Main Rd. &Youngs Ave.) G � Telephone: 631 765-1938 Southold, NY 11971 ® a0 P couff 1,� LOCAL WATERFRONT REVITALIZATION PROGRAM TOWN OF SOUTHOLD MEMORANDUM , To: John Bredemeyer, President Town of Southold Board of Trustees From: Mark Terry, LWRP Coordinator Date: August 11, 2016 Re: Local Waterfront Revitalization Program Coastal Consistency Review for HARRINGTON FAMILY LIMITED PARTNERSHIP, c/o DAVID HARRINGTON SCTM# 1000-2-1-12.2 Docko, Inc. on behalf of HARRINGTON FAMILY LIMITED PARTNERSHIP, c/o DAVID HARRINGTON requests a Wetland Permit and a Coastal Erosion Permit to reconstruct remains of dock structure with a 5 foot wide by +/-138 linear foot long fixed wood pile and timber pier with open grate decking including four batter braced tie-off piles and ladders waterward of the apparent high water line; relocate 4' wide stairs to beach to be off of new 5'x4' fixed landing; and reconstruct an existing 3.5' wide by 34' linear foot long wood access ramp landward of the apparent high water line. Located: Private Road on Clay Point Road, Fishers Island. SCTM# 1000-2-1-12.2 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is INCONSISTENT with the below listed Policy Standards and therefore is INCONSISTENT with LWRP. 4.1 Minimize losses of human life and structures from flooding and erosion hazards. The following management measures to minimize losses of human life and structures from flooding and erosion hazards are suggested: A. Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. The proposed deck is within the Coastal Erosion Hazard Area (CEHA). All development is prohibited in the nearshore area pursuant to11§ 1-11. unless specifically provided for by Chapter 111, COASTAL EROSION HAZARD AREAS. Pursuant to § 111-6, allowable activities in these areas may include open timber piles or other similar open work supports with a top surface area of less than 200 square feet which are removed in the fall of each year. Therefore, the proposed action is prohibited in the nearshore area pursuant to Chapter 111, COASTAL EROSION HAZARD AREAS as it is not removable. § 111-6. Definitions. UNREGULATED ACTIVITY -- Excepted activities which are not regulated by this chapter include but are not limited to elevated walkways or stairways constructed solely for pedestrian use and built by an individual property owner for the limited purposes of providing noncommercial access to the beach; docks, piers, wharves or structures built on floats, columns, open timber piles or other similar open work supports with a top surface area of less than 200 square feet or which are removed in the fall of each year; normal beach grooming or cleanup; maintenance of structures when normal and customary and/or in compliance with an approved maintenance program; planting vegetation and sand fencing so as to stabilize or entrap sand in primary dune and secondary dune areas in order to maintain or increase the height and width of dunes; routine agricultural operations, including cultivation or harvesting; and the implementation of practices recommended in a soil and water conservation plan as defined in § 3, Subsection (12), of the Soil and Water Conservation Districts Law; provided, however, that agricultural operations and implementation of practices will not be construed to include any activity that involves the construction or placement of a structure. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. Town of Southold Mts LWRP CONSISTENCY ASSESSMENT FORMA. INSTRUCTIONS 1. All applicants for permits* including Town of Southold agencies, shall co CCAF for proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except for minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list,policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its significant beneficial and adverse effects upon the coastal area (which includes all of Southold Townj 3. If any question in Section C on this form is answered "yes" or "no", then the proposed action will affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. Thus, each answer must be explained in detail, listing both supporting and non-supporting facts If an action cannot be certified as consistent with the LWRP policy standards and conditions, it shall not be undertaken. A copy of the LWRP is available in the following places: online at the Town of Southold's website (southoldtown.northfork.net), the Board of Trustees Office, the Planning Department, all local libraries and the Town Clerk's Office. Provide all proposed Best Management Practices that will further each policy. Incomplete answers will require that the form be returned for completion. DEVELOPED COAST POLICY Policy 1. Foster a pattern of development in the Town of Southold that enhances community character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development. See LWRP Section III—Policies; Page 2 for evaluation criteria. X Yes No Not Applicable The pier reconstruction makes appropriate benificial use of an existing waterfront site and complies with environmental design factors published by the NYS DEC and the DOS Coastal Management Program, Southold Local Law No. 6 2004 and the Southold LWRP The pier will be built to a 4-foot deck height (8 FT MLW elevation level) over the bottom sediments at the Apparent High Water Line until passing the Apparent Mean High Water Line where the clearance will be approximately 5 feet and gradually increasing. Rails will be 42 inches above the deck There will be no impairment of waterflow or navigation. Policy 2. Protect and preserve historic and archaeological resources of the Town of Southold. This project proposes to reconstruct the deteriorated dock facility to meet current standards consistent with safe boating and public access standards and typical climatological conditions. The pier will also be typical in construction to docks in similar coastal waters. NATURAL COAST POLICIES Policy 4. Minimize loss of life, structures, and natural resources from flooding and erosion. See LWRP Section III—Policies Pages 8 through 16 for evaluation criteria. X Yes No Not Applicable 3 This project is consistent with this policy because it proposes the elevation of the pier reconstruction at an acceptable height above the bottom sediments through which adjacent tidal wetlands vegetation may spread The deck height will also allow significantly improved light passage which will be conducive to growth of eel grass in the shallow nearshore waters The dock site however is so rocky and so heavily shaded by brush, understory vegetation and trees surrounding the cove that tidal vegetation along the shoreline is minimal. No adverse impact on tidal or submerged vegetation is anticipated as a result of the proposed project. In addition, the NYS DEC prepared a study showing that the proposed pressure- treated Southern Pine timber products construction materials are suitable for this type of project in this location, except for decking which will be of untreated woods or composite or plastic)materials As mentioned earlier, the design parameters shown on the drawings provides an optimum balance between acceptable design and access standards without depriving the wetlands vegetation the opportunity to spread. Policy 7. Protect and improve air quality in the Town of Southold. See LWRP Section III — Policies Pages 32 through 34 for evaluation criteria. Yes No X Not Applicable There is no solid waste or hazardous substances to be generated from this project The pressure-treated wood trimmings from the dock construction will be collected and disposed of in accordance with current regulations so as to minimize any harmful affect. PUBLIC COAST POLICIES Policy 9. Provide for public access to, and recreational use of, coastal waters, public lands, and public resources of the Town of Southold. See LWRP Section III— Policies; Pages 38 through 46 for evaluation criteria. Photograph 1 This photograph shows the full length of structure to be rebuilt, looking from about 100 offshore looking in an easterly direction from West Harbor. The piles, stringers and timbers will be removed in the demolition process. Reference piles will be left in place to make sure that the alignment of the pier is true to the long standing structure. The pier will be higher than the existing elevation in order to avoid wave buildup in these shallow waters when approaching from the west. The end of the pier will be at approximately the elevation of the existing deck, 6 feet above mean low water. f t Photograph 2 This photograph shows the isolated piles at the end of the pier,which will be deleted from the project. The remaining structure is minimal,the length is unnecessary to reach adequate depth for small to medium motor boating access. This photograph also shows the rocky shorefront sediments and the boulder to the south side of the main pier. The boulder will be spanned over by the new structure. The new decking over this boulder will be considerably higher by several feet to provide maximum clearance above waves which break on the shore. Clearly this is a fairly natural waterfront with a rocky shoreline and stony beach characteristics. There is minimal tidal wetlands vegetation at the site along the shore at the dock site and home that will be adversely impacted by the project or the use of this facility.
