SCOLLARD INTER VIVOS CREDIT SHELTER TRUST SCTM# 1000-123-10-3 En-Consultants on behalf of GLORIA A. SCOLLARD INTER VIVOS CREDIT SHELTER TRUST requests a Wetland Permit to construct a 16'x32' swimming pool surrounded on three sides by a 4' to 8' wide (448sq.ft.) on-grade masonry patio; and install pool enclosure fencing, a pool equipment area, and a pool drywell. Located: 905 Willis Creek Drive, Mattituck. SCTM# 1000-123-10-3 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is CONSISTENT with the below listed Policy Standards and therefore is CONSISTENT with LWRP. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. This assessm ent is intended to supplem ent other inform ation used by a T ow n of Southold agency in m a k in g a d e t e r m in a t i o n o f c o n s i s t e n c y. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its significant beneficial and adverse effects upon the coastal area(which includes all of Southold Town). If any question in Section C on this form is answered "yes" or "no", then the proposed action will affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. Thus, each answer must be explained in detail, listing both supporting and non- supporting facts. If an action cannot be certified as consistent with the LWRP policy standards and conditions, it shall not be undertaken. A copy of the LWRP is available in the following places: online at the Town of Southold's website (southoldtown.northfork.net), the Board of Trustees Office, the Planning Department, all local libraries and the Town Clerk's office. See LWRP Section III - Policies; Pages 22 through 32 for evaluation criteria. ®Yes ❑ No ❑ Not Applicable The proposed swimming pool is proposed at the highest point of the subject property at an elevation of 14 feet above mean sea level and thus will not interfere with the groundwater table Both the swimming pool and associated pool patio have been designed to remain landward of the tidal wetlands jurisdiction of the New York State Department of Environmental Conservation and exceed the 50'setback from the mean high water line and tidal wetlands associated with Willis Creek,as required by Section 275-3(D)(1)(a)(5)of the Wetlands Law of the Town of Southold As a result of the proposal,lot coverage as defined by Chapter 280 of the Town Code will increase only by 12 percent to 7 5 percent A temporary project limiting silt fence will beset in place between the work site and Willis Creek to control and contain site disturbance and potential runoff during construction,and a pool drywell will be permanently installed upon completion of construction to capture pool backwash Therefore,the project will not result in the physical loss,degradation,or functional loss of ecological components or otherwise adversely impact the adjacent tidal wetlands or waters of the Town and will thus be consistent with Policy 6 Attach additional sheets if necessary Policy 7.
