The plans in the file show the 1 story frame garage with a side yard SE�':'ack of 6.5' and front yard setback of 83' from the front property boundary. The shed on the plan "s a side yard setback of 6' from the property boundary and a 77' setback from the front sh '; _ , prc. ;;rty line, therefore, the structure does not comply with the 1964 decision. The dimensions of the 1 story frame garage have also changed. The variance approved a 32' x 22' structure and the existing structure is shown as 48' x 22'. RAYMOND RAIMONDI #6957= Request for Variances from Article III Section 280-15 and the Building Inspector's February 23, 2016 Notice of Disapproval based on an application for building permit to demolish existing dwelling and construct new single family dwelling, at; 1) proposed construction places existing accessory garage in location other than the code required rear yard, 2) 'as built' accessory shed at less than the code required side yard setback of 20 feet; located at: 1150 Mason Drive (adj. to Haywaters Cove) Cutchogue, NY. SCTM#1000-104-7-6 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program,(LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the existing 1 story frame garage and existing shed is INCONSISTENT with the below listed Policy Standards and therefore is INCONSISTENT with the LWRP. Policy 9. Foster a pattern of development in the Town of Southold that enhances community character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development. The 1 story frame garage does not comply with a past Board of Review variance and the as- built shed does not conform to zoning regulations. Development that does not reinforce the traditional land use patterns and comply with zoning regulations of the Town of Southold could result in an erosion of the community character and adverse effects of development. Pursuant to Chapter 268, the Board shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. Weber, revised January 22, 2016, and stamped approved on February 17, 2016. Permit to construct and complete project will expire two years from the date the permit is signed.
