Main Rd. &Youngs Ave.) cn Southold, NY 11971 ® �pQ Telephone: 631 765-1935 OOUNT�,� LOCAL WATERFRONT REVITALIZATION PROGRAM TOWN OF SOUTHOLD MEMORANDUM To: John Bredemeyer, President Town of Southold Board of Trustees From: Mark Terry, LWRP Coordinator Date: July 18, 2016 Re: Local Waterfront Revitalization Program Coastal Consistency Review for ROBERT & FLORENCE TAYLOR SCTM# 1000-116-5-11 Suffolk Environmental Consulting on behalf of ROBERT & FLORENCE TAYLOR requests a Wetland Permit to demolish the existing cottage with attached deck; construct a 1,178sq.ft. footprint two-story dwelling with an 8'x18' attached deck and a variable 12'x30' attached porch; abandon existing sanitary system and install a new compliant sanitary system with surrounding 208 linear foot low-profile retaining wall; connect to public water; and install gutters to leaders to drywells in accordance to Chapter 236 of the Town Code-Storm Water Management. Location: 1010 Dean Drive, Cutchogue. SCTM# 1000-116-5-11 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action furthers the policy to the extent practicable and therefore is CONSISTENT with the LWRP policies. This recommendation is made with the following considerations: 1. There is no ability to re-locate the single family residence to outside of the AE EI 6' FEMA Flood Zone due to parcel configuration, sanitary system etc. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. All applicants for permits* including Town of Southold agencies, shall complete this CCAF for proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2. Before answering the questions in Section C,the preparer of this form should review the exempt minor action list,policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its significant beneficial and adverse effects upon the coastal area(which includes all of Southold Town). 3. If any question in Section C on this form is answered"yes",then the proposed action may affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. Thus,the action should be analyzed in more detail and, if necessary,modified prior to making a determination that it is consistent to the maximum extent practicable with the LWRP policy standards and conditions. If an action cannot be certified as consistent with the LWRP policy standards and conditions, it shall not be undertaken. Foster a pattern of development in the Town of Southold that enhances community character, preserves open space,makes efficient use of infrastructure,makes beneficial use of a coastal location,and minimizes adverse effects of development. See LWRP Section III—Policies;Page 2 for evaluation criteria. ® Yes ❑ No ❑ Not Applicable As indicated within Policy 1, "Development that does not reinforce the traditional land use pattern of the Town of Southold would result in a loss of the community and landscape character of Southold." this proiect is a proposal to replace an existing Dwelling 8. Decking with a new dwelling &decking all located within an almost entirely developed neighborhood. The proposal, as designed will not result in any adverse effects to the surrounding environment in that the project will simply replace existing structures that have existed harmoniously hereon for over fifty_(50) years without any form of adverse impact to the surrounding community. Accordingly,we believe that this proiect is consistent with this policy. Attach additional sheets if necessary Policy 2. Protect and preserve historic and archaeological resources of the Town of Southold. See LWRP Section III—Policies Pages 5 through 7 for evaluation criteria ® Yes ❑ No ❑ Not Applicable Subject proposal will not adversely impact the visual quality of the surrounding area in that the subject parcel was already improved with an existin single-family dwelling which has not impeded visual quality or the value of local scenic resources. Therefore we feel that the instant oroposal fully complies with this Policy. Attach additional sheets if necessary NATURAL COAST POLICIES Policy 4. Minimize loss of life,structures, and natural resources from flooding and erosion. See LWRP Section III—Policies Pages 8 through 16 for evaluation criteria ® Yes ❑ No ❑ Not Applicable The proposal is for the construction of a new dwelling with decking in place of existing dwelling and deck The dwelling and deck will be 120-feet from MHW and will comply with all applicable FEMA Regulations Therefore we feel that the instant proposal fully complies with this Policy. See LWRP Section III - Policies Pages 16 through 21 for evaluation criteria ® Yes ❑ No ❑ Not Applicable The new construction features full stormwater control whereas the existing structure contains no stormwater control In addition the existing non-compliant cesspool serving the existing structure would be replaced by a new septic system that would comply with the Suffolk County Sanitary Code in all respects Conseauently,this project complies with this Policy. Attach additional sheets if necessary Policy 6. Protect and restore the quality and function of the Town of Southold ecosystems including Significant Coastal Fish and Wildlife Habitats and wetlands. See LWRP Section III—Policies; Pages 22 through 32 for evaluation criteria ® Yes ❑ No ❑ Not Applicable Again, all proposed activity is to take place a minimum of 120' from the landward edge of tidal wetlands, fully conforming with the requested wetland setbacks of the Town of Southold Further, the original structures have harmoniously existed hereon for over fifty (50) years without any form of adverse impact to the surrounding ecosystems. Finally, because the proiect will result in a fully SCDHS conforming sanitary system the overall environmental condition of the property will increase Consequently, this proiect complies with this Policy.
