HENRY, residing at 421 1st Street, Greenport, New York 11944, hereinafter referred to as "HENRY" and ROBERT J. TAPP and NICHOLAS J. ELLIS, residing at 152 Central Avenue, Greenport, New York 11944, hereinafter referred to as "TAPP & ELLIS", WHEREAS, HENRY is the owner of real property at 156 Central Avenue, Greenport, New York (SCTM #1001-005. 00-01,. 00-013 . 000) by deed dated February 13, 1987 and recorded in the Suffolk County Clerk' s Office on March 2, 1987 in Liber 10260, Page 329; and WHEREAS, - TAPP & ELLIS are the the owners of real property at -152 Central Avenue, Greenport, New York (SCTM #1001-005 . 00-01 . 00- 014 . 000) by deed dated January 2, 2014 and recorded in the Suffolk County Clerk' s Office on January 14, 2014 in Liber 12760, Page 228; and WHEREAS, HENRY and TAPP & ELLIS share a common boundary line between their respective properties; and WHEREAS, the parties desire to fix and definitely establish the boundary line between the two parcels mentioned above respectively owned by them. NOW, THEREFORE, in consideration of the premises and the sum of One Dollar by each of the parties to the other in hand paid, the receipt of which is hereby acknowledged, the parties for themselves, their heirs, executors, successors and assigns, —1— covenant and agree that the boundary line be established as a line described as follows : BEGINNING at a point on the northerly side of Central Avenue distant 342 . 08 feet easterly from the corner formed by the intersection of the northerly side of Central Avenue with the easterly side of Carpenter Street; from said point of beginning North 14 degrees 10 minutes 00 seconds West 1.25. 61 feet to land now or formerly of Parks. HENRY remises, releases and quitclaims to TAPP & ELLIS, their heirs, executors, administrators, successors and assigns forever all his right, title and interest in and to any land lying to the east of the boundary line so established. TAPP & ELLIS remise, release and quitclaim to HENRY, his -heirs, executors, administrators, successors and assigns forever all their right, title and interest in and to any land lying to the west of the boundary line so established. It is mutually covenanted and agreed by and between the parties that this agreement shall run with the land and be binding to the benefit of their respective heirs, executors, administrators, successors and assigns .
