Main Rd. &Youngs Ave.) Southold, NY 11971 ® �pQ Telephone: 631 765-1938 l�I'OUNTI,� LOCAL WATERFRONT REVITALIZATION PROGRAM TOWN OF SOUTHOLD MEMORANDUM To: John Bredemeyer, President Town of Southold Board of Trustees From: Mark Terry, LWRP Coordinator Date: July 18, 2016 Re: LWRP Coastal Consistency Review for BRIM FISHERS ISLAND TRUST, c/o JOHN BRIM SCTM# 1000-4-3-3 Docko, Inc. on behalf of BRIM FISHERS ISLAND TRUST, c/o JOHN BRIM requests a Wetland Permit and a Coastal Erosion Permit to construct a 4' wide by +/-181 linear foot long fixed wood pile and timber pier; a 3.5'x20' ramp; an 8'x20' floating dock with four (4) restraint piles; install four(4) tie-off piles; relocate boulders within the vicinity of the proposed float and berthing areas under the new pier; and on top of existing concrete foundation pier located in beach area construct a proposed +/-18'x28' wood platform. Located: 3206 Brooks Point Road, Fishers Island. SCTM# 1000-4-3-3 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it-is my recommendation that the proposal is INCONSISTENT with the below referenced LWRP Policies and therefore, INCONSISTENT with the LWRP. 4.1 Minimize losses of human life and structures from flooding and erosion hazards. The following management measures to minimize losses of human1ife and structures from flooding and erosion hazards are suggested: A. Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. 1. Avoid development other than water-dependent uses in coastal hazard areas. Locate new development which is not water-dependent as far away from coastal hazard areas as practical. a. No development is permitted in natural protective feature areas, except as specifically allowed under the relevant portions of 6 NYCRR 505.8. Although the action is a water dependent use, the location of the proposed dock is within the Coastal Erosion Hazard Area (CEHA) and will be constructed in the nearshore area and on the beach. All development is prohibited in the nearshore area pursuant to § 111 A 1. and beach pursuant § 111-12 unless specifically provided for by Chapter 111, 'COASTAL EROSION HAZARD AREAS. Pursuant to § 111-6 (below) allowable activities in these areas may include open timber piles or other similar open work supports with a top surface area of less than 200 square feet which are removed in the fall of each year. The proposed fixed dock has a top surface area of 724 square feet (excluding ramp and float). Therefore, the dock, as proposed, is prohibited in the nearshore area and on the beach pursuant to Chapter 111, COASTAL EROSION HAZARD AREAS. § 191-6. Definitions. UNREGULATED ACTIVITY -- Excepted activities which are not regulated by this chapter include but are not limited to elevated walkways or stairways constructed solely for pedestrian use and built by an individual property owner for the limited purposes of providing noncommercial access to the beach; docks, piers, wharves or structures built on floats, columns,:open timber piles or other similar open work supports with a top surface area of less than 200 square feet or which are removed in the fall of each year, normal beach grooming or cleanup; maintenance of structures when normal and customary and/or in compliance with an approved maintenance program;planting vegetation and sand fencing so as to stabilize or entrap sand in primary dune and secondary dune areas in order to maintain or increase the height and width of dunes, routine agricultural operations, including cultivation or harvesting, and the implementation of practicesrecommended in a soil and , water conservation plan as defined in§ 3, Subsection (12), of the Soil'and Water Conservation Districts Law;provided, however, that agricultural operations and implementation of practices will not be construed to include any activity that involves the construction or placement of a structure. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. This project is consistent with this policy because.the proposed elevation of the pier is at an acceptable height above the bottom sediments beneath which tidal wetlands vegetation or even submerged aquatic vegetation may spread. The NYS DEC prepared a study showing that pressure-treated Southern Yellow Pine timber product construction materials are suitable for this type of proffiect except for deckin which will be of untreated woods or composite (or plastic) materials.
