New York 11944,parry of the second part,
WITNESSETH,that the party of the first part, pursuant to Resolution Number 303-2017
adopted by the Suffolk County Legislature on April 25,2017 and thereafter,approved by the
County Executive on May 2,2017,in consideration of One Thousand Two($1,002.00)Dollars
DISTRICT paid by the party of the second part,does hereby remise,release,and quitclaim unto the party
1000 of the second part,the heirs or successors and assigns of the party of the second part forever,
SECTION ALL,that certain plot,piece or parcel of land,with any buildings and improvements thereon

recorded on September 8,2000 in Liber 12069 at CP 203 and described as follows,being and
LOT intended to be that parcel of land carried on the tax rolls of the Town of Southold under SCTM#
048.001 District 1000 Section 048.00 Block 01.00 Lot 048.001, _
5 7 7,,; FURTHER,notwithstanding the above description, it is the intention of this conveyance to

give title only to such property as was acquired by the County of Suffolk by Tax Deed on
September 7,2000,from John C.Cochrane,the County Treasurer of Suffolk County,New York
and recorded on September 8,2000, in Liber 12069,CP 203.
AND the premises described herein shall not be independently improved by the erection
of any habitable structure,and can be merged with grantee's adjoining parcel if applicable
so as to form one single lot. There can be no further subdivision of the merged parcel
unless it is consistent with local town and/or village zoning codes and standards of the
Suffolk County Department of Health Services,applicable at the time application is made.
THIS restrictive covenant shall be enforceable by the County of Suffolk by injunctive relief or
by any other remedy,in equity, or at law. The failure of the County of Suffolk or any agency
thereof to enforce this covenant,shall not be deemed to impose any liability whatsoever upon
the County of Suffolk or any officer,employee or agent thereof.
THIS covenant and restriction shall run with the land and shall be binding upon the grantee,
its successor and assigns,and upon all persons claiming under them.
TOGETHER with all right,title and interest,if any,of the party of the first part of, in and to
any streets and roads abutting the above-described premises to the center lines thereof;
TOGETHER with the appurtenances and all the estate and rights of the party of the first part
in and to said premises;
TO HAVE AND TO HOLD the premises herein granted unto the partyof the second part,the
heirs or successors and assigns of the party of the second part forever.
SUBJECT to all covenants,restrictions and easements of record,if any.
SUBJECT to any state of facts which an accurate survey might show.
AND the party of the first part, in compliance with Section 13 of the Lien Law, hereby
covenants that the party of the first part will receive the consideration for this conveyance and
will hold the right to receive such consideration as a trust fund to be applied first for the purpose
of paying the cost of the improvement and will apply the same first to the payment of the cost of
the improvement before using any part of the total of the same for any other purpose.
