En-Consultants on behalf of the ESTATE OF HARRIET E. GAMPER requests a Wetland Permit to
construct approximately 184 linear feet of vinyl bulkhead in-place of existing timber bulkhead and
backfill with approximately 25 cubic yards of clean sand fill to be trucked in from an approved upland
source; remove existing 5'x22.5' wood ramp and install a 3'x26' aluminum ramp to existing 10'x30' fixed
concrete dock with wood decking; and construct a new±16' section of vinyl bulkhead within 14" of
existing,concrete wall/boathouse foundation wall. Located: 2895 Wells Avenue, Southold. SCTM#
1000-70-4-13
The proposed actions have been reviewed to Chapter 268,-Waterfront Consistency Review of the Town
of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my recommendation that the proposed action to
remove existing 5'x22.5' wood ramp and install a 3'x26' aluminum ramp to existing 10'x30' fixed
concrete dock with wood decking is INCONSISTENT with the below Policy Standards and therefore
is INCONSISTENT with the LWRP.
6.3 Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and
regulations for all Andros Patent and other lands under their jurisdiction
1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions.
The existing concrete dock was not constructed pursuant to a-Board of Trustees Wetland
Permit. A permit was issued for a dock structure in 1957 under the name Meoller for a dock 20'
in length. The existing dock does not comply with the permitted configuration.
The proposed action to construct 184 linear feet of vinyl bulkhead in-place of existing timber
bulkhead and backfill with approximately 25 cubic yards of clean sand fill to be trucked in from
an approved upland source; construct a new±16' section of vinyl bulkhead within 14" of
existing concrete wall/boathouse foundation wall is Consistent the LWRP.
In the event the action is approved a vegetated, non-turf buffer(excluding access paths) is
recommended for the width of the back filled area to further LWRP policies 5 and 6.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
If any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency
review law. Thus, each answer must be explained in detail, listing both supporting and non-
supporting facts. If an action cannot be certified as consistent with the LWRP policy standards and
conditions, it shall not be undertaken.

Policy 4
The project seeks to replace an existing timber bulkhead(originally permitted by the Town of
Southold in 1957)with a vinyl bulkhead in the same location to maintain the property's historical
method of protection against erosion and flooding. Pursuant to Pursuant to Town Code §268-5
("Review of Actions") and the corresponding definitions of"action" and "minor action" by §286-
3 ("Definitions"),the project meets the following definition of minor action and is thus not
subject to waterfront consistency review pursuant to Chapter 268: "GG. Within all Town creeks,
replacement of existing bulkhead on the applicant's property in the same location with a silt
curtain deployed prior to and during construction." Also proposed is the addition of a+/- 16'
section of vinyl bulkhead to be constructed immediately seaward(within 14") of the existing
concrete wall that comprises part of the existing boat house foundation. This proposed section of
wall would connect the subject bulkheading being replaced to the south of the boat house with
the northerly neighbor's bulkhead return to the north of the boat house and would serve to protect
and preserve the integrity of the boat house. (A similar bulkhead extension was approved for a
property fronting Jockey Creek to the north on Calves Neck Road in 2001 via Wetlands Permit
No. 5270). The existing, developed site has been improved with and supported and protected
from flooding and erosion by a bulkhead since prior to 1960, and there is no viable non-
structural alternative means of maintaining and protecting the upland portion of the property or
the existing boat house in its current location. Without replacement and maintenance of the
bulkhead,the subject and adjacent properties would be exposed to severe erosion, flooding, and
damage to the residential structures located thereon. Therefore the project is consistent with
Policy 4.
Pursuant to Town Code§268-5 ("Review of Actions")and the corresponding definitions of"action" and"minor action"by§286-3
("Definitions"),the proposed bulkhead replacement meets the following definition of minor action and is thus not subject to waterfront
consistency review pursuant to Chapter 268: "GG. Within all Town creeks,replacement of existing bulkhead on the applicant's property
in the same location with a silt curtain deployed prior to and during construction." And consistent with Policy 6,the proposed
construction of a+/- 16'extension of the vinyl bulkhead immediately seaward of the existing concrete wall/boat house foundation will
not result in the physical loss,degradation,or functional loss of ecological components or otherwise adversely impact the wetlands or
tidal waters of the Town.
