sq. ft. per use. The subject parcel contains 14,793 sq. ft. where the code requires 60,000 sq. ft for the three existing uses which is already 75.3% less than the bulk schedule requirement. The proposed fourth use would require 80,000 sq. ft. and represents an 81.5% variance from the code. As the Planning Board noted in their June 29, 2017 Memo, they have serious concerns over the long rage effects and potential safety issues of inadequate parking on undersized parcels, especially in the Mattituck hamlet center. 4. Town Law X267-b(3)(b)(4) Evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. Although the owner testified that the second floor offices will be used as office space for the operation of his retail Page 3,July 20, 2017 #7059, Orioli SUM No. 1000-140-3-38.4 business, the Zoning Board and the Town have no method or means to prevent the proposed office space from being rented to third parties which would require additional on site parking spaces. In their memo dated June 29, 2017 the Planning Board noted that only 5 parking spaces exist to serve the entire site, where the required parking for the 3 existing uses is approximately 20 spaces And, although the town code allows municipal parking to replace some of the required on site parking, that is only permitted when he Planning Board can make a finding that there are municipal parking facilities within 300 feet that will adequately serve the parking needs. A 2005 parking assessment of the area by the Planning Board demonstrated that municipal parking in the area is already over- subscribed and therefore not adequate to replace the parking requirements for new and expanding businesses. In a July 18, 2017 submittal, the applicant proposed 10 parking spaces on a parking plan dated July 14, 2017 which remains inadequate for existing uses and the uses proposed. 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created.: The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law &267-b. Grant of the requested variance is not the minimum action necessary and adequate to enable the applicant to enjoy the benefit of office space, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE 130ARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Goehringer, seconded by Member Dantes, and duly carried, to DENY as applied for Vote of the Board: Ayes:Members Weisman (Chairperson), Dantes, Goehringer, Planamento and Acampora. While the Town Code does allow municipal parking to replace some required on-site parking, this is only permitted when the Planning Board can make a finding that there are municipal parking facilities within 300 feet that will adequately serve the parking needs. In August, 2015, the Planning Board conducted a parking assessment of the area where this parcel is located. This study, the Mattituck Hamlet Center Parking Assessment, demonstrated that the municipal parking is over-subscribed and therefore is not adequate to replace the parking requirements for new and expanding businesses. In September, 2016, the Planning Board denied a site plan application in this area'for not providing enough on-site parking. The Planning Board has serious concerns over the long-range effects and potential safety issues of inadequate parking on undersized parcels, especially in the Mattituck hamlet center.
