Twin Fork Landscape Contracting, Inc. on behalf of PETER SABAT requests a Wetland Permit to
remove existing timber walk, fixed dock, ramp and float; construct a 4'x125' elevated catwalk using
thru-flow decking over the vegetated wetlands; a 3'x12' hinged aluminum ramp; and a 6'x20'
r' floating dock secured by two double 10" dolphin pilings; with all construction to consist of non-
treated building materials and galvanized hardware. Located: 3000 & 3090 Beebe Drive,
Cutchogue. SCTM# 1000-103.-3-16&17
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation that
the action is INCONSISTENT with the Policy Standards (Policy 6.3) and therefore is
INCONSISTENT with LWRP.
6.3 Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southold Town Board of
Trustees laws and regulations for all Andros Patent and other lands under their
jurisdiction
1. Comply with Trustee regulations and recommendations as set forth in Trustee
permit conditions.
A Wetlands Permit for the current dock was not located in the Town
records.

The applicant fails to prove that the action meets the following requirements § 275-11 Construction
and operation standards C. 2 (d) of the Southold Town Code:
(d) Review and approval of dock applications. Before issuing a permit for a dock structure, the
Trustees shall consider whether the dock will have any of the following harmful effects:
[21 Whether the dock will unduly interfere with the public use of waterways for swimming, boating,
fishing, shelffishing, waterskiing and other water-dependant activities,
The dock extends further into the water body than surrounding structures affecting the public use of
the waterbody. Further, Chapter 275 requires that the determination of the length of the dock must
include the dimensions of the vessel. The dimensions of a vessel are not specified.
[3] Whether the dock will unduly interfere with transit by the public along the public beaches or
foreshore;

[61 Whether the dock will cause habitat fragmentation and loss of significant coastal fish and wildlife
habitats,
The dock structure is located within a New York State Significant Coastal and Fish and Widlife
Habitat Area/ NYSDEC Critical Environmental Area. At the discretion of the Board of Trustees, any
operations proposed in critical environmental areas (§ 275-2) may be subject to more stringent
requirements than detailed in this section. Such requirements may include, but are not limited to,
denial of certain operations, shortening or reducing the size of structures, and increasing the
width of non-disturbance buffers.

[7] Whether the dock will result in the destruction of or prevent the growth of vegetated wetlands,
seagrasses including eelgrass (Zosters marina) and widgeon grass (Ruppia maritima) or shellfish;
[11] Whether the cumulative impacts of a residential and commercial dock will change the
waterway or the environment and whether alternate design, construction, and location of the dock
will minimize cumulative impacts, and
The continued expansion/construction of dock structures within a Siqnificant Fish and Wildlife
Habitat/Critical Environmental Area will affect the public use of the area and degrade the ecological
quality of the area through introduction of contaminants, disruption of marine life habits etc ....
Correspondingly, physical and functional loss to wildlife has been found to occur through the loss
and/or impairment of habitat, disruption of habits and migration patterns (structure and activity) and
introduction of harmful contaminants.
[12] Whether adequate facilities are available to boat owners and/or operators for fueling,
discharge of waste and rubbish, electrical service and water service.
No such facilities are proposed or discussed
9.3 Preserve the public interest in and use of lands and waters held in public trust by the state and
the Town of Southold.
A. Limit grants, leases, easements, permits or lesser interest in lands underwater in
accordance with an assessment of potential adverse impacts of the proposed use, structure,
or facility on public interest in public lands under water.
3. Obstruction of navigable waters and underwater/ands is limited.
b. to the minimum necessary for access to navigable waters. The minimum is
determined by evaluating the following factors:
(vi) whether or not alternative means to gain access are available.
The applicant presently enjoys access to the waterbody via the opportunity for a mooring and
existing dock (may not have valid permits). Due to the shallow water depths and environmental
sensitivity of the area, seasonal moorinq of vessels further the LWRP policies.
In the event the action is approved, it is recommended that:
1. That a non-turf, vegetated buffer be established.
2. The dock be shortened to comply with the existing "pier line".
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

proposed actions that are subject to the Tovm of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfiont Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area(which includes all of Southold Town).
3. If any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency
review law. 'Thus, each answer niust he explained in detail, listing both supportingr and non-
supporting facts. If an action cannot be certified as consistent with the LWRP policy standards and
conditions,it shall not be undertaken.
A copy of the LWRP is available in the following places: online at the Town of Southold's
website (southoldtoum.northfork.net), the Board of Trustees Office,the Planning Department, all
local libraries and the Town Cleric's office.

Attached provides you with a Wetland permit Application.
The purpose of the proposed application is to obtain Trustee's permit for
reconstruction of an existing timber walk for a proposed dock/float to reach a
30" water depth at low tide due to the depth changes of Eugene's creek.
For Peter Sabat, we are requesting permit to reconstruct existing timber walk
for a proposed dock/float allowing light thru to water, extending to a 30"
water depth at low tide. Details of project, (1) elevated catwalk (4.0' x 125')
including timber walk reconstruction. All construction to consist of non-
treated building materials and galvanized hardware. Thru flow decking
material will be utilized over wetlands as required. (2) hinged ramp (3.0' x
12.0') Aluminum construction. (3) Floating dock (6.0' x 20.0') secured by two
double 10" Dolphin pilings.
