Located: 302 Town Creek Lane, Southold. SCTM# 1000-64-1-12 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the LWRP policies and therefore CONSISTENT with the LWRP. This recommendation is made on the basis that the applicant has shown that there is no further impediment on navigation of the waterbody and public access as long as the vessel used to describe the action is in use. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its significant beneficial and adverse effects upon the coastal area(which includes all of Southold Town). If any question in Section C on this form is answered "yes" or "no", then the proposed action will affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. Thus, each answer must be explained in detail, listing both supporting and non- supporting facts. If an action cannot be certified as consistent with the LWRP policy standards and conditions, it shall not be undertaken. See LWRP Section III - Policies; Pages 38 through 46 for evaluation criteria. ® Yes FINo R Not Applicable The proposed float orientation would create no more encroachment on the waterway than would tying the 11'wide boat to the outside of the existing,permitted,shore-parallel float,even without tie-off piles on the seaward side of it,as the shore-perpendicular float would extend approximately 11 feet farther seaward than the existing float. The proposed float orientation would also remain well within the code-required limitation of one-third of the width of the waterway,with a 44'or approximately one-fifth seaward extension from mean lower low water. The proposed dock reconfiguration would also permanently limit the dockage facility's potential seaward intrusion by eliminating the variability of larger boats being docked on the seaward side of the shore-parallel float and instead confining boats to the proposed dockage footprint alongside the shore-perpendicular float. Therefore,consistent with Policy 9,the proposal will have no adverse impact on public access to or recreational use of Town Creek.
