KWIT REVOCABLE TRUST, c/o SUSAN KWIT, TRUSTEE SCTM# 1000-117-5-48.1 En-Consultants on behalf of THE SUSAN T.H. KWIT REVOCABLE TRUST, c/o SUSAN KWIT, TRUSTEE requests a Wetland Permit to construct approximately 139 linear feet of vinyl bulkhead in-place of and 12" higher than existing timber bulkhead; construct±8' of vinyl bulkhead to close off an existing 8'x14' boat slip and ramp to be filled/removed; construct±8' northerly return; backfill bulkhead and boat slip with approximately 50 cubic yards of clean sand/loam to be trucked in from an approved upland source; remove existing 3'x21'fixed dock; construct a 4'x6' platform and 3'x14' ramp to existing 6'x80'floating dock; relocate two existing light poles and install a third light pole in compliance with the standards set forth by Section 172-5 of the Town Code; and to remove existing utility poles and overhead wires and install buried electric. Located: 906 Old Harbor Road, New Suffolk. SCTM# 1000-117-5-48.1 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is CONSISTENT with the below listed Policy Standards and therefore is CONSISTENT with LWRP provided: 1. Turbidity controls are required. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. DECD ❑ 9E Town of Southold LWRP CONSISTENCY ASSESSMENT FORM SEPI 2 2015 A. INSTRUCTIONS Southold Town 1. This assessor ent is intended to supplem ent other inform ation used by a T ow n of Southold agency in m a k i n g a d e t e r m i n a t i o n o f c o n s i s t e n c y. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its significant icant beneficial and adverse effects upon the coastal area (which includes all of Southold Town). If any question in Section C on this form is answered "yes" or "no", then the proposed action will affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. Thus, each answer must be explained in detail, listing both supporting and non- supporting facts. If an action cannot be certified as consistent with the LWRP policy standards and conditions, it shall not be undertaken. A copy of the LWRP is available in the following places: online at the Town of Southold's website (southoldtown.northfork.net), the Board of Trustees Office, the Planning Department, all local libraries and the Town Clerk's office. Minimize loss of life, structures, and natural resources from flooding and erosion. See LWRP Section III - Policies Pages 8 through 16 for evaluation criteria ® Yes ❑ No ❑ Not Applicable For the purpose of maintaining the property's historical method of protection against erosion and flooding,the project proposes to construct a vinyl bulkhead in place of existing timber bulkheading,a 391f portion of which was permitted pursuant to Southold Trustees Permit No. 3800. The existing,undeveloped land has been retained and protected from flooding and erosion by a bulkhead that continues around the surrounding dredged and bulkheaded canal that was created prior to 1955,and there is no viable non-structural alternative means of maintaining and protecting the upland portion of the property in its current location. Without replacement and maintenance of the bulkhead,the subject and adjacent properties would be exposed to severe flooding and erosional damage. Therefore the project is consistent with Policy 4. See LWRP Section III - Policies Pages 16 through 21 for evaluation criteria ®Yes ❑ No ❑ Not Applicable The project is consistent with Policy 5 to the extent that the existing treated timber bulkhead will be replaced with a bulkhead constructed with vinyl sheathing and a 10'wide nonturf buffer will be established adjacent to the new bulkhead,which can serve as both a sink and filter for surface water runoff and potential contaminants contained therein. Attach additional sheets if necessary Policy 6. Protect and restore the quality and function of the Town of Southold ecosystems including Significant Coastal Fish and Wildlife Habitats and wetlands. See LWRP Section III - Policies; Pages 22 through 32 for evaluation criteria. ®Yes ❑ No ❑ Not Applicable The project will effectively maintain the historically preexisting conditions along this bulkheaded canal shoreline without any change in or significant adverse impact on the adjacent unvegetated wetland area or tidal waters of the Town,but consistent with the Policy 6 goal of protecting and restoring the quality and function of Town of Southold ecosystems,the project will provide the ecological benefits associated with replacing a treated timber bulkhead with untreated vinyl sheathing and establishing a 10'wide nonturf buffer adjacent to the bulkhead. The project also proposes the removal of an existing Y x 21'fixed dock and the filling of an existing boat slip/ramp in favor of a platform and ramp to the existing floating dock.
