party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party of
the second part, the heirs or successors and assigns of the party of the second part forever,
All that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being in the Town of Southold, County of Suffolk, State of New York,
and being bounded and described as follows:
BEGINNING at a point on the westerly side of Hortons Lane at the northeasterly side corner of
the herein described and the southeasterly corner of land now or formerly of Hortons Lane LLC;
RUNNING THENCE South 10 degrees 31 minutes 50 seconds East along the westerly side of
Hortons Lane, 22.42 feet to the northerly end of the are of a curve connecting the westerly side of
Hortons Lane with the northerly side of Middle Road;
THENCE southerly and westerly along the arc of said curve having a radius of 86.00 feet a
length of 114.17 feet to a point at the westerly end of said curve;
THENCE South 65 degrees 32 minutes West along the northerly side of Middle Road, 136.28
feet to land now or formerly of Benali LLC;
RUNNING THENCE North 35 degrees 08 seconds East along said last mentioned land now or
formerly of Benali LLC, 137.45 feet to an iron pipe and land now or formerly of Westview
Holdings, LLC;
THENCE North 50 degrees 14 minutes 20 seconds East along said last mentioned land, 118.78
feet to land now or formerly of Hortons Lane LLC;
THENCE South 29 degrees 45 minutes 40 seconds East along said last mentioned land, 71.00
feet; and
THENCE North 60 degrees 14 minutes 20 seconds East still along land now or formerly of
Hortons Lane LLC, 126.34 feet to the westerly side of Hortons Lane at the point or place of
BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by
deed dated December 29, 2016, and recorded February 10, 2017 in the Office of the Suffolk
County Clerk in Liber 12900, Page 298.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and wily hold the right
to receive such consideration as a trust fund to be applied first for the purpose of paying the cost
of the improvement and will apply the same first to the payment of the cost of the improvement
before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year
