Duryea Jr. State Office Building, 250 Veterans Memorial Highway, Hauppauge, New York, on March 23, 2017, and upon all other papers in this matter, the Board makes the following determination. NATURE OF GRIEVANCE AND RELIEF SOUGHT The petition pertains to additions and alterations to an existing single-family dwelling, two stories in height, Type 5B wood-frame construction, approximately 1,400 square feet in gross area, located at 1025 North Sea Drive, Town of Southold, County of Suffolk, State of New York. Relief is sought from 19 NYCRR Part 1220, The Residential Code of New York State, Section R311-6.1, which requires that ramps shall have a maximum slope of one unit vertical in 12 units horizontal. Where it is technically infeasible to comply because of site constraints, ramps have a maximum slope of one unit vertical in eight horizontal, 12 5 percent slope [The Petitioner requests relief to allow a ramp that is accessory to a single-family dwelling, and attached to an exterior deck, to have a slope of 23 percent.] FINDINGS OF FACT 1. The building that is the subject of this petition had an existing wood deck around the perimeter of the dwelling, which the Petitioner has stated was constructed in 1973. The deck had an existing attached ramp that was used to access the beach The Petitioner has stated that the deck and ramp had a Certificate of Compliance. Because the original deck was aged and deteriorated beyond repair, a decision was made to replace the deck, ramp, and structure in its entirety 2 The dwelling, deck, and ramp are located in a Coastal Erosion Hazard Zone, and the owners, along with obtaining a NEWYORK Department STATE OF OPPORTUNITY ®f State Petition No 2016-0424 Page 2 building permit, were also required to obtain a Coastal Erosion Management Permit from the Town of Southold Board of Trustees. This permit was granted to permit the owners to replace the deck, stair, and ramp "in-kind." 3. The existing ramp in question, when constructed, had a slope of approximately 23 percent. As stated by the Petitioner, because of the "in-kind" condition in the approval from the Board of Trustees, the new deck and ramp were reconstructed the exact same size with the same slope. 4 The Petitioner has also stated that after the proposed plans were submitted to the Town of Southold Building Department, the plans were"approved without any changes noted, and the building permit was issued " 5 The exception for Section R311.6 1 stipulates that "Where it is technically infeasible to comply because of site constraints, ramps may have a maximum slope of one unit vertical in eight horizontal, 12.5 percent slope." In light of the limitations presented by the Petitioner, this Board feels that such limitations qualify as technically infeasible, and determined the ramp slope is dust under two times as much as permitted 6. The Petitioner has stated that unlike the original ramp, the new ramp has a graspable handrail on one side, and the guardrails that would make the new ramp safer than the previous ramp. The Petitioner, in testimony, has stated he proposed to add a second Code-compliant handrail to the opposite side of the ramp 7. With the anti-slip mats, the handrails and guardrails, the Petitioner argues that strict compliance with the Code'would be unnecessary in light of alternatives which, without a loss in the level of safety, achieve the intended objective of the Code. 8. The Petitioner has submitted the contract used to construct the deck from the builder, which comes to a total of $135,000. The Petitioner has stated that with an additional $10,000 for engineering and permit feels, the total for the project came to $145,000 9. The Petitioner has stated that the cost to replace the ramp with a Code-compliant stair is estimated to be$7,500, and for this reason, would create an excessive and unreasonable economic burden. 10 The Petitioner has stated that the Board of Trustees will not allow the ramp to be extended any further into the Coastal Erosion Hazard Zone to lessen the slope, and for this reason, would by physically or legally impracticable 11. The Petitioner has stated that the ramp "Is only accessory and used mostly in the summer months for access to the beach." Petition No. 2016-0424 Page 3 CONCLUSION OF LAW Strict compliance with the provisions of the Uniform Fire Prevention and Building Code would entail practical or unnecessary hardship, and would create an excessive and unreasonable economic burden, and would be unnecessary in light of alternatives which ensure the achievement of the Code's intended objective more efficiently, effectively, or economically, and would be physically or legally impracticable. The granting of this variance would not substantially adversely affect the Uniform Code's provisions for health, safety, and security. DETERMINATION WHEREFORE IT IS DETERMINED that the application for a variance from 19 NYCRR Part 1220, Section R311-6 1, be GRANTED with the following conditions: 1. That the Petitioner will mechanically fasten and maintain the anti-slip mats on the subject ramp to help prevent slipping 2. That Code-compliant graspable handrails on both sides of the ramp will be installed 3. In the event that the ramp is damaged beyond repair, requiring replacement, a new Code-compliant stair or ramp shall be installed This decision is limited to the specific building and application before it, as contained within the petition, and should not be interpreted to give implied approval of any general plans or specifications presented in support of this application.
