En-Consultants on behalf of LISTA M. CANNON requests a Wetland Permit to demolish and
remove existing one-story dwelling with attached deck and related structures, including retaining
walls at basement level; construct new two-story, 1,511sq.ft. single-family dwelling with attached
12'x45' first-story deck and associated steps, 12'x14' trellis, and 12'x16' second story porch;
construct new 18" high retaining walls at walk-out basement level; install approximately 448sq.ft.
irregularly shaped on-grade masonry patio at basement level below first story deck; install 4'x4'
outdoor shower and masonry stepping stones; and establish and subsequently maintain a 10' wide,
780sq.ft. non-turf buffer adjacent to the tidal wetlands boundary. Located: 725 Arshamomaque

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation that
the proposed action is CONSISTENT with the LWRP policies and therefore CONSISTENT with the
LWRP provided the following:
1. Require that the 750 square foot non-turf buffer be shown on the plans.
2. Clarify where the outdoor shower will drain.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area(which includes all of Southold Town).
If any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency
review law. Thus, each answer must be explained in detail, listing both supporting and non-
supporting facts. If an action cannot be certified as consistent with the LWRP policy standards and
conditions, it shall not be undertaken.

In association with the removal of the existing dwelling and construction of the proposed dwelling,a drainage system of leaders,gutters,and drywells
will be installed to collect roof runoff. By also reducing lawn areas and increasing the setback of lawn areas from wetlands by establishing a 10'wide,
approximately 795 square-foot nonturf buffer adjacent to the tidal wetlands boundary,which can serve both as a sink and filter for stormwater runoff
and contaminants,the quantity of runoff reaching the adjacent tidal waters will be decreased and the quality of runoff will be improved through a
reduced concentration of potential fertilizers,pesticides,and insecticides. Additionally,groundwater and ultimately surface water quality will benefit
from the replacement of the existing,nonconforming sanitary system with a new,Suffolk County Department of Health Services-conforming sanitary
system located outside Chapter 275 jurisdiction and more than 200 feet from the surface waters of Pettys Pond. Therefore,consistent with Policy 5,
water quality and supply will be both protected and improved as a result of the mitigation measures associated with the project.

Policy 6
Consistent with Policy 6, the project will contribute to the protection and restoration of the
adjacent tidal wetland ecosystem. The proposed dwelling, which will be located entirely in a
FEMA designated Zone X, will be situated in roughly the same location as the existing dwelling
but 2 feet farther(97 versus 95 feet) from the tidal wetlands boundary associated with Pettys
Pond. The proposed deck attached to the waterfront side of the house will maintain the same 87'
wetlands setback as the existing waterfront deck. Thus,the new dwelling structure will create no
new encroachment on the adjacent wetlands and will remain situated farther landward of
wetlands than the structures on the adjoining properties to the north and south, consistent
with§275-11(3). Although only a limited portion of the proposed dwelling will actually be
located within 100 feet of wetlands and within Chapter 275 jurisdiction, significant mitigation
measures have been included in the project design to offset any potential impacts of the proposed
construction activities and to improve upon existing site conditions to create a net environmental
benefit upon project completion. Specifically, a drainage system of leaders, gutters, and
drywells will be installed to collect roof runoff, and a 10' wide, approximately 795 square-foot
nonturf buffer will be established adjacent to the tidal wetlands boundary, which can serve both
as a sink and filter for stormwater runoff and contaminants. By thus reducing lawn areas and
increasing the setback of lawn areas from wetlands,the quantity of runoff reaching the adjacent
tidal waters will be decreased, and the quality of runoff will be improved through a reduced
concentration of potential fertilizers,pesticides, and insecticides, thereby providing a net benefit
to surface water quality. Groundwater and ultimately surface water quality will also benefit from
the replacement and landward relocation of the existing sanitary system with an upgraded,
Suffolk County Department of Health Services-conforming sanitary system located outside
Chapter 275 jurisdiction and more than 200 feet from the surface waters of Pettys Pond. The
project is located entirely landward of the 10- elevation contour above mean sea level and thus
beyond the tidal wetlands jurisdiction of the New York State Department of Environmental
Conservation.
