1. Final survey of property with accurate location of all buildings,property lines, streets, and unusual natural or

FINDINGS, DELIBERATIONS AND DETERMINATION
MEETING OF JULY 25, 2002

Property Location: 460 Village Lane, Mattituck 1000-114-7-19
SEORA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration
in this application and determines that this review falls under the Type II category of the State's List of
Actions, without an adverse effect on the environment if the project is implemented as planned as a
setback or lot line request.
BASIS OF APPEAL: Building Inspector's Notice of Disapproval dated March 20, 2002, denying a
permit for an "as built deck" addition to a single-family residence because the deck is located +/- 7.6 feet
from a side yard instead of the code-required minimum setback of 15 feet for a single side yard, pursuant
to Article XXIV Section 100-242A.
AREA VARIANCE REQUESTED: Applicant requests a variance for a 32 ft. by 14 ft. as-built deck
addition, part of which, approximately 7.6 ft. by 14 ft. is set back less than the code's 15 foot minimum.
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on July 25, 2002 at which time
written and oral evidence were presented. Based upon all testimony, documentation, personal inspection
of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant:
PROPERTY FACTS: Applicant's property is located on the north side of a Village lane in Mattituck. The
lot is improved with applicant's one story house and garage and the as-built attached deck addition, all as
shown on the site plan prepared by Young and Young, P.E, dated January 29, 2002, and the survey
prepared by Peconic Surveyors dated June 8, 1988.
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and
personal inspections, the Board makes the following findings:
1. Grant of the area variance will not produce an undesirable change in the character of the neighborhood
or a detriment to nearby properties. The deck addition has existed in its current location for at least seven
years with no apparent ill effects to surrounding neighbors. The deck is screened from view of the
adjoining property owners by evergreen hedges, and follows the existing side yard setback of the
residence.
2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to
pursue, other than an area variance. The deck addition is built. The only remedy would be to remove the
approximately 7.6 ft. by 14 ft. of nonconforming deck area which would be costly and serve no public
benefit since the nonconforming area of the deck aligns with the nonconforming area of the residence.

3. The variance granted herein is substantial in relation to the code's 15-foot minimum single side yard
requirement and represents a 50 percent reduction. However, the code also requires total side yards of 35
feet for this size lot and the applicant exceeds the minimum with a total side yard setback of+/-57.7 feet.
4. The alleged difficulty has been self-created because construction took place without the required town
permits.
5. No evidence has been submitted to suggest that the proposed additions will have an adverse impact on
physical or environmental conditions in the neighborhood.
6. Grant of the requested variance is the minimum action necessary and adequate to enable the applicant
to enjoy the benefit of a deck addition to a single-family residence while preserving and protecting the
character of the neighborhood and the health, safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test
under New York Town Law 267-13, motion was offered by Member Tortora, seconded by Chairman
Goehringer, and duly carried, to
GRANT the Variance authorizing, a 14 ft, by 32 ft. as-built open deck addition with a single sidc
yard setback of+/- 7.6 ft. at its closest point to the south property line; and on CONDITION that
the deck remain unenclosed and open to the sky.
Vote of the Board: Ayes: Members Goehringer (Cha' ora, Horning, and Orlando. (Member
Oliva was absent.) This Resolution was duly a ed (4-0).

The "as built' deck addition to an existing, non-conforming structure on a non-conforming lot is not
permitted pursuant to Article XXIV Section 100-242A which states;
"Nothing in this article shall be deemed to prevent the remodeling, reconstruction or
enlargement of a non-conforming building containing a conforming use,provided that such
action does not create any new non-conformance or increase the degree of non-conformance
with regard to the regulations pertaining to such buildings."
Therefore, the proposed addition to the existing non-conforming single family dwelling is not
permitted pursuant to Article XXVI Section 100-244 which states that non-conforming lots between
20,000 square feet and 39,999 square feet in total size, require a single side yard setback of 15 feet, and
a total side yard setback of 35 feet. The plan note a single side yard setback of+/- 7.6 feet, and a total
side yard setback of 57.7 feet.
Total lot coverage is+/- eight (8)percent.
