BOUNDARY LINE AGREEMENT
THIS Agreement, made the day of April, 2017, between Jeffrey S. Talan and Carol
Defreitas-Talan, residing at 1475 Kennys Road, Southold, NY 11971, Party of the First Part
and Pamela A.Allen, residing at i j�Kennys Road, Southold, NY 11971, Party of the
Second Part;
WHEREAS, the Party of the First Part is the owner in fee simple of certain real property
known as and by 1475 Kennys Road, Southold, NY 11971 designated ad District: 1000,
Section: 059.00, Block: 07.00, Lot: 017.001 on the Tax map for the County of Suffolk, State
of New York and more particularly described on Schedule A attached hereto and made part
hereof(hereinafter"Parcel A"); and
WHEREAS, the Party of the Second Part is the owner in fee simple of certain real property
known as and by�'16'� Kennys Road, Southold, NY 11971, designated ad District: 1000,
Section: 059.00, Block: 07.00, Lot: 018.000 on the Tax map for the County of Suffolk, State
of New York and more particularly described on Schedule B attached hereto and made part
hereof(hereinafter"Parcel B"); and
WHEREAS, Parcel A adjoins Parcel B; and
WHEREAS,a survey of Parcel A has been prepared by John C. Ehlers, Land Surveyor, dated
September 8, 2016 (hereinafter the "Survey"), a copy of which is attached as Exhibit 1. Said
survey shows among other things a fence which runs along the southeasterly record line of
Parcel A and the northwesterly line of Parcel B, but is situate 3.9 feet inside Parcel A and.a
shed which is situate 2.4 feet inside Parcel A;
WHEREAS,the parties desire to fix and definitely establish the boundary line between the
two parcels mentions above respectively owned by them without resort to litigation; and
NOW,THEREFORE, in consideration of the mutual promises and conveyances herein
contained, and other good and valuable consideration, the receipt of which is hereby
mutually acknowledged, the parties hereto for themselves and their heirs, legal
representative, successors and assigns, covenant and agree as follows:
THAT irrespective of the placement of the fence and shed between Parcel A and Parcel B,
the common boundary line between the parcels shall be deemed the southeasterly
boundary of the property owned by the Party of the First Part and the northwesterly
boundary of the property owner by the Party of the Second Part, which is established as
being described as follows:
A line commencing at a point on the southwesterly side of Kennys Road where the division
line between a Described Parcel and Lot 9 on Map of Subdivision known as Kennewood"
filed 3/30/1954 as Map No. 2180 intersects the southwesterly side of Kennys Road;
Thence South 48 degrees 02 minutes 10 seconds West 152.40 feet to a point; marking the
northwest corner of Parcel B and the Southeast corner of Parcel A.
AND the Party of the First part does hereby remise, release and quitclaim unto the Party of
the Second Part, its successors and assigns, all of its right, title and interest in and to any
land lying to the southeast of the boundary line so established,and the Party of the Second
Part does hereby remise, release and quitclaim unto the Party of the First Part, its
successors and assigns, all of its right, title and interest in and tow any land lying to the
northwest of the boundary line so established, and
THE parties further agree and acknowledge that any use by the Party of the Second Part,
their heirs, legal representative, successors and assigns, of any portion of Parcel A lying
south of the fence is permissive and not hostile to or with any claim of rights against the
Party of the First Part,their heirs, legal representative, successors and assigns. The Party
of the Second Part further agrees that the Party of the First part, their successors and
assigns, is/are permitted to relocate the fence and shed to the record line of title at the cost
of the Party of the First Part.
IT IS MUTUALLY AGREED AND COVENANTED that this agreement shall run with the land
and inure to the benefit of and be binding upon'the parties hereto and their respective
heirs, legal representative, successors and assigns.
IN WITNESS WHEREOF,we have hereunto set our hands and seals on the date first above
mentioned.

SCHEDULE A
ALL that certain plot, piece or parcel of land, situate, lying and being in the Town of
Southold, County of Suffolk and State of New York, known and designated as Lot No. 10 and
the southerly 25 feet of Lot No. 11 and a described parcel as shown on a certain map
entitled, "Map of Subdivision known as Kennewood" and filed in the Office of the Clerk of
the County of Suffolk on March 30, 1954 as Map No. 2180, said lot, part of lot and described
parcel,when taken together, being more particularly bounded and described, according to
said map,as follows:
BEGINNING at a point on the southwesterly side of Kenneys Road where the northwesterly
