The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the below Policy Standards and therefore is CONSISTENT with the LWRP provided that Chapter 275 dock standards have been met. The action would not result in a substantial conveyance of public bottomlands or waters over existing conditions. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. See LWRP Section III - Policies; Pages 22 through 32 for evaluation criteria. ®Yes ❑ No ❑ Not Applicable LISTA M CANNON 725 ARSHAMOMAQUE AVENUE SOUTHOLD,NY SCTM 91000-66-3-2 LWRP CONSISTENCY ASSESSMENT FORM POLICY 6 The proposed dock,only±13 square feet of which will consist of permanent fixed dock structure located seaward of the high water line of Pettys Pond,will replace a+5'x 30' permanent fixed dock that has been present since prior to 1977 and covers approximately 156 square feet of the surface water of Pettys Pond at high tide. The new dock will extend no more than 19 feet seaward of mean lower low water(less than 25% of the width of the waterway)and will be situated inside the"pier line"of the two neighboring dock structures, including the similarly constructed dock to the north that was constructed pursuant to Southold Wetlands Permit No. 5086. Therefore,the dock will be consistent with the dock construction and operation standards set forth by§275-11(C)(2)and will not interfere with navigation or other public use of the adjoining waterway. To minimize the dock's impact on tidal wetlands vegetation,the catwalk will be constructed with open-grate decking, and the ramp and float will be constructed with untreated wood decking. Therefore,consistent with Policy 6,the proposed dock will not cause the"fragmentation of ecological communities;"result in the physical loss, degradation, or functional loss of ecological components; or have any other significant adverse impact on the adjacent tidal wetlands or waters of the Town and will otherwise comply with the statutory and regulatory requirements of Chapter 275 and Article 25 of the New York State Environmental Conservation Law.
