SCTM# 1000-35-4- 16 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town-of Southold Town-Code-and the-Local Waterfront Revitalization Program-(LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, is CONSISTENT provided: 1. A proposed non-turf buffer that includes native, drought tolerant, beneficial plants to further Policy 6 is required. Further, it is my recommendation that the action replace in-place approximately20 linear feet-of existing timber bulkhead with vinyl bulkhead is INCONSISTENT with the below listed Policy Standards and therefore is INCONSISTENT with LWRP. 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their Jurisdiction 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. The structure was constructed without a Board of Trustee permit. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. See LWRP Section III - Policies; Pages 22 through 32 for evaluation criteria. ®Yes ❑ No ❑ Not Applicable LWRP CONSISTENCY ASSESSMENT FORM ADDENDUM FOR PAUL & PATRICIA AHLERS 1905 GULL POND LANE GREENPORT,NY SCTM#1000-35-4-16 Policies 4, 5 & 6 The project seeks to replace an existing timber bulkhead with a vinyl bulkhead, partially in the same location and partially farther landward, to maintain the property's historically existing method of land retention and protection against erosion and flooding. The project also proposes a new section of bulkhead between the replacement bulkhead and the neighboring bulkhead to the north to stem the ongoing erosion and loss of upland in the northerly end of the property. All of the new bulkheading will be constructed at the same top elevation(+/-5'MSL) as the existing +/-20' section of bulkhead to be replaced in-place, and the seaward-sloping grade behind the new bulkheading to be constructed landward of the old will be backfilled and raised to a more level elevation. Therefore, in addition to the benefit of replacing a treated timber bulkhead with untreated vinyl sheathing, the project will provide the additional ecological benefits of 1) creating approximately 167 sf of beach/tidal wetland area(in place of the existing upland area behind the/-48'and+/-7' sections of bulkhead to be removed); and 2)reducing the potential for runoff as a result of reducing the downward slope of the upland grade toward the surface waters of Gull Pond. The project also proposes to stem the ongoing erosion of the unbulkheaded shoreline at the southerly end of the property by placing stone rip-rap along the toe of the eroding embankment. Preventing the further erosion of this embankment will help to preserve the remaining tidal wetlands vegetation, e.g., Baccharis halimifolia, which is at risk of being lost completely if the embankment is allowed to continue to erode. Therefore,the project will serve to maintain and improve upon the existing bulkhead, thus protecting the property and residential structures from flooding and erosion, consistent with Policy 4; create additional wetland area on the north end of the property and preserve existing wetland vegetation at the southerly end of the property,thus protecting and restoring the quality and function of the adjacent tidal wetland ecosystem, consistent with Policy 6; and reducing the potential for stormwater runoff into the adjacent surface waters of Gull Pond, thus potentially protecting and improving water quality, consistent with Policy 5.
