LICENSE AGREEMENT made as of the 27th day of February, 2017 between
JOHN C. MEYER, residing at 2420 Indian Neck Lane, Peconic, New York ("Meyer") and
RICHARD S. DASKIN, residing at 2260 Indian Neck Lane, Peconic, New York ("Neighbor").
WHEREAS, Meyer is the owner of that certain parcel of land in Peconic, in the
Town of Southold, Suffolk County,New York, known and designated on the Land and Tax Map
of Suffolk County as District 1000, Section 086.00, Block 04.00, Lot 006.006, commonly known
as 2420 Indian Neck Lane, Peconic, New York (the "Meyer Property"); and
WHEREAS, Neighbor is the owner of the parcel of land adjoining the north
record line of the Meyer Property designated on the aforesaid map as District 1000, Section
086.00, Block 04.00, Lot 005, and commonly known as 2260 Indian Neck Lane, Peconic, New
York(the "Neighbor's Property'); and
WHEREAS, a portion of the Neighbor's driveway (the"Encroaching Driveway
Portion") is located southerly of the northern boundary line of the Meyer Property (the "Rec6rd
Boundary"), as shown in the shaded portion of the attached copy of a survey map of the Meyer
Property dated September 9, 2015 made by Peconic Surveyors, P.C. (the "Survey"); and
WHEREAS, the parties hereto wish to clarify and define the rights and
responsibilities each of them has in and to the Encroaching Driveway Portion.
NOW, THEREFORE, in consideration of$1.00 and other good and valuable
consideration, the parties hereto agree as follows:
1. Neighbor acknowledges that Neighbor is not vested with any title by any
means acquired to the Encroaching Driveway Portion of the Meyer Property or any part thereof
as shown in the shaded portion of the attached copy of the Survey.

2. The parties hereto acknowledge and agree that the boundary line between
their respective parcels is the Record Boundary as shown on the Survey,
3. During the term of this Agreement,Neighbor shall have the license to use
the Encroaching Driveway Portion, as it is presently being used only, as if it were a part of
Neighbor's own property subject to Neighbor's obligation to maintain it at Neighbor's own
expense. Such use and maintenance shall in no way be deemed to be hostile possession.
4. Neighbor shall indemnify,defend and hold Meyer harmless, including
reasonable attorneys' fees, from any claims, liability or damage to any property or injury or
death of any person occurring in, on or about the Encroaching Driveway Portion.
5. It is mutually agreed and covenanted that this Agreement shall run with
the land and be binding upon and inure to the benefit of the respective heirs, successors in
interest and assigns of the parties and the parties agree to record same within the Suffolk County
Clerk's Office.
IN WITNESS WHEREOF,the parties have entered into this Agreement as of the
day and year first above written.
