En-Consultants on behalf of FARLEY FINE ARTS, LLC requests a Wetland Permit to remove
existing non-native, invasive species (e.g. Japanese knotweed), and establish additional native
plantings (e.g. Cape American beach grass and groundsel bush), on naturally vegetated
embankment landward of existing concrete seawall while maintaining existing native trees and
shrubs for the purpose of enhancing the density and diversity of vegetation occurring on the
embankment and increasing the soil stability and natural erosion control capacity of the
embankment. Located: 7940 Indian Neck Road, Peconic. SCTM# 1000-86-7-7.2
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation that
the proposed action is CONSISTENT with the LWRP policies and therefore CONSISTENT with the
LWRP.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

A. INSTRUCTIONS Southold Town
1. All applicants for perm its' including Town of Southold agencies, shall c
proposed actions that are subject to the Town of Southold W aterfront Consistency Review Law . This
assessm ent is intended to supplem eat other inform ation used by a Town of Southold agency in
making a determination of consistency, *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area(which includes all of Southold Town).
If any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency
review law. Thus, each answer must be explained in detail, listing both supporting and non-
supporting facts. If an action cannot be certified as consistent with the LWRP policy standards and
conditions, it shall not be undertaken.
A copy of the LWRP is available in the following places: online at the Town of Southold's website
(southoldtown.northfork.net), the Board of Trustees Office, the Planning Department, all local
libraries and the Town Clerk's office.

Consistent with Policy 6,the project will further the goal of protecting and restoring the existing shoreline and tidal wetland ecosystem through the
vegetative enhancement of the naturally vegetated embankment. Specifically,the proposed revegetation plan proposes to a)remove existing
non-native,invasive species,such as Japanese knotweed;b)maintain existing native trees and shrubs on the embankment,such as cedars,bayberry and
rose;and c)establish new plantings of seaside suitable native vegetation,such as Cape American beach grass,switch grass,little bluestem grass,
Virginia rose,groundsel bush,and additional bayberry. The addition of these plantings will enhance the density and diversity of the vegetation
occurring on the embankment;increase the soil stability and natural erosion control capacity of the embankment;and enhance the embankment's ability
to act as a stormwater runoff sink and filter for potential contaminants such as fertilizers,pesticides,and insecticides
