VICTOR FERRULLI #6952 - Request for Variances from Article Mll Section 280-124 and Article III Section 280-15 and the Building Inspector's February 3, 2016 Notice of Disapproval based on an application for building permit to legalize and make changes to 'as built' additions and alterations to existing single family dwelling and accessory shed, at; 1) less than the code required single side yard setback of 15 feet, 2) less than the code required total side yard setbacks of 35 feet, 3) 'as built' accessory shed located in other than the code required rear yard, located at: 1540 Smith Drive South (adj. to Goose Creek) Southold, NY. SCTM#1000-76-3-5. The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the below listed Policy Standards and therefore is INCONSISTENT with the LWRP. Policy 1. Foster a pattern of development in the Town of Southold that enhances community character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development. The as-built structures were constructed without the benefit of Board of Review. Development that does not reinforce the traditional land use patterns and comply with zoning regulations of the Town of Southold results in an erosion of the community and landscape character. The setbacks (including encroachment onto the adjacent parcel) to the southern property line for the as-built structures do not support the character of the community and built environment of the neighborhood. a v — r.>.Y W - * .M „-t•rp; M.- .:4 ",f•,.I.ty.', :,,,iye tF£w`dy J4ay; ( b >..
