With this they are requiring that the float be secured by four piles with two of the piles installed at each end of the float; a "cross beam float support" would then be installed between each of the two piles located at either end of the float. That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will,at his or her own expense, defend any and all such suits initiated by third parties,and the said Permittee assumes full liability with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved,to provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized,or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation,the said Permittee will be required,upon due notice, to remove or alter this work project herein stated without expenses to the Town of Southold. 8. That the said Board will be notified by the Permittee of the completion of the work authorized. 9. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit, which may be subject to revoke upon failure to obtain same. 10. No right to trespass or interfere with riparian rights. This permit does not convey to the permittee any right to trespass upon the lands or interfere with the riparian rights of others in order to perform the permitted work nor does it authorize the impairment of any rights, title, or interest in reat or personal property held or vested in a person not a party to the permit. I currently share an existing dock with two other neighbors, Henry Loeffler and Gerry Diffley. I am very familiar with docks and hazards to navigation in that- in the 1980's I was issued a 100 ton masters license from the U.S. Coast Guard and I owned one half of Seatow Eastern L.I. with Joe Frohnhoeffer. In addition to our towing business, Joe and I built and repaired many docks in the area. First- In reference to the current pending application -the clearance given on this application is only approximately fifteen feet between our floats and the proposed six foot by twenty foot float. We currently have two eight and one half foot wide boats tied on the side of our dock that is next to the proposed 4 foot by 89 foot fixed dock. It would be impossible for the second boat, (Mr. Diffley's) to have enough clearance to leave his float. About six feet of clearance is not enough to get through. He would be completely blocked. Using fenders when tying to the float would also add six inches. The clearance should be at least 25 feet. He has to either back in or back out of his berth which necessitates even more clearance. Second - If the proposed 6 foot by 20 foot float is approved, chances are a boat of greater length would be tied to this float. For example'- if a 26 to 28 foot boat is there, it would be possible that this boat would extend an additional 8 feet, narrowing the distance between our docks even more. Third - In addition, this property has been for sale quite some time and in our opinion the sole purpose of the application is to make the property more appealing to any future buyer so the listing can say"permitted dock" as it now says "permitted swimming pool." Fourth - Ms. Ameen's proposal seriously infringes on the extension of my property line into the water. I only mention this because when we applied for a dock permit more than forty years ago, the Board of Trustees at that time required us to get a letter from Mrs. Avant who owned the property adjacent to us on the north side because our dock partially infringed on her property line. I would hope the same consideration be given to this application. I would definitely have an objection to this. Fifth - It would not be a hardship for her to move her proposed dock and float over towards the middle of her property. I had mentioned this to Mr. Forbes, who is part owner of this property a number of times but for some reason he refuses to change his mind and consider moving his dock further away from ours. Sixth - I do not know if it is my purview to comment on the construction of the proposed dock but I can make several comments. There is a freshwater spring just north of our docks. As you know, freshwater freezes before saltwater. As the tide rises, the whole end of Deep Hole Creek swirls counter clockwise and thus drives the thicker ice toward our docks. Many other docks in the area have triple pilings on each end of their floats In my opinion, two 4 by 4's 1 sitting in the pudding mud simpiy will not do the job and will be wiped out the first time the thickened ice starts to swirl. In addition, the mud in this area is extremely deep. It has the consistency of pudding. If you want to put a 20 ft. x 2 inch pipe into the mud, you have to be very careful not to shove it in too hard because if you do, it will completely disappear. 4x4s simply won't hold. In closing, I strenuously object to the size and placement of this dock proposal. Secondly,I call to your attention the existing docks that are illustrated to the left (north)of the proposed construction. This dock is actually three separate docks owned by three separate homeowners: Edward Hannas,Hank Loeffler,and Gerard Diffley(formally owned by Sam Ganshaw). Mr. Hannas owns a total of 40 feet consisting of two twenty feet segments, Mr.Loeffler a twenty-foot segment,and my wife and I of a twenty-foot segment. The proposed construction by Ms.Ameen only leaves 15 feet of navigation space between our existing dock and the proposed construction. Assuming that a typical 19-foot outboard boat is 8 feet wide and assuming that a boat is docked at both docks,you quickly have a problem wherein you seek to utilize 16 feet of space when only 15 feet exists. At any given time two boats can be docked at the dock owned by Mr.Hannas,Mr.Loeffler,and myself. It is already a difficult feat to navigate past a boat docked in front of me requiring nae to swing out towards the proposed construction. Based on our review and the scope of the work you propose the Board has determined that you need to upgrade the application to a full wetland application as I have elaborated below. Due to the complexity of the application process and the current standards in the Wetlands Code you may wish to retain the services of a competent permit expeditor to assist you: 1) The Trustees previously were unable to transfer the existing permit into your names as it did not conform to the approved plan and permit on file for the prior owner. Our field inspection on the 9th revealed a similar condition as we noted piling supports that are not approvable (over-sized) and a small section of decking,that appears to be toxic/treated lumber; both may constitute an unauthorized repair. Without a wetland permit in your name you are not authorized to perform any repairs. Please perform no further work without a wetland permit from this office. These deficiencies may be corrected through the permit process, provided you agree to remove the unauthorized materials upon receiving a permit, and provided your plans include proposed pilings that are no larger than "4X4" with non-toxic decking over the water and "Thru-flow" style decking for the first 20-25'. 2) Your plans may include no more than one 6'x20' float (or a maximum of 120sq. ft. for all floats) as this is the maximum allowed by code at this time. (FYI: Your neighbor's docks were issued permits prior to this requirement when the standards were more lax.) Because of the proximity of neighboring property lines and docks you may wish to consider a modified "L" or"dog-leg" shaped configuration with a 5'x24' or 4'x30' float that may be more appropriate/beneficial for your site. The area of any jet-ski float must Y j be included against the 120 sq. ft. total float allowance. Floats should be located at least 15'from neighboring docks. 3) Your plans need to be neater and to an accurate scale. This office cannot grant approvals on plans that do not meet minimum standards. 4) To honor the existing pier line the proposed dock and plans should project no further seaward than a line connecting the nearest corners of the 'Us" of the neighboring docks. 5) The noticing requirements and public hearing provisions of the Town wetland code are all applicable. 6) You may reuse your existing floats as part of the 120 sq.ft. float total and reuse non- toxic decking. 7)The Clerks may credit your$50.00 administrative application fee towards the $250.00 full wetland application fee, provided your submission honors all the above items. 8) It is recommended that you apply for a tidal wetland permit from the NYS Dept. of Environmental Conservation in addition to the Town as there is concurrent jurisdiction in these matters. If you look at the depths on the plans you can see that the depth of-2.5'ALW is closer to shore on the left hand side of the dock next to the neighbors that had concerns; where on the right side of the dock the depth of-2 5 'ALW is further off shore. I believe that the difference is that there a couple of boats on the neighbor's dock and with the muddy bottom prop wash has probably created the difference. We are trying to stay away from the neighbors dock so we are trying to place the dock as far away as possible and lastly since they want the float dock in -2.5'ALW I have attached two separate sketches.
