Re: Coastal Consistency Review for NEIL STRONSKI and PATRICIA PEREZ#6929
SCTM# 1000-111-15-11
A 1987 Wetlands Permit was found for a secondary retaining wall.
NEIL STRONSKI and PATRICIA PEREZ#6929 - Request for Variances from Article XXII Section 280-
116A and Article XXIII Section 280-124 and the Building Inspector's December 22, 2015, Amended
January 14, 2016 Notice of Disapproval based on an application for building permit to legalize 'as built'
additions/alterations and accessory structures and construct additions/alterations to the existing 'as
built' accessory structures, at; 1) the proposed and 'as built' accessory construction is less than code
required setback of 100 feet from the top of the bluff, 2) 'as built' deck addition is less than the code
required setback of 100 feet from the top of the bluff, 3) 'as built' deck addition located at less than the
code required minimum side yard setback of 15 feet, located at: 7125 Nassau Point Road (adj. to Little
Peconic Bay) Cutchogue, NY. SCTM#1000-111-15-11
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my recommendation that the actions are
INCONSISTENT with the Policy Standards and therefore are INCONSISTENT with the LWRP.
Policy 4.1. "Minimize losses of human life and structures from flooding and erosion hazards." The
following management measures to minimize losses of human life and structures from flooding and
erosion hazards are recommended. specifically
A. Minimize potential loss and damage by locating development and structures away from
flooding and erosion hazards.
3. Move existing development and structures as far away from flooding and erosion
hazards as practical. Maintaining existing development and structures in hazard areas may
be warranted for.
a. structures which functionally require a location on the coast or in coastal waters.
The accessory structures do not functionally require a location on the coast and
are not water dependent.
5. Manage development in floodplains outside of coastal hazard areas so as to reduce adverse
environmental effects, minimize the need for future structural flood protection measures, or expansion
of existing protection measures and to meet federal flood insurance program standards.
Flood zones are not shown on the submitted documents and must be added.
Portions of the deck appear to be located in the VE (velocity hazard) Flood Zone - EI 9'. VE zones are
defined as areas with special flood hazards associated with high-velocity waters generated by tidal
surges and hurricane wave wash. Accessory structures located within these areas have the potential
to suffer high rate of loss and pose hazards to life and property during storm surge events.

Further, the "as built additions/alterations and accessory structures" were built without the benefit of
Board review and approvals and therefore does not meet Policies 1 and 6.
Pursuant to Chapter 268, the Southold Town Zoning Board of Appeals shall consider this
recommendation in preparing its written determination regarding the consistency of the proposed
action.

ZONING BOARD OF APPEALS
FORM ZH4 1'-7 f Y
t ll •1 ' •'. Betty Ne ille, Secretary
Chairman Board of ppeaIC Southold Town Board of Appeals
After investigation and inspection the Board finds that the
applicant requests approval of access over private rightrof-way
in accordance with the New York State Law, Secttion g8QA. The
Board finds that the applicant's lot has sufficient area for two
dwellings. The applicant washes to divide lot in half and reserve
a right-of-way to waterfront lot over present access. The Board
is in agreement with the reasoning of the applicant and grants
approval of access subject to the conditions that the right-of-way
be widened to 15 feet and be improved to the approval of the
Building Inspector.
The Board finds that strict application of the Ordinance
would produce practical difficulties or unnecessary hardship;
the hardship created is unique and would not be shared by all
properties alike in the immediate vicinity of this property
and in the same use district; and the variance will not change
the character of the neighborhood, and will observe the, spirit
of the Ordinance.
THEREFORE, IT WAS RESOLVED Fxances-Seewald, Naasau Point Road,
Cutchogue, New York, be GRANTED approval of access over Private
right-of-way as applied for. Location of property.: private -right-
