Martin - Application No. 545 Dear Mr. Costello: The following action was taken by the Board of Town Trustees during their regular meeting held on September 24, 1987 regarding the above matter. WHEREAS, Costello Marine Contracting Corp. on behalf of Jeanne E. Martin applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated May 19, 1987, and WHEREAS said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and WHEREAS, a public hearing was held by the Town Trustees with respect to said application on August 27, 1987 at which time all interested persons were given an opportunity to be heard, and WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, add WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of NOW, THEREFORE, BE IT RESOLVED that Costello Marine Contracting Corp. on behalf of Jeanne E. Martin BE AND HEREBY IS GRANTED PERMISSION UNDER THE PROVISIONS OF THE WETLAND ORDINANCE OF THE TOWN OF SOUTHOLD TO: Construct 110' of rock bulkhead with a 12' return. Trustee Bredemeyer: Are ihere any comments? George Costello: My name is George Costello. I am here to answer stay questions you may have regarding ali three of these applications. Trustee Bredemever: In that case I will open the record for the remainder of the applications which you represent, which are Jeanne Martin and Mario V. Cella which are for wetland applications on North Sea Drive. Are there any comments? No response. Is there any one who wishes to speak against this application? Walter Smith: I'm Walter Smith and I'm a resident of Orient. In looking at that 15roperty recently Father John McGuire and a Mr. Loria put structures on their property that they thought would control the erosion from the bluff. What it has done is cause an acceleration of the .erosion of the two Terry properties to the east of them. Now the summer house that Joyce Terry has, has been moved back twice since these-structures were put in place. Now I don't know if these two structures have permits, but if they don't they should be removed. We have normal beach erosion going on all the time. We loose about a foot a year along the north shore, that is' pretty well established. Anything that we put up is going to accelerate.~hat rate of-erosion. Now if we want another Kenny's beach in Orient, I think that if this is pul up, I think that we will-get that result. I would say that if this permit is granted ii would cause erosion farther to the west and cause a great deal of problems to the Two people there and the people who purchased the Terry property. I think that this should be evaluated. I think that it will do damage. Public Hearing - Page 2. Emanuel Piperakis, Jeanne Martin and Mario V. Cella Trustee Bredemeyer: The structure that you referred to, a~e you talking about a bullahead or .a retaining wall section? Walter Smith: The one that was moved back? Trustee Larsen: Where the house was moved back? Walter Smith: That was moved back twice. That was a summer house. Trustee Goubeaud: Was that from a bulkhead? Trustee Br~demeyer: A damage that resulted in moving the house. You said ~tructures. Walter Smith: The McGuires and the Lorias to the east. Trustee Goubeaud: What type of structure was put in there to cause this damage? Walter Smith: It looks like small rocks covered with wire and some other mesh. Father McGuire has been working on this for years. Trustee Goubeand: What you are saying in regard to these three applications is that any bulkheads or retaining structures along the bluff is going to d~prive the beach of the natural nourishment? ~- Walter Smith: I think the energy of the wave coming in, don't forget that we are getting alot of sea level rise, although it is not apparent in the sound itself the volume of water has increased. If you read the Stony Brook reports that will validate what I'm saying that it is putting more energy on the shore line. So if we have another hurricane it will go across these bulkheads. There are many problems that should be looked at. Thank you. Trustee Bredemeyer: Is there anyone else- here who wishes to speak on this application? Joyce Terry: I am Joyce Terry and I am now the owner of the property to the west of Father McGuire and Mr. Loria. I do have some photographs I would like to show you. Trustee Bredemeyer: I am familiar with them, but would you like to share them with the rest of the' Board? If you would like to have them entered into the file, please. Joyce Terry: That is the shack that Professor Smith was speaking about. It has been~ there ~ince 1961 and since the gabions were l~ut in it was movecL back twice. Trustee Larsen: Prior to the installation of the gabions, how much did your property recede over a five year period, lets say. Joyce Terry: Not that much. Trustee Larsen: Not that noticeable. How much have you lost since She installation? Were these taken after a storm. Joyce Terry: The.s.e were taken yestef~day. We had about 500 rugosa's and t~hink that we have 20 left. Public Hearing - Page 3, Emanuel Piperakis, Jeanne Martin and Marlo V. Cella Trustee Bredemeyer: The application shows a picture of a neighboring property. The gabions were fairly stabilized. For the individual loosing property, I can see their concern also. You are loosing, they are loosing, everyone is loosing. The question is how far do we siabilize without creating secondary effects? Joyce Terry: That is what we are concerned about 340 lin. ft. of bulkhead. Trustee Larsen; The Town right now, in fact~we are, spending $50,000.D0 to study the Kennys Beach situation, and we don~t need to.spend another $50,000.00..~ to look at more erosion as a result of these structures. Trustee Bredemeyer: These structures are not in the water. Trustee Larsen: John, you said that you are familiar with this? Trustee Bredemeyer: The erosion is a problem along the entire sound frontage. Storm Gloria and Nelsen were very bad. Trustee Larsen: Professor Smith do you know how many feet have been lost to the' down drift side? Walter Smith: Ab~out eight feet if I remember right? Constance Terry: I am west of Joyce~'~erry. We are loosing approximately 100 to 150 ft. beyond Joyce Terry~s property which abuts the McGuire's property where the gabions are, from there on the bank is leveling out. The wash in coming in around where the gabions were put in. He has put in 330 ft. more in, east of us. The bank has fallen down. I make a path down to the beach, but the bank is' falling. If yon put 330 ft. more? We have a complaint in to the Army Corps of Engineers and they are going to look into this matter and send a report. Thank yom. Virginia Gill: My name is Virginia Gill, I live on Green Acres on the east side where these people want to put up these bulkheads. I understand their desire to do so, but I am also concerned with the Terry's and the eastern portion which is part of our beach lot and our steps have been almost washed away. I am concerned with what this structure will do to all of us. George Costell~: In regard to the scouring action that the existing gabions are causing the neighbor directly to the east, Piperakis, has lost approximately six feet. Those gabion? have been~there for four or five years. It has been suggested to me by the- Army Corps and DEC, Jean Gillman, to use the rock gabions as a deterrent for the wave action. The placement of these rocks will be approximately 27 ft. above the high tide. That is mean high tide. If you look a~ Piperakis just immediately to the east of the existing you can see that there is very little erosion. In some spots 'you can see where the bank fell down. I don't understand how the existing gabions, since it is so far away from storm irides, could cause that much erosion? Three, four five, six hundred feet to the west and ~o the east? I don't believe that these rocks are going to cause any further damage. Everyone has been loosing on that coast. This is the reason why my clients want to retain their upland. This is not for beach nourishment or to stop erosion. The beach is loosing all the time. They want to keep the upper portion-of their property in tact. As yon can see, they had a fence up there they still lost property. That is ~hy they propose this structure. Public Hearing ~ - Page ~ Emanuel Piperakis, Jeanne Martin and Mario V.
