SCTM# 1000-51-4-8 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is INCONSISTENT with the below listed Policy Standards and therefore is INCONSISTENT with LWRP. 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction I. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. The as-built construction was not authorized by Board of Trustee permits. Said permit was granted a one year extension on January 21, 2015. The original site plan prepared by Jeffrey Butler, P.E. was the basis of the work depicted in the permit. At the time of the design, the adjoining property slope to the west was vegetated and stable. This was the basis of the use of terracing to restore the slope from the proposed new bulkhead to the proposed retaining wall which was meant to create a new top of slope. The following is a time line depicting how conditions on the westerly property changed: 1. June 19, 2012: Site plan by Jeffrey Butler. At this time, adjoining bulkhead on property to the west was entirely intact. 2. October 29, 2012 Hurricane Sandy destroyed approximately 20 feet of bulkhead of adjacent property, which exposed the westerly property line, causing slope to collapse. 3. From Sandy to the Spring of 2015, it is estimated the adjacent property lost in excess of 1000 yards of fill. Conditions on the adjoining property had deteriorated to the point that made the reconstruction of the slope by the use of timber terracing and re-vegetation no longer a viable solution. The slope continued to erode to a point within seven(7) feet of the house, which posed a serious danger that the foundation would be compromised. In addition, the removal of the concrete bulkhead was not possible because the seaward conditions would not allow a barge to conduct the removal work, nor was the property owner able to engage a contractor to accomplish this. With the reality of on site conditions and the threat to the existing structure, amendments to the plan were instituted in a way that recognized the severity of the conditions. What was constructed was a solution necessary for the severity of the problem that would protect the slope against further Sandy type storms and normal coastal storms. Further, due to the severe 4 Y r .y erosion threatening the structural integrity of the premise, it was necessary to proceed with the work on an emergency basis, which did not allow for the time of seeking an amendment of the permit in advance. The following is a narrative of what had been approved in the permit and what had been amended to meet changed on site conditions: Not Constructed. 1. Construction of 65 linear feet of steel bulkhead with 20 foot and 10 foot returns 2. Removal of collapsed steel bulkhead behind concrete bulkhead 3. Construction of approx. 47 feet of vinyl retaining wall with 9ft. and 10 ft. returns at top of bluff. 4. Construction of timber terrace retaining walls on face of bluff to retain proposed fill and plantings. Not Removed 1. Collapsed steel bulkhead behind concrete bulkhead. 2. Removal of concrete seawall Removed 1. Collapsed staircase 2. Collapsed steel sheet piling retaining wall from face of bluff Amended 1. Stabilize the concrete bulkhead by placing approximately 1000 tons of large stones in between steel bulkhead and concrete bulkhead. Top off with 4-6+ stones 2. Cut collapsed steel bulkhead down below finish grade 3. Construct a six tiered retaining wall system, completely integrated, to stabilize slope and protect westerly property line. 4. Replace collapsed brick patio with natural irregular blue stone from house to top of retaining wall. 5. Redesign stairway to attach to retaining walls. Stairway same width and slightly less in length at 45.2 feet as to the approved length of 50 feet. There are two landings, one at the top is 23 sq.ft. and at the bottom is 24.5 sq.ft. The permit merely refers to landings down the slope. In addition there are two irregular bluestone patios on two tiers. They are 73 sq.ft and 176 sq. ft. respectively. 6. A gabion return wall was constructed at the westerly adjoining property line to protect the slope from storms until, and at such time, that a new bulkhead and slope restoration was in place. As of this letter, work has commenced on the bulkhead with three retaining walls and two 20 foot returns. The contractor is coordinating with the owner so that a number of the gabions will be removed to accommodate the return along the lower property line. Note: The heavy winds and storms of the winter of 2016 that destroyed the remainder of the adjoining property's bulkhead and washed away several more hundred yards of slope. would have washed away the lower portion of the slope from the bottom retaining wall to the concrete bulkhead. Some gabion baskets, weighing 2 tons apiece, shifted slightly from undermining, but held. 7. The permit called for the re-vegetation of the slope with native vegetation with a 10 foot non turf buffer seaward of the Coastal Erosion line. The Coastal Erosion line is at the height.of the top retaining wall lying•between there and the house. There are five tiers between each retaining wall and the area from the base of the lower wall to the stone ground cover. In this area is planted some 10,000 American beach grass along with some 325 rosa rugosa. 8. A small sand beach area at the base of the retaining wall on the easterly side was constructed . The sand beach is approx. 450 sq.ft. with a retaining wall support structure along its northern and eastern sides. The end result is a restructuring of the badly damaged slope in the only practical way that provides a re-vegetation that will not be compromised by future storms, a top of bank that is in the same location as proposed by the vinyl retaining wall but with a stronger structure and a re- strengthened concrete bulkhead to withstand storm events. SCTM# 51-4-8 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP. The due to property size, the relocation of the existing structure is not practical. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
