The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation that
if the jurisdictional setback is correct, the action is CONSISTENT with the below listed Policy
Standards and therefore is CONSISTENT with LWRP provided:
1. A vegetated, non-turf buffer is established landward of the wetland line to further Policy
6. Existing vegetation should be included in the buffer.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its

SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration
in this application and determines that this review falls under the Type II category of the State's List of
Actions,without further steps under SEQRA.
SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the
Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of
Planning issued its reply dated July 1, 2016, stating that this application is considered a matter for local
determination as there appears to be no significant county-wide or inter-community impact.
LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront
Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization
Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated July 26,
2016. Base4 upon the information provided on the LWRP Consistency Assessment Form submitted, as
well as the records available, it is the recommendation of this department that the proposed action is
CONSISTENT with LWRP policy standards and therefore is CONSISTENT with the LWRP.
SUFFOLK COUNTY SOIL AND WATER CONSERVATION DISTRICT: The application was
referred for an evaluation and recommendation. According to the information provided in letter dated
August 2, 2016, and following an evaluation conducted on August 2, 2016, it was recommended that any
small trees on the bluff face be cut at the base leaving the root system intact, and that the proposed
swimming pool and patio be placed as far back from the bluff as reasonably feasible to reduce the
potential for retaining wall damage and consequent bluff erosion. Also, in order to prevent degradation of
the bluff's integrity and to minimize environmental impacts, the Soil District has recommended that
construction be handled with care and done by hand wherever possible. Since excess idling of heavy
machinery creates the potential for soil erosion and deposition into the Mattituck Creek, all machinery
should be turned off when not being used.
PROPERTY FACTS/DESCRIPTION: The subject property is a 3.76 acre parcel in the R-80 Zoning
District with 318.19 feet of frontage along Howard's Branch of Mattituck Creek to the east. The
northerly lot line having approximately 553.31 feet abuts a residential property; the southerly line having

702.57 feet abuts another residential property, and the westerly line having 240 feet fronts Cox Neck
Road. The parcel is improved with a single-family dwelling,and a boat ramp with floating dock,as
shown, with proposed swimming pool and patio, on the survey drawn by Kenneth M. Woychuk Land
Surveying,PLLC,dated July 29,2014,last revised April 28,2016.
BASIS OF APPLICATION: Request for Variance(s) from Article III, Section 280-15, and Article XXII,
Section 280-116A, and the Building Inspector's May 19, 2016 Notice of Disapproval based on an
application for a building permit to construct an accessory in-ground swimming pool, at; 1) proposed
accessory in-ground swimming pool in other than the code required rear yard, 2) proposed accessory in-
ground swimming pool is less than the code required setback of 100 feet from the top of the bluff.
RELIEF REQUESTED: The applicant requests a variance in order to construct a swimming pool to be
located in a side yard area rather than the required rear yard, and a second variance to situate the pool 72
feet from the top of the bluff where 100 feet is required.
ADDITIONAL INFORMATION: The property was the subject of ZBA decision #4068, dated April 30,
1998, in which lot width and upland area relief for a subdivision was granted, although, a subdivision
map has not been filed or recorded. No neighbors have submitted letters of objection to the project.
FINDINGS OF FACT/REASONS FOR BOARD ACTION:
The Zoning Board of Appeals held a public hearing on this application on August 4,2016,at which time
written and oral evidence were presented. Based upon all testimony, documentation,personal inspection
of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following
facts to be true and relevant and makes the following findings:
1. Town Law 4267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the
character of the neighborhood or a detriment to nearby properties. The pool will be tucked into a side
yard surrounded on two sides by the existing dwelling. The pool will not be visible from Cox Neck Road,
and will be well screened from the nearest neighbor by established vegetation. The adjacent home closest
to the proposed pool area is situated+150 feet from the pool site in this R-80 neighborhood.
2. Town Law §267-b(3)(b)(2).The benefit sought by the applicant cannot be achieved by some method,
feasible for the applicant to pursue, other than an area variance. This property slopes downward toward
wetlands and Mattituck Creek, and there is no rear yard area suitable for the placement of a swimming
pool.
3. Town Law §267-b(3)(b)(3). The variances granted herein are mathematically substantial,
representing 100%relief from the code for the side yard location, and 28%relief for the distance from the
top of the bluff.However,the rear yard consists of steeply declining terrain,sloping towards wetlands and
Mattituck Creek, and the relatively flat side yard is the most suitable area for the pool placement. The
proposed setback for the pool from the creek is greater than the setback of the existing dwelling thereby
mitigating any concerns of the LWRP Coordinator.
4. Town Law §267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this
residential community will have an adverse impact on the physical or environmental conditions in the
neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management
Code. The pool placement will have a greater setback from the creek than the existing dwelling, and will
not create a detriment to the top of the bluff and the existing wetlands with the conditions imposed herein.

5. Town Lav 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel
after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive
knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the
time of purchase.
6. Town Lav §267-b. Grant of the requested relief is the minimum action necessary and adequate to
enable the applicant to enjoy the benefit of a new swimming pool located in a nonconforming side yard,
while preserving and protecting the character of the neighborhood and the health, safety and welfare of
the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test
under New York Town Law 267-13, motion was offered by Member Horning , seconded by Member
Schneider,and duly carried,to
GRANT the variances as applied for, and shown on the survey drawn by Kenneth M. Woychuk
Land Surveying,PLLC, dated July 29,2014, last revised April 28,2016.
SUBJECT TO THE FOLLOWING CONDITIONS:
1. The applicant will adhere to the construction practices outlined in the memorandum submitted by
Suffolk County Soil and Water Conservation District dated August 2,2016.
2. Pool mechanicals shall be placed in a sound deadening enclosure.
3. Drywell for pool de-watering shall be installed.
That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued.
Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in
delays and/or a possible denial by the Building Department of a building permit, and may require a new
application and public hearing before the Zoning Board of Appeals.
Any deviation from the variances) granted herein as shown on the architectural drawings, site plan
and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this
application when involving nonconformities under the zoning code. This action does not authorize or
condone any current or future use, setback or other feature of the,subject property that may violate the
Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this
action.
The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration
that does not increase the degree of nonconformity.
Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted
by the Board of Appeals shall become null and void where a Certificate of Occupancy has
not been procured, and/or a subdivision map has not been filed with the Suffolk County
Clerk,within three (3)years from the date,such variance was granted. The Board of
