Located: 1455 Ole Jule Lane & 1570 Ole Jule Lane 10' Wide Right of Way, Mattituck. SCTM# 1000-122-5-1 (Dominant) & 1000-122-4-3 (Servient) The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the LWRP policies and therefore CONSISTENT with the LWRP provided that the Board requires that the applicant comply with the following dock standards pursuant to § 275-11. Construction and operation standards C. 2. d. (d) Review and approval of dock applications. Before issuing a permit for a dock structure, the Trustees shall consider whether the dock will have any of the following harmful effects: [9] Whether the dock will impair navigation or be located in areas of high vessel traffic or vessel congestion; The navigable channel in this waterway is narrow and limited. The applicant must show the width of a representative vessel at the end of the dock to adequately assess impacts to navigation.' [2] Whether the dock will unduly interfere with the public use of waterways for swimming, boating, fishing, shellfishing, waterskiing and other water-dependant activities; [5] Whether the dock will cause degradation of surface water quality and natural resources, (11] Whether the cumulative impacts of a residential and commercial dock will change the waterway or the environment and whether alternate design, construction, and location of the dock will minimize cumulative impacts, and [12] Whether adequate-facilities are available to boat owners and/or operators for fueling, discharge of waste and rubbish, electrical service and water service. The applicant presently enjoys access to the waterbody via the right of way and an opportunity for a mooring. Due to the shallow water depths and environmental sensitivity of the area, seasonal moorinq of vessels further the LWRP policies. It is recommended that the Board determine whether or not alternative means to gain access are available and that the ability to moor a vessel is not possible. 9.3 Preserve the public interest in and use of lands and waters held in public trust by the state and the Town of Southold. A. Limit grants, leases, easements, permits or lesser interest'in lands underwater in accordance with an assessment of potential adverse impacts of the proposed use, structure, or facility on public interest in public lands under water. 3. Obstruction of navigable waters and underwater/ands is limited: b. to the minimum necessary for access to navigable waters. The minimum is determined by evaluating the following factors: (vi) whether or not alternative means to gain access are available. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. Located: 2700 Sound Drive, Greenport. SCTM# 1000-33-1-11 The Zoning Board of Appeals has granted alternative relief approval for the actions (in part) in May 19, 201 (6972). The decision (with conditions) found the action CONSISTENT with the LWRP policies to the greatest extent practicable. The proposed actions have been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed actions are CONSISTENT with the Policy Standards and therefore are CONSISTENT with the LWRP provided the Board concurs with the Zoning Board of Appeals decision. Locating the pool the required 100' from the top of bluff cannot be achieved and therefore the action has been mitigated through the Zoning Board of Appeals conditions to the greatest extent practicable; furthering the LWRP policies. 2.
