TERMS AND CONDITI®NS
The Pennittee John&Benedetta Fanneron residing at 1900 Mill Lane,Peconic,
New York, as part of the consideration for the issuance of the Permit does understand and
prescribe to the following:
1. That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of Southold.
2. That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved,but should circumstances warrant, request for
an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved,to provide evidence to anyone concerned that
authorization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance wit:°the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
6. That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
7. That if future operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized,or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation,the said Permittee will be
required, upon due notice,to remove or alter this work project herein stated without
expenses to the Town of Southold.
8. That the said Board will be notified by the Permittee of the completion of the work
authorized.
9. That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit,which may b-,subject to revoke upon failure to obtain same.
10. No right to trespass or interfere with riparian rights. This permit does not convey to the
permittee any right to trespass upon the lands or interfere with the riparian rights of others
in order to perform the permitted work nor does it authorize the impairment of any rights,
title, or interest in real or personal property held or vested in a person not a party to the
permit.

Dear Mr. and Mrs. Fanneron:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, June 21, 2017 regarding the above matter:
WHEREAS, JOHN & BENEDETTA FANNERON applied to the Southold Town
Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code,
the Wetland Ordinance of the Town of Southold, application dated May 11, 2017, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator recommended that the proposed application be
found Inconsistent with the LWRP, and,
WHEREAS, the Board of Trustees has furthered policy of the Local Waterfront
Revitalization Program to the greatest extent possible through the imposition of the
following Best Management Practice requirements: the issuance of a permit for the
structures, and
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on June 21, 2017, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,

WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that for the mitigating factors and based upon the Best Management
Practice requirement imposed above, the Board of Trustees deems the action to be
Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5
of the Southold Town Code, and,
RESOLVED, that the Board of Trustees approve the application of JOHN &
BENEDETTA FANNERON for the existing ±2' high by 48 linear foot long wooden
bulkhead and the as-built repairs made using like materials; as-built replacement of
existing 5'x5' wood stairs off bulkhead to beach; for the replenishment of existing
340sq.ft. beach stone splash pad landward of bulkhead, and as-built installation of a
90sq.ft. beach stone splash pad along the seaward side of bulkhead; with the condition
that no additional stone or material be put on splash pad seaward of bulkhead; and as
depicted on the survey prepared by Kenneth M. Woychuk Land Surveying, PLLC ,
dated August 2, 2016, and stamped approved on June 21, 2017.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of$50.00 per inspection. (See attached schedule.)

Project Description: To trim 315 sf, area of phragmites, utilizing selective cutting
techniques, to 18" above grade and removed to an approved upland site for disposal,
and replant areas void of vegetation with Spartina patens. Remove existing rear deck
and construct a 2'X 12'wood step off the rear of the dwelling; construct a 15.5'X 12'
paver patio off the rear of the dwelling; install a paver walkway 4'X 19' leading from the
existing stoop to the driveway in the front of the house; and to replace the existing 12'
wide RCA driveway with 8' wide parking area with pervious gravel.
Findings: The project meets all the requirements for issuance of an Administrative
Permit set forth in Chapter 275 of the Southold Town Code. The issuance of an
Administrative Permit allows for the operations as indicated on the site plan prepared by
Land Use Ecological Services, Inc. last revised May 19, 2011.
Conditions: The installation of an 8' non-turf buffer area along the landward side of the
bulkhead.
Inspections: Final Inspection.
If the proposed activities do not meet the requirements for issuance of an Administrative
Permit set forth in Chapter 275 of the Southold Town Code, a Wetland Permit will be
required.
This is not a determination from any other agency.

JOHN & BENEDETTA FANNERON requests a Wetland Permit for the existing ±2' high by 48 linear
foot long wooden bulkhead and the as-built repairs made using like materials;*as-built replacement
of existing 5'x5' wood stairs off bulkhead to beach; for the replenishment of existing 340sq.ft. beach
stone splash pad landward of bulkhead, and as-built installation of a 90sq.ft. beach stone splash
pad along the seaward side of bulkhead. Located: 1900 Mill Lane, Peconic. SCTM# 1000-67-7-13
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation that
the action is INCONSISTENT with the below listed Policy Standards and therefore is
INCONSISTENT with LWRP.
6.3 Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southold Town Board of
Trustees laws and regulations for all Andros Patent and other lands under their
jurisdiction
The as-built bulkhead was constructed without a Wetland Permit.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

replenish splash pad area.

Permit for our property and the repair work we made to the Bulkhead and the beach stairs covered by
Permit# 7558A which we have applied for a transfer inot our name from Ken Teldaldi as we just
purchased this in September of 2016.Also, I have enclosed a survey prepared by Kenneth M Woychuk
Land Surveying Inc.originally dated 8/2/16 and revised 5/12/17 with actual bulkhead dimensions,
beach stair diminutions and splash pad sq.footage areas.Description for as built permit application;
We have made general repairs,invoice from Walter Gomez Landscaping enclosed to the existing Bulkhead
and Beach stairs.I have enclosed pictures of the work performed on the bulkhead repairs,beach stair
repairs',sprinkler system installed spring cleanup and mulch installed around property.
Bulkhead Repair: I had repairs made to the existing Bulkhead which is 48 linear feet by 10 "wide and 2'
+/_as shown on Mr.Woychuk Survey enclosed.Repairs were made with like materials of existing
bulkhead
Beach Stairs repair: I had the original stairs replaced/repaired as they were in an unsafe condition and a
trip hazard.The repair was made utilizing like materials of original stairs covered by Permit# 7558A.
Please note my wife had Parkinson's and I can provide a letter from Dr.Parfour of NYU if required.The
stair dimensions are wood steps 5'by 5'by 10"wide as noted on Mr.Woychuk survey.
Splash Pad replenishment: I had the splash pad house level 340 Sq.Ft and the water level splash pad 90
sq. Ft replenished as noted on Mr Woychuk Survey enclosed as well
I hope the above work and repairs meet with the trustless approval and that an as-built permit can be
issued for the existing bulkhead. I apologize for any inconvenience this may have caused as we were not
aware of the regulations'.

1. All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its si iLg�r ficant
beneficial and adverse effects upon the coastal area(which includes all of Southold Town).

Dear Trustees,
Please find enclosed our request for as as-built bulkhead. My wife and I bought this cottage September
of 2016.
It appears we have records/CO going back to 1978 but the town has no permit of file for the actual
bulkhead.

1 have enclosed revised survey from Kenneth Woychuk Surveying and Design from 8/2/16 and revised
5/2/17 to reflect the sq.footage of stone splash area and the bulkhead dimensions of 48 linear feet High
Wood Bulkhead.
I have enclosed pictures of the bulkhead and if you look closely you can see wear I made minor repairs
to the bulkhead. We dug out the stone splash area on the house side of the bulkhead and placed like
material patches internally.The repairs were very minor but this work prevents any sand and soil
slippage thru the bulkhead itself. If you look closely at the picture I have enclosed,you can see where we
placed the internal patches.
Also, note we made repairs to the beach stairs as it was I believe a trip hazard and my wife has
Parkinson's so I placed a hand rail on the beach steps. I applied for a transfer of permit#7558A from the
previous owner Kenneth Tedaldi into our name already at your office in April 2017.
Please note a copy of the repair invoice which was also inclusive of spring cleanup of the outside lawn
etc. and the installation of mulch around the shrubbery etc. I have enclosed pictures of all.
I hope I completed application properly. If you need any additional information, please contact me via
my cell 917-364-7299 and I will respond as best as possible. I have enclosed a check for$500.00 as well
for the application fee and hope this meets with Board approval.
