AGREEMENT
THIS AGREEMENT entered into this aa' day of , 2016
between Harry Philippou and Irene Philippou residing at 552 8151 Street, Brookl , NY 11209
(hereinafter"Philippou"), Theodore Vallas and Eleni Vallas residing at 7723 10'Avenue,
Brooklyn, NY 11228 (hereinafter"T&H Vallas"), and Sarantos Vallas residing at 1063 8151
Street, Brooklyn,NY 11228 (hereinafter"S Vallas");
WHEREAS, Philippou and T&H Vallas are the owners in fee simple of certain real
property known as and by 2200 Rocky Point Road, East Marion, NY 11939 bearing SCTM
#1000-31-2-6.2 by Deed recorded in the Suffolk County Clerk's Office in Liber 12854
Page 912 and as more particularly described on Schedule A attached hereto and made a part
hereof(hereinafter the "Philippou and T&H Vallas Parcel") ;
WHEREAS, Philippou is the owner in fee simple of certain real property known as and
by 2090 Rocky Point Road, East Marion,NY 11939 bearing SCTM #1000-31-2-7 by Deed
recorded in the Suffolk County Clerk's Office in Liber 10449 Page 150 and more particularly
described on Schedule B attached hereto and made a part hereof(hereinafter the "Philippou
Parcel");
WHEREAS, S Vallas is the owner in fee simple of certain real property known as and by
1932 Rocky Point Road, East Marion, NY 11939 bearing SCTM # 1000-31-2-9 by Deed
recorded in the Suffolk County Clerk's Office in Liber 12150 Page 380 and more particularly
described on Schedule C attached hereto and made a part hereof(hereinafter the "S Vallas
Parcel");
WHEREAS all three parcels adjoin each other;
WHEREAS all three parcels are subject to or have the use of a right of way running from
Rocky Point Road to the "S Vallas Parcel" along the boundary line between the "Philippou and
T&H Vallas Parcel" and the "Philippou Parcel" as stated in their Deeds;
WHEREAS, the owners of all three parcels have mutually agreed to hereby extinguish
said right of way;
IT IS MUTUALLY AGREED AND COVENANTED that this agreement shall run with
the land and inure to the benefit of and be binding upon the parties hereto and their respective
heirs, legal representatives, successors and assigns.

SCHEDULE A DESCRIPTION
The property consists of the land and all the buildings and structures on the land in the
Town of Southold, County of Suffolk and State of New York. The legal description is:
BEGINNING at a point on the easterly side of Rocky Point Road, said point being where
the northwesterly corner of land of Peters intersects the said easterly side of Rocky Point
Road and from said point of beginning;

erected, situate, lying and being in East Marion, Town of Southold, Suffolk County,New York
and bounded and described as follows:
BEGINNING at a point on the easterly side of Rocky Point Road distant 2268.21 feet northerly
from the corner formed by the intersection of the northerly side of Main Road with the easterly
side of Rocky Point Road;
RUNNING THENCE along said easterly line of Rocky Point Road, North 8 degrees 30 minutes
00 seconds West 110.17 feet to the center line of a 20 foot right of way and land now or formerly
of Vrontos;
THENCE along said center line being along said land of Vrontos North 71 degrees 9 minutes 30
seconds East 152.48 feet to land now or formerly of Dinas;
