Main Rd. &Youngs Ave.) Southold, NY 11971 • �O@ Telephone: 631 765-1938 �yoom� LOCAL WATERFRONT REVITALIZATION PROGRAM TOWN OF SOUTHOLD MEMORANDUM To- John Bredemeyer, President Town of Southold Board of Trustees From: Mark Terry, Principal Planner LWRP Coordinator Date: February 9, 2b16 Re: Local Waterfront Coastal Consistency Review FIRM FOUNDATIONS PARTNERS LLC SCTM# 1000-113-6-23 Suffolk Environmental Consulting on behalf of FIRM FOUNDATIONS PARTNERS LLC request a Wetland Permit to remove the existing timber walk and docking assembly and construct a new dock assembly in approximately the same location consisting of a proposed landward 4'x16' top platform leading to a 4'wide by 52' long steps/rampway to a 4'x72' fixed catwalk, all supported by TxT posts/pilings; a 3'x15' hinged ramp; and a 6'x20' floating dock secured by four (4) 8"x8" pilings; all top decking located over vegetated tidal wetlands to be light penetrable thru-flow type decking material. Located: 1060 Fox Hollow Road, Mattituck. SCTM# 1000-113-6-23 The proposed actions have been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the below Policy Standards and therefore is INCONSISTENT with the LWRP. 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. The existing dock was not constructed pursuant to a Board of Trustees Wetland Permit. Pursuant to Chapter 268, the-Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. nFlanninq Form TS 1 � 2016Town of Southold holdToWn Board LWRP CONSISTENCY ASSESSMENT FORM A. INSTRUCTIONS 1. All applicants for permits*including Town of Southold agencies, shall complete this CCAF for proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2. Before answering the questions in Section C,the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its significant beneficial and adverse effects upon the coastal area(which includes all of Southold Town). 3. If any question in Section C on this form is answered"yes"or"no",then the proposed action will affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. Thus, each answer must be explained in detail,listing both supporting and non- supporting facts.. If an action cannot be certified as consistent with the LWRP policy standards and conditions, it shall not be undertaken. Foster a pattern of development in the Town of Southold that enhances community character, preserves open space,makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development. See LWRP Section IH—Policies; Page 2 for evaluation criteria. ® Yes ❑ No ❑ Not Applicable Subject proposal is consistent with the policy in that the siting/utilization of the reconstructed dock assembly will maintain the character of the surrounding neighborhood, which currently consists of many similarly- improved residential lots with similar accessory structures (i.e. dock assemblies). In addition, subject proposal will be in harmony with the ". beneficial use of a coastal location " in that the legally created residential waterfront(i.e. coastal) lot will be enhanced by the reconstructed dock assembly in order to maintain access to the contiguous surface waters. See LWRP Section III—Policies Pages 5 through 7 for evaluation criteria ® Yes ❑ No ❑ Not Applicable Subject proposal will not adversely impact the visual quality of the surrounding area in that the surrounding area is currently comprised of properties improved with similar appurtenances (i.e. dock assemblies) of similar size and scope. Scenic resources, assumedly views of Mattituck Creek, are not at risk due to the reconstructed dock assembly being typical of the character of this section of waterfront. Accordingly, this proposal will comply with Policy 3. Attach additional sheets if necessary NATURAL COAST POLICIES Policy 4. Minimize loss of life, structures, and natural resources from flooding and erosion.
